Hi. I am also new to the forum. I have sent the first letter requesting a copy of my agreement which BofScot failed to reply to within the timescale of what I understand to be 12+2 working days.

I then sent the second letter stating that they were in breach of the timescale under the CCa and as such the account has become unenforceable.

This morning I have received from them a copy of the agreement.

Can anyone please advise me what step I should now take.

Hi..............the next step is to decide whether the Credit Agreement is enforcable..........it should have your signature on it for instance. You could copy it and cover any info that you do not wish to be viewed, scan it and then post it up to this forum. Someone, with more knowedge that me could then check it and tell you if is in enforcable or not. If is is not you then have the knowledge that your creditor has no hope of being able to take you to court to enforce payment. iIve just CCA'd two of my creditors and am waiting for outcome..........:)

i'd be inclined to start your own thread too rather than hijacking another, makes things confusing to who is answering who.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

The fact that they are in breach of the timescales, does that have any impact on the matter as they failed to send the agreement in the set time? They waited until I sent second letter before even acknowledging my request!!

Hi...............as far as I know and i'm not an expert by any means, the crux of the matter is getting that copy of the original credit agreement. Once you have that, if you ever do get it you can check it and then you will know for sure if the debt is enforcable by a court. if it is not the creditor/DCA's cannot force you to pay.

ok well they breached the timescale, but let that pass.

now what you need to do is scan the docs you have blotting out any direct pers info

 

let the wonderful members on here decide if its enforceable or not
