      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

right their time is now up what do i do now???? i read somewhere that people on benefits would not have to pay the fee for the small claims court. would i have to get a solicitor involved in that case or can i still do it online. can someone please help me on where i go from here, i am so stressed at the momentg as i am travelling back and forth to my mums in bucks as she is very ill also i am haviing probs with my son who has aspergers. i really don't want to quit and let the bank win but i have no energy.

hi everyone

sorry i haven't posted for a while but a member of my family has been ill so been away.

anyway today we finally got around to filing a claim at the county court, i couldn't believe how easy it was we were expecting loads of questions to be asked as we also applied for exemption of court fees, but we were basically in and out of the court ( even put 2 hours on parking ticket and we were in ther 10 mins lol ) anyway the deed is done now.

today we received letter from court stating that hsbc solicitors intend to defend all of our claim.

 

i've been looking through the threads and it seem the next thing i can expect is a letter from DG asking for a breakdown of charges....is this right??:confused:

They ill possible ask for a brekdon - or you'll get a settlement offer. If they ask for a breakdown, you'll get an offer once theyve received it.

still waiting to hear from dg solicitors, thought we might have heard something by now they've not even asked for a breakdown they got till the 6th november then their 28 days are up..........do you think they may just be stalling...getting a bit worried now :confused:

Don't worry, at the end of the day, the longer it takes them to settle, the more interest you'll earn!! You'll hear from them soon. They are probably having trouble now with all the claims that are coming in!!

is that right i thought once you had made a claim that is all that you would get back.....since making the claim they have taken another £50 in charges with another £95 due to come out on the 10th November :mad:

Well, in your particulars of claim, did you request daily interest? If you did, then they will ahve to pay you that out too.

 

As for the cahrges due to go on, try either calling HSBC and asking for them to be waived, or aask for it within your settlement.

today we received offer from DG solicitors of £4113.18 will be accepting as part payment. our claim was for £4818.31. i don't want to sound greedy but the £700 difference would help towards things needed for my son who has aspergers.

great what a time for my printer to pack up... ok does any one know what i can (hand) write to accept offer as part payment towards total claimed. the letter needs to go to DG solicitors and it has the confidential claus in it that i won't agree to. I've looked through the threads but with five kids running round me i can't think straight:confused:

Yep - I got my 100% offer today - 9 days since reject offer day

My advise if free and is worth exactly as much as you paid for it….

 

HSBC 28 Oct 2006 Personal accounts ~ Offered and accepted ~ £3514 :)

HSBC 15 Sep 2006 Business ~ Offered and accepted ~ £4980 :)

MBNA 7 Sep Offered and accepted £2290 - (my amount £1170 plus Compound Interest) using the "phone call method" :o

FREEWAY 28th Oct ~ offered and acepted £506 :)

TSB VISA MCOL £300 - court date 27th March 2007

after receiving offer on Sat which we declined by recorded delivery this morning and said we would accept as partial settlement, today we received a letter from the court which said that HSBC have filed their defence.

Their defence is as follows:-

 

1) The claimant's accounts are governed by the defendant's personal and/or business banking terms and condiotions.

2) Pursuant to the defendant's terms and conditions the defendant is entitled to make a charge for it's services as set out in the defendants price lists.

3) It is denied that the fees charged for the services provided amount to a penalty or (if it is alleged ) a liquidated damages clause. It is denied the fees are an unfair contract term. The fees are an agreed price for a service provided by the defendant.

 

I am right to be worried ??? or is this just a standard defence??

 

I'm starting to wish that I had accepted offer as full and final settlement.

 

Can someone please help me

I wouldn't worry - they've entered a defence to buy them more time to settle....still hand the AQ etc in and go with the flow of the claim

:D just had letter from dg offering full settlement :D £ 4988.90.

Do I just cross out confidential claus?????

Am very happy now.:D :D :D

I want to thank everyone on this forum for their advice and I would also like to thank Lorraine Kelly for had I not been watching LK today I would never have known I could claim the charges back in the first place.

Will of course be donating to the consumer action group when money comes through.

Am off now to cartwheel round the garden lol.

Isn't it hilarious!

Today I received (nearly breaking my letterbox) 42 seperate bank statements! The poor person that had to lick all those envelopes must have a very sore tongue!

 

Fortunately for me I found all the info online before these arrived, so have already sent off my request for refund of charges (nearly £4000). After 14 days I received no reply from either of the people at HSBC I had written to.

 

Yesterday, I have sent by recorded delivery my letter before action.

 

14 days to go.... of no response then my court claim will go ahead.... watch out HSBC!!

 

Hang in there, it's V.stressful, but lots of us are going thru it
