    • Yes that looks fine. It is to the point. I think somewhere in the that the you might want to point out that your parcel had been delivered but clearly had been opened and resealed and the contents had been stolen

You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? The claimant seeks reimbursement of £265, plus P2G fees of £9.10, plus postage costs for two first class letters to P2G of £2.70, plus court fees, plus interest.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Lynn

I have slipped into arrears on one or two occassions and even after 1 missed payment of 161.00 LMC have sent an "advisor" to my door...Only to find LMC have charged another £94.00. I have written to them with little or no help on this matter. I feel so ripped off. This surly must be illegal? Can anyone advise me further on these crazy robbing charges?

Sorry i haven't been in touch, but update is that CAB put me in touch with Shelter who said that we could apply to the DSS for help.

Unfortunately the builder who done the work on my house has died, we couldn't find any receipts to show what we spent the loan on, as the builder had the main receipts, and basically we are in the same boat as we were in a year ago. How we are going to get out of this is anyone's guess.

 

As for LMC putting charges on for sending out a debt counsellor, there is nothing we can do about that, as that is there policy. This i have been told by my solicitor.

Hi fran, just had some time to pop into to see how your getting on, Iv not done anything with london morgage for a while, as we sold the house. We were so lucky we sold in one week, and we moved early April. so have settled all the debts, except for A & L who are still taking me to Court.

Havent had much time up untill the last few weeks.

 

I have to say I think yr solicitor is wrong there was something you could have done to stop a debt councellor calling.

 

I managed to stop haviong debt councellors to the house, buy just sendind a very good letter on here from one of the mods. Unfortunatly I can't find it now. I know thats much help now, but I will try and find it for you for further use.

I really hope that you are ok and you still keep in touch

Thanks for keeping in touch. I'm afraid nothing has changed, except my relationship with my partner. With all our debt problems we have drifted apart. We still live together as i cant afford to move out, although i have my name on the housing list. My partner has buried his head in the sand, and panicked as far as the DSS was concerned, as we didn't have any receipts to show what work has been done to the house, and some of the loan from LMC was to pay some of his other debts at the time. He's now received his first county court order, concerning his Lloyds bank loan.

 

So i'm afraid in my situation its gone from bad to worse. I personally think it would be best to sell the house, but my partner wont. I also think i've just got conned, as i paid £49.99 to have a company look at this secured loan, to see if we can get the charges back, and to see if the loan was enforceable at the time it was taken out, as my name is not actually on the deeds to the house, only my partner's. But i keep phoning this company, as i haven't received any paper work from them. Will be trying again today.

 

Thanks very much for keeping in touch, at least i dont feel so alone.

Hya Fran, sorry to here of yr problems, money has always been the route of all evil, and will never change.

 

Im sorry yr partner is having problems coping with it all, it really i'st as bad as they think, they seem to just clam up and shut it all out.

 

I now its really hard to have a life when all this is hanging over you, but the only thing is to keep on top of the letters and keep those debt agancies away from the house. I have lernt from experience, face it head on its the only way, they can't do anything at the end of the day, blood out of a stone etc.

This site has kept me sain, and with everyone's help Iv managed to come the other side of things, I still have debts but I fight them all the way.

 

Is your partner dealing with his County Court order? do you need help with it?

You can always post details of agreements up on here to see it they are enforcable, ring the Solicitors again make a nuisence of yr self, they will soon give you the information and advice that you've paid for.

 

Im just about to pick up again with L M C, before it's to late as I understand that S P M C is winding down buisness and Capstone is taking it over.

i've just got conned, as i paid £49.99 to have a company look at this secured loan
Have you managed to get your money back - which company is it. Have you written to them to complain.

 

You can call your bank and ask them to charge back the transaction if it was carried out without your permission or agreement. Contact Trading Standards to reoprt this.

Hi Lynn

I know its been a year since i last sent you a msg, but wanted to give you a quick update on what's been happening. As far as the unsecured debts are concerned, we still have them but only pay a small amount each month, so no more harassment from the debt collector's. As far as the house is concerned, i approached the 'Mortgage Rescue Scheme", its taken a while, but with the help of the 'Homelessness', and 'Shelter', we are now in the process of having the local housing association buying our house. We now get to stay in our house, and pay rent instead. Shelter and the Homelessness were brilliant, and without them i dont know what we would have done.

Good to hear things are at long last getting a bit easier for you.

Please don,t apologise for the lengh of time weve not been in touch. I no only to much how time goes when your trying to sort at priority problems.

 

I have,nt been able to do anything with London Mortgage Company

as Iv had loads to do with a Alliance & Leicester case. 5 times in Court,

last one was Friday 10th July 09 when Judge ordered a stay until April 2010. Any way will have a bit of free time from now on.

 

Hope you and your O Half are ok, its really good to hear that things are eventually getting sorted for you. You done really well to get it well on the way to being sorted.

 

Wish you all the best and please keep in touch from now on, as I really do have a bit more time to concentrate and help others.

I have been reading your threads with interest. Although our mortgage was not with LMC, but Swift Advances, it was arranged by Norton and we had PPI which we believe was mis-sold. We only had the mortgage for just over a year - when we sold our house we paid Swift off thankfully!

 

We have been trying to get the PPI back - Swift have ignored our letters and Norton have replied, but say it was not mis-sold. Like you they say our PPI was with Sterling. We have all our original paperwork from that time (2006-7), but had nothing from Sterling and had never heard of them till Norton sent us the documents last month.

 

I was wondering if you had any success getting the PPI back? I read on another thread that Sterling had offered you 40% back and I wondered if you ever got this money?

 

Apologies for hijacking your thread, but I thought you might be able to offer me hope that there's a chance of success with these people.

So sorry I missed your post, only just come across it when looking for something else. :eek: I hope that you have had a refund by now, but if you have,nt I hope the following willl help

 

We have all our original paperwork from that time (2006-7), but had nothing from Sterling and had never heard of them till Norton sent us the documents last month.

 

Landy this was the same as us, we had no idea who our PPI was with untill we received a letter from Norton.

 

The answer to your question, it yes we had about half of the PPI back from Sterling, after requesting it.

PPI added to our loan was £5,600. we had no idea how long we were covered for with this.

Sterling stated that they were in no way responsable/involved with the selling of the PPI nor for the supply of any documents,those matters were for the Lender and the broker.

 

We have and still do claim that our PPI was missold to us.

 

However, we wrote and to Sterling informing them that we had paid the loan off early, and we were entiteled to a part refund of £2,419, (which hubby worked out for me.)

 

We also stated that we were discussted that it was left up to us to contact Sterling to claim a refund, and that LMC should have told Sterling as a matter of course that the loan had been settled early.

 

We did receive £2,419. refund and I still intend to claim the rest of the PPI as soon as I have a window to do so.

We have and still do claim that our PPI was missold.

 

I have a case going through the Court at the moment for the reclaiming of PPI added to another loan. First National Bank now owned by GE.

But it is very complicated , will be posting up some time today for some very much needed HELP

 

I do hope that you have had your PPI refunded, if not I will endevour to try to help you as much as possible.

 

As you know there is another big thread going on in the Forum, which reads like a noval, I have had a London Mortgage Loan, I am finding our this thread very gripping as I have a vested intrest in it.
