My wife has received a CCJ for a debt on a repossesed car.


It has been an ongoing issue, and we have dealt with Black Horse finance who have been fairly accomodating, until last year my wife was unemployed and couldnt afford the repayments.


A letter was sent to Black horse, no reply was received and the debt was passed to Sechiari, Clark and Mitchell who sent us a letter threatening action. It was not a letter before action, just asking us to contact them.


We replied, explaining the situation, offering a token payment. Again, no reply.


This morning we received a CCJ notice and now I am looking to respond.


Whilst I dont disupte the amount, although they have levied £381 in late payment fees and interest, I am a bit peeved that they have gone straight to a CCJ without a proper LBA or responding to my letters!


Is there anything I can do to defend the claim? I cant dispute I owe them the money, but really was hoping to avoid a CCJ altogether.

Ok, whenever a person or company are taken to court they are sent letters by the court ,due to hear the case, to submit their defence for the judge to read.


Are you saying you've not rec'd anything from the county court prior to the hearing date?

I have a loan with Black Horse and it has been passed onto a credit agency. However, I have been unable to sort this debt out. We get numerous amounts of letters for different missed payments we never know where we are. Very reluctant to ring in case I get pushed into agreeing something I can not afford.


I asked for a credit report and noticed that Black Horse has been adding ^ for danger on equifax since July 2008 till this present month. Surely it should have been defaulted in 2008. This account is not active at all and is a loan. I have read that companies are meant to close the account after 3 months arrears and add a default.


Any help or guidance would be most appreciative.
