Hi all, i was ment to be on a discounted iphone tarrif through the macdonalds friend and family discount of 30%. I should be paying £24.50 but my first 2 bills have been for £37.50 and £35.00. I have had numerous calls to the accounts and billing depts. They keep telling me to go into the shop and for them to send the form i signed up with which should of been sent. I have been in twice since and the shop have said it has been done and takes 4-7 days. 8 days has since passed and still my account has not been adjusted or creditted. I have just been told by accounts to go back into the shop with my copy of the form and get it sent again. It costs £1.50 to park and is a 13mile round trip for me and i have done this twice previously.

Where do i stand with cancelling the contract and taking it all back as i am being overcharged and given them ample time to rectify the matter.

Thanks in advance

Jason

None. Your agreement with the network takes priority, as the promotional element was arranged McDonalds. According to the network, it is due to their non-compliance that is stopping the discount being applied.

As doe going there - why? PHONE the person responsible and say you've chased this twice and nothing has happened. You'd like them to send YOU the required proof and YOU'LL send it to the network. The concern is these discounts are usually set up at the time and never retrospectively, so this could become an issue.

thanks for the reply,

I have asked that question everytime about doing it over the phone and i have to go in due to data protection. It is not macdonalds error it is O2 for not sending the paper work to their iphone accounts department and or the accounts department for not ammending the account. O2 must be in breach of contract as i have not been paying the agreed tarrif at the signing of the contract surely??

I am going in again this afternoon and even though i dont like making a fuss, i feel this time i have no choice.

thanks again for taking the time to reply

It is a common cry on CAG the someone somehow must benefit from their network being 'in breach if contract', but say this without ever having actually READ their contract. I can tell you now, the amount you pay is NOT in your contract, for the sole reason this will change - probably quite often over the period you are contracted, and they are allowed to do this.

What you also forget is that you - like everyone else, will be paying the SAME standard price that the network set. The difference is that you will (or should!) receive a DISCOUNT that will bring down the amount to the agreed rate advertised in the promotion.

Furthermore, don't get bogged down in the various O2 departments, this has nothing to do with you. Identify with O2 what they don't have or what prevented them from providing you with the promised discount. Should it transpire that they are without a code or voucher from McDonalds, cut to the chase and get if for them, sending it to the named individual that requires it to process the required discount.

Just an update, after 40mins again in the shop last week and again paying out for petrol and parking i have had my account discounted. Will believe it when i get my next bill. I have to go in again!! this thurs to have them back date my account for the discount as they could not find the online form. As i wasnt given one in the first place i doubt they will find one. What joys await on thursday :-S
