Hi,

 

well my CC companies have not been co-operating and I am going to defualt with at least one of them if I fail to pay the £900 mininmum payment. They have refused to arrange a payment plan and I cannot afford to pay the £900. :(

 

Can I ask what will happen when I default? Will the interest be frozen? I have heard that they will offer to write off some of the debt if you can make a full payment to clear the debt. Is this possible?

Have you requested the agreements yet?

 

Yes, I have done all of that. Been writing to them since January and have heard nothing. They keep treatening to forward my account to a debt collection company.

 

I would just like to know what is going to happen when they do?

if you have sent off the CCA request and they have not responded then send the account in dispute letter.

This should stop then moving it on to the scumbags, and nothing should happen until they come up with the agreements

Thanks for the advise. I have already sent off all of those letters though. I don't have anymore options but to let the account defualt.

Hi, have you got proof of delivery for your CCA Request? If you have, then I would suggest one further letter with a copy of the CCA Request and a photocopy of the receipt by them, of the original request.

 

This will serve to prove that you are not ignoring them, and that they are ignoring your legal request, and that the account is legally 'in dispute' from 12 + 2 working days after proven receipt date.

 

This 'paper trail' will come in very handy as this matter progresses.
