hey there, just been reading alot of threads about crap1 about claiming charges back. I have 2 ongoing accounts and both are noe over the limit. I have tried twice to get a signed copy of my credit agreement but just got the usual unsigned rubbish and the blah blah blah we dont have to send you a signed one, then I sent a letter to both requesting the interest to be frozen and a payment plan set up (about 2 months ago) did have one letter stating they wud get back to me on that but never have so have now sent them a access request letter. (to which they have about another 2 weeks to reply) just wondered what I do once I received this, bearing in mind I have never used either card in years so all that is on that never seems to go down is - interest charges, overlimit charges, late payment charges and missed payment charges!!! any help would be most welcome :-)

Hi

Once you get your SAR back (and on the assumption cap1 enclose everything they're suppose to) you will be able to work out what they have charged you.

You then send the prelim letter to claim the charges back.

They will probably offer you the difference between what you were being charged and the £12 they now charge.

If you reject it, they will write back saying that is their final offer so you file at court and what has happened previously is that Cap1 will settle.

That's how I see it anyway.

There are template letters for the prelim request but you need to get all the information together first with regards to what you have been charged.

Once you get the information back go through it and calculate what they have charged you for late payment and overlimit fee's.

Have a read through the library and the faq's while you are waiting.
