      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi all, this is my first post, so be gentle.

 

i have just read mungrymatts thread, and i feel i'm in the same situation.

 

had a ccj against my wife with welcome, the solicitors involved were irwin mitchell.

 

we felt really pressurised at the time and had major panic when it neared the court stages,

we didn;t get any advice and welcome accepted our offer of £100 per month. which we've been paying for for 3 months now.

 

then we recieved a letter off welcome listing charge after charge. capitalisation, court fees. taking what we owed them to £7200.

rang them and they said ignore it the amount is what ever irwin mitchell say!?

 

however, before all the court thing started we had sent SAR letter twice, no reply,

also started trying to get ppi miselling as my wife was made to assume if she didn't take it then she'd get no loan. again no replys,

until all the threatening letters and threats of legal proceedings.

 

we just seemed to sit back and accept anything that welcome threw at us, having read mungrymatts post just wondered if there was anything we could do.

 

my wife took the first loan out in nov 2004, then stupidly(in hindsight) took out and resigned for a newer and larger loan in july 2006.

 

on both there was ppi,

 

but on the newer loan they've craftily added medicare, which on the first agreement they said on the agreement it wasn't suitable for her.

 

sorry this post is long, it's just all muddled up in my head at the moment.

trying to get too much out at once.

 

hope someone can shed some light on this. still have the agreements.:confused:

but to be honest don't know where to start its all a big mess,

 

it would be a huge weight off my shoulders if i knew there was a possibility of me screwing them for a change.

WE JUST NEED TO PUT WELCOME INTO A CORNER WHICH IS QUITE EASY REALY

not sure i have the sar, just have a statement listing charge after charge, this is from before the court stages.

i think the default notice is there too.

i'm a little bewildered by this at the moment.

as usual, default notice is crap

 

 

one thing i spotted

 

i take it welcome re-wrote the loan

why do you have another agreement

 

what you should have is an agreement to modify the first

 

i see they stung you for ppi

gave no rebate when you re[wrote the loan

then stung you for these insurancies again on a second loan

 

boy did they see you comming

 

not being critical, seen it to often

 

so

 

DEFAULT NOTICE IS CRAP

WELL THE INSURANCE BIT IS A TOTAL RACKET

COMMISSION HUNGRY BAR STEWARDS

 

HOW ABOUT GETTING THIS CCJ SET ASSIDE

 

IT WILL COST YOU 75 QUID

Only A Judge Can Set It Asside

That Will Be As Though It Never Exsisted

 

I Want You To Take A Stroll To Your County Court

 

Ask The Girl At The Desk For Some N244 Forms

This Will Cost 75 Quid And Will Prob Take 3 Months

Come Back To Your Thread Then And Ill Have It All Written Out For You The Application

 

Just Give It To The Court And Then Its Just A Waiting Game

 

Can See No Reason For Not Setting Asside The Ccj But It Is Up To The Judge

They Have Bad Days As Well

what is the possibility of it being set aside.

what if the judge says no.

could i appeal or go somewhere else.

 

should i send an sar off?

 

i have copied the one you gave mungrymatt. its in an envelope ready to go, should i send this?

 

do i need all the information from the n1 forms?etc.

 

do i pay for the forms when i get them or when i've completed them and return them?

 

sorry for all questions but i need to know i'm doing the right thing.

as i said before what if the judge doesn't set it aside?

 

is that the end of it?

 

what will happen if it is set aside?

 

will i still owe money?

 

what about ppi and charges.?

 

sorry for multiple questions,

 

just don't have a clue which i suppose is how they got us.

I Gained Great Advice From Valued Members Of The Forum And I Now Pass That Knowledge On

 

My Score Is Now Six Out Of Six With Welcome

They Dont Like Me Very Much As I Have Cost Them A Lot Of Money

 

Dont Worry About The Set Asside

Ime 99.9999% Sure It Will Be, You Just Have To Show Good Cause And A Realistic Chance On Winning Another Claim.

 

When Its Set Asside, Welcome Can Then Issue New Proceedings Against You If They Wanted, It All Goes Back To Stage 1

Thats What We Want

 

At The End And When We Win, Well When Welcome Discontinue The Action, You Are Free Of Welcome.

 

Well To Issue Another Claim, They Will Need The Permission Of The Court Which Would Be Unlikly, They Had There Chance

YES UNTILL YOU HAVE THE COURT ORDER SAYING THE SET ASSIDE HAS BEEN GRANTED

 

TO SET ASSIDE SHOULD TAKE NO MORE THAN THREE MONTHS

had to take time off from this,

been a little worse for wear past few months.

 

sent letter and 10 pound,

 

just got to get the ball rolling again.

 

hope you're still on my side.

 

missed a couple of payments and bricking it.

 

am i still in a good position.

 

grateful of help..
