£90 parking ticket issued by Elite Parking Control LTD

Hi,

 

My name is Daniel and I received a PENALTY CHARGE NOTICE via ELITE PARTKING CONTROL LTD today at 10.45 DIGBETH, BIRMINGHAM.

 

The car park is owned by the Custard Factory which is the building I work in and these guys have recently taken over the management for parking.

Before ELITE ran the car park I used to get free parking but a letter was issued to the tenants who rent offices explaining the change over and also explaining the new tariffs etc. I received no such letter.

 

The reason the ticket was issued was because I had neither a permit nor did I have a pay and display ticket.

I park in this car park near enough everyday and usually leave my car in the car park in the morning, pop in and grab the morning post then pop down to reception to grab a permit for the day. When I went to reception they informed me I could no longer have a permit and another company had taken over the management. I walked around to the car park to find a PENALTY CHARGE NOTICE on my windscreen explaining that I now owe £90.

 

The ticket is issued for 10.45am and I sent an email as soon as my computer was on at 10.46am. Reading through other peoples threads I see an emerging pattern in regards to this. I got to my car at 11.03 by my watch and the guy was nowhere to be seen.

 

Looking around there have been signs put up on the walls of the car park and on the pay machines, every machine except for the one that i parked infront of (typical). If I had noticed these signs then i would have put £1.60 in, grabbed my post and off i would have went.

 

This company obviously means business as just after lunch that day i saw the same company lifting a car that was clamped on to the back of a lorry. not relevent sorry but errrg!

 

Anywho, can anyone help me? Any ideas of ways of getting out of paying £90, which is over 2 days wages for me as i work for a charity and get paid peanuts bad times!

Ignore it.

 

Even if their signs allege that they will tow/clamp, they cannot now do so for the [problem] invoice that you have already been given. To do so would be classed as theft/be illegal and you would be within your rights to cut the clamp off.

 

Just who has arranged for them to take over the management of the site?

You just have an unenforceable invoice. It's a [problem].

 

• do not pay

• do not contact them

• ignore all the junkmail you'll receive from them and their powerless debt collectors

• they won't take you to court

• they will give up and go away

The custard factory (which is the building we rent our offices from) own the parking land but they have given the management off their parking over to ELITE PARKING CONTROL.

 

I have scanned both sides of my ticket in the hope i could attach it and show you guys what it looks like and how it reads etc but i can't see an option that allows me to do so. Any ideas?

It will be just the same as a thousand other ones.

As explained, above, it is not a fine. It has no authority in law. It is just an unenforcible invoice that is not worth the paper it's printed on.

Just ignore it. You will receive a few letters from them threatening dire consequences if you do not pay. You may get a couple from a debt collection agency. If you're very lucky, you might even get one from a "solicitor", threatening court action........ All meaningless waffle.

Just ignore them all. don't reply to any of them. Eventually they'll get fed up an chase a softer touch.

You guys have been very helpful but one more question:

Does ELITE have no authority because they are a private management company and the ticket is not issued by the Council and if it were issued by the Council would I then have to pay? Why do they have no authority?

Sorry for the nagging questions but I want to be 100% before I start ignoring letters from the Debt collectors etc.

yes to council/police/parking warden on PUBLIC PROPERTY.

 

this is PRIVATE PROPERTY, they are intimating you read all the signs & other docs displayed or refered to before you parked. & thus automatically agreed to their terms & conditions [or implied contract] before you parked......you didn't & shouldn't have to.

Exactly.

Only the police, the council, or a Parking company appointed by the council to control council parking, can impose parking fines.

Because they are just [problematic].

hi anyone

 

my husband went to visit a friend with knee problem in walsall (west midland) he as always park at the same area on tuesday he visit and went to get the visitor parking permit by the time he returned there was a parking charge notice from ELITE MANAGEMENT (MIDLAND)LTD for £90.00 for NO PERMIT with seven days.

i know all the others say no to pay but is ELITE MANAGEMENT (MIDLAND) LTD the same as ELITE PARKING CONTROL LTD.

 

question: do i ingnore the ticket or appeal because i i do have the visitors permit.

you already answered it yourself, and you are correct ignore the ****

 

its a mail [problem] sending an INVOICE trying to say its an official parking ticket , IGNORE, they make threats of what they MAY or MAY not do its all bluster and toilet paper, part of the [problem]

 

they do give up in the end prob after 5 - 8 stupid letters
