It appears to be their policy to NOT send out ANY agreements.

 

By being obstructive, they can conceal more of those cases where there is NO agreement, or it is unenforceable.

 

But we have also seen many cases where the document they DO eventually provide appears to be properly executed.

We could do with some help from you

I have read another thread on here by 'Bones' where bc admit to only having a microfiche copy. On there the tone is that of unenforceability due to not having the original.

 

Has this consensus started to shift due to the test cases? ie; a poor microfiche copy would suffice in court?

 

What are the downsides of me continuing to claim 'in dispute' as it's not ligible and going to court?

 

The top and bottom is that I cannot pay the amounts requested anyway :(

 

As always thanks for the input.

 

Top of my todo list is making a donation to the site when I can. Quite frankly it has saved my remaining sanity over the past six months.

hi there, ive reported mine to the police, almost identical circumstances as yours. morgan stanley-goldfish....... then Barclaycard statements come through the door.. they took money from my barclays bank acc.claiming there right under set off, but if the original CCA is duff well there screwed.

 

hope you dont mind but seeing a post with a good example of a MS CCA is a bit rare and thought it may help to see what i received.
