      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi its me again..

 

Firstly I know I was stupid taking this out in the first place so I don't need reminding of that :(

 

Anyway, I have had several loans with these people, the loan I have outstanding now is for £300, I have already rolled it over because I couldn't afford it last month and wont be able to this month either, I done a quick search on here seeing what I could do, as I know that if it defaulted it would be passed to a dca as I have experience with this through other payday loans and am now paying 1st credit and clarity £30 each month.

 

Although reading the otehr posts on here I am not sure what to do as alot have said that wonga would not be willing to accept a payment plan from me and will carry on adding interest each day..just wanted to know what to do as I am really trying to sort my debts out. Shall I cancel my debit card and get a new one? Shall I contact Wonga and let them know my situation and offer a paymenteach month by direct debit eg £50 a month until settled or will they not accept this

 

Again, any help appreciated

Hi there, from what I understand from helping someone else - if Wonga have your card details they will empty your bank account as they try to take payment every day until they strike it lucky!! You need to cancel your card at the bank (tell them you've lost it) and get a new one.

 

Also do not set up a direct debit on your bank account to pay a small amount - they will take what they want with it.

 

Ask them for their bank details so you can make payments manually, that way you keep control.

Great, thank you so much for your help. I will cancel my card right now! Thats exactly what I thought they would do...should I send them an email/letter explaining that i'm not able to pay the full amount and offer say £50 a month?

Yes, email them and make your offer. Are you on internet banking? if so you'll need to watch your account every day to make sure they haven't tried to set up a direct debit and take the money that way. You could write to your bank (after you've received your new card) and advise them not to accept a direct debit instruction from Wonga.

Hi, just an update really. The loan is due at the end of this month, I have recieved my new debit card and certainly won't be giving them the details! I have emailed them twice now asking to pay each month but no reply, do I just wait until they pass it to a dca? Also just wanted to clarify that they definately cannot contact my employer and ask for it to be taken from my wages without a court order can they? I really do not my work knowing everything going on, although my payroll lady would probably tell them where to go lol

Just looking at the lending streams website out of interest, and the interest you pay is still extortionate, there are no good payday companies so my advice to anyone having learnt a valuable lesson is to steer clear! Wonga (just like numerous other companies i owe money to, none of which for payday loans) will just have to accept their money in installments, i would advise everyone to remeber that nobody can make you pay more then you can afford. I used to be really intimidated by these pathetic companies but knowledge is power :-)

I've just been hunting around for details about Wonga, as I've no experience of them. Not impressed by what I've read of them!

In response to your earlier question...They can't come in without your permission/take your belongings or get an attachment of earnings without having first obtained a CCJ, and then only if you don't stick to the CCJ instalments.

Hi, I have my new debit card now, but im getting a bity worried as I have seena few other threads about Wonga on here and people are saying that they can still take payments from your old debit card is this true? I have emailed them trying to set up a payment plan but they keep saying roll the loan over or call them!

They shouldn't be able to if the card has been cancelled correctly. Worth a call to your bank to ensure that they will not make any payments, albeit evidence points to them not being helpful. I believe an occasional payment can go through in error. The only safe way is to open a parachute account for salary/benefits and any other cash to go in to.

 

Hard work to get the bank to give it back if they make a payment in error!

Just make sure that you have put in writing that no payment is to be made to wonga via direct debit card (even though cancelled) or by any other means. Keep a copy then if the bank pays you have proof that you have notiified them in writing about payments.

Also, send wonga an email saying that you cannot afford to ring them and could they ring you. Send email to customer services or direct to the collections department, state you would like to sort this out and they are not be very helpful. If you do manage to set up an arrangement get them to put it in an email with also that they will not take any payments from your bank account,get a name of the person you are dealing with.

I doubt you'd get very far on the phone, whoever makes the call, they'll just bully you, as you already know. Keep it all in writing, then you have a record.

I'm tending to think you should ring Trading Standards about this bunch, and perhaps talk to CAB to see if they will negotiate on your behalf.

Failing that just write to them stating what you can afford to pay each month, enclosing a PO for that amount. Ask them to freeze interest in view of your circumstances. Be firm and INSIST that this is all you can afford, and that if they continue to press for more you will report them for harrassment.

I had a loan with Wonga which was originally for £650, with the daily interest they added on it reached £1850 - they sent me repeated e mails, which I did reply to with an offer of payment but did not receive any reply to any of them. I was then contacted by their 'solicitors' who who actually just a different department of Wonga! The debt was then passed to a company called PDP who I have found extremely helpful, they have frozen the interest, reduced the debt to £900 and are willing to take £215 a month for 4 months. Took a while, and received numerous e mails and telephone calls but got the right outcome in the end! I hope you get sorted soon!

I'm in the same boat as you Suepoo! I took out a loan for £750 then ran in financial difficulties - I have paid back by installments £380 but now Wonga has passed the debt to JBW Group who now say I owe £1881.06!!!!

 

If Wonga has accepted payments can they just pass the debt on? And what can I now do? Do I still pay Wonga the same installments £18.75 every Friday or do I stop?

 

Any help appreciated - thanks!

it might be worth checking and getting wonga to confirm they have passed on the debt just in case its a con or mistake!

I've just been reading Wonga's terms and conditions of contract! Please see below

 

 

5. Our Relationship with You

  • a. If you miss a loan repayment, or find yourself in financial difficulties and you believe you cannot afford to repay the amount due under your Agreement, you should contact us as soon as possible by email to [email protected]. We will do the following:
    • i. explain the procedures we will apply and your options;
    • ii. tell you if your account is being passed to the Collections Agency.

    [*]b. You should tell us or the Collections Agency, as the case may be, when your circumstances change in a way that may adversely impact your ability to repay the amount due under your Agreement.

    [*]c. If your relationship with us or the Collections Agency has broken down, this will be included in the information supplied to the credit reference agencies. You should be aware that this may have serious consequences for your ability to get credit in the future.

No did anyone notice that it says to email them? It doesnt say anything about call us? Harras them on the email until you get a responce. it worked with me for PdUK

Hi,

Just an updat really, wonga passed the debt onto PDP Management services in november i am paying them £40 a month which is fair enough as i acknoledge i took the loan out and do want to pay the debt off etc but...the amount they are asking for is over £1000 for a £200 loan, just wondering if i should keep paying monthly until i pay the £200 back and then stop? Wonga have already have more then then that back anyway as i rolled the loan over before it defaulted. Plus I tryed contacting them a number of times to sort the situation out but nobody replied to my emails so it just feels like they let it accumalate to this amount and I think its ridiculous really I know people will say I knew the apr etc when I signed but just wondered if I should write/email the dca and ask them?

How much had you already paid them before you defaulted?

 

You need to send a letter by recorded delivery to PDP Management asking them to provide you with a detailed statement of how they arrive at the £1,000 they are demanding. You can then try to negotiate a lower figure.

I paid them the rollover fee which was about £40 i believe now I have paid PDP £30 a month for the past 3 months. Yes thank you for the advoce, I iwll do that today and let you know the outcome.

I had alot of hassle from them constant phonecalls but after i sent the telephone harrasment letter they stopped! I emailed at least 3 times a week saying i could not afford to pay all at once and needed to set up a payment scheme and they would not accept saying they could not do this etc I stuck to my guns they kept saying you must call to discuss the account but i wanted to keep it all in writing and refused to be bullyed..it took a good couple of months to be passed over but the dca was fairly easy to deal with and happily accepted payments. Im just in teh process of trying to get the interest reduced x
