    • Hi, I need advice please, Back in November 2018 we parked at The Southgate McDonald’s/Starbucks car park at Stansted before getting our flight.I parked at Starbucks to walk to McDonald’s. I have received letters over the years and have never acknowledged any of them . I now have a CCJ against me as I didn’t think that it was real so never answered My latest letter from dcbl is a notice of debt recovery unpaid county court judgment of £347.92.I know I should have completed the CCJ.Is there anything that I can do now or should I just pay it.Thank you bingoboy

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

i am looking to claim back monies from Paragon.

There are arrears charges, but also £20 for a phone call and £10 for a letter sent - both in relation to arrears. As it clearly doesnt cost £20 to make a 30 second call, in my opinion this institutes a penalty - has anyone claimed back monies charged in this maner?

Sent letter to ask for it back, then LBA - received offer for 50% of what i am claiming. They believe this is better than the court costs etc. Unfortunately (for them) this was received after court claim was sent, so now looking at full amount plus interest. Their response has given me confidence, as it is an admission that the charges are unlawful (without actually neing an admission etc).

Court here we come!!!:-)

They made it as a gesture, without admission of "guilt" so I guess so - clearly I will attempt to use the offer letter as part of my "evidence pack" without prejdice or not!

Hi there

 

Total newbie to the forum, but have spent the last 3 days reading lots of threads in relation to Paragon.

 

I have a PPI claim against them that has been running to 18 months now. They just keep dodging the bullet and passing the buck to intermediary, underwrite etc.

 

So decided I might go after the charges they levvied as well.

 

Reason for posting here is to find out if you used a template letter at all for the charges reclaim and if so where you got it from? Or if someone can point me in the direction of one?

 

Also does anyone know if I can claim the interest that I have obviously paid on the charges?

 

In short I am 7 years into a 20 year loan for 30K and still owe more than I borrowed!
