    • I came across this discussion recently and just wanted to give my experience of A Shade Greener that may help others regarding their boiler finance agreement.
       
      We had a 10yr  finance contract for a boiler fitted July 2015.
       
      After a summer of discontent with ASG I discovered that if you have paid HALF the agreement or more you can legally return the boiler to them at no cost to yourself. I've just returned mine the feeling is liberating.
       
      It all started mid summer during lockdown when they refused to service our boiler because we didn't have a loft ladder or flooring installed despite the fact AS installed the boiler. and had previosuly serviced it without issue for 4yrs. After consulting with an independent installer I was informed that if this was the case then ASG had breached building regulations,  this was duly reported to Gas Safe to investigate and even then ASG refused to accept blame and repeatedly said it was my problem. Anyway Gas Safe found them in breach of building regs and a compromise was reached.
       
      A month later and ASG attended to service our boiler but in the process left the boiler unusuable as it kept losing pressure not to mention they had damaged the filling loop in the process which they said was my responsibilty not theres and would charge me to repair, so generous of them! Soon after reporting the fault I got a letter stating it was time we arranged a powerflush on our heating system which they make you do after 5 years even though there's nothing in the contract that states this. Coincidence?
       
      After a few heated exchanges with ASG (pardon the pun) I decided to pull the plug and cancel our agreement.
       
      The boiler was removed and replaced by a reputable installer,  and the old boiler was returned to ASG thus ending our contract with them. What's mad is I saved in excess of £1000 in the long run and got a new boiler with a brand new 12yr warranty. 
       
      You only have to look at TrustPilot to get an idea of what this company is like.

    • Dazza a few months ago I discovered a good friend of mine who had ten debts with cards and catalogues which he was slavishly paying off at detriment to his own family quality of life, and I mean hardship, not just absence of second holidays or flat screen TV's.
       
      I wrote to all his creditors asking for supporting documents and not one could provide any material that would allow them to enforce the debt.
       
      As a result he stopped paying and they have been unable to do anything, one even admitted it was unenforceable.
       
      If circumstances have got to the point where you are finding it unmanageable you must ask yourself why you feel the need to pay.  I guarantee you that these companies have built bad debt into their business model and no one over there is losing any sleep over your debt to them!  They will see you as a victim and cash cow and they will be reluctant to discuss final offers, only ways to keep you paying with threats of court action or seizing your assets if you have any.
       
      They are not your friends and you owe them no loyalty or moral duty, that must remain only for yourself and your family.
       
      If it was me I would send them all a CCA request.   I would bet that not one will provide the correct response and you can quite legally stop paying them until such time as they do provide a response.   Even when they do you should check back here as they mostly send dodgy photo copies or generic rubbish that has no connection with your supposed debt.
       
      The money you are paying them should, as far as you are able, be put to a savings account for yourself and as a means of paying of one of these fleecers should they ever manage to get to to the point of a successful court judgement.  After six years they will not be able to start court action and that money will then become yours.
       
      They will of course pursue you for the funds and pass your file around various departments of their business and out to third parties.
       
      Your response is that you should treat it as a hobby.  I have numerous files of correspondence each faithfully organised showing the various letters from different DCA;s , solicitors etc with a mix of threats, inducements and offers.   It is like my stamp collection and I show it to anyone who is interested!

Thanks for preparing these letters I think ,as Cerber advised in #48 above, we should wait and see what RW or their solictors come up. As I said in my letter the ref no was correct and they had every thing to find me if they are unable then tuff. I should rather not to wake'm up.

 

I will keep these letter ready to post as soon as I get reply from RW.

HI CB I am still waiting from Horelly farrlly (RW) solicitors. Its boring now as nothing to write for a while. Normally before they were used to reply as soos as my letter touches their table. I think as CAP1 couldn,'t find my record same is happening with RW.

Hi Andy, hope this reaches you before you trot off to the post office :)

 

IMHO, I would just send Horrible farrell a copy of the letter that appears to be in limbo. You can hand write on it, something like, "copy of letter which remains unanswered".

 

I would just get a free proof of posting from the Post office as it looks as though the orignal might just have been delivered but not signed for, no sense in wasting more money.

 

Chances are of course that the website has not been updated, so you could as a back up check, telephone the number on the RD receipt and see if it has been delivered.

Righto, If the post office believe this is lost, then I suggest you wait 15 days from the date you posted it. Then fill in a Royal Mail complaint form. You can pick one up from the post office or download it from the website.

 

As you will need to send the original receipt, you must photocopy it for your file.. send the completed form and the original receipt to the Free post address on teh complaint form and get your postage back.

 

You will only receive stamps to the value of £1.15.. but why the hell should you prop up the Royal Mail ?

 

I am sending in at least 2 complaint forms in every month:D

HI CB guess what I just checked bank statement my chq of £1.00 Has been cashed by Horrible f**ts. So they have got my letter. Although they may not have sign the RM reciept.

There you go then. It is very annoying that Royal Mail advertise their recorded delivery service for "sending legal documents which require a signature" and half the time they dont obtain one...

 

Still at least you know it HAS been received. Quick thinking on checking to see whether the postal order had been cashed. :D

Hi CB/ Cerber Let me wish you guys a happy season. I had a very horrible start to this year as my wife had a subarcniod brain hemmorhhage. After 3 weeks she just able to start talking and sitting. All the loved ones prayer for us and God blessed her recovery.

 

After 7months I got this letter from RW regarding Cap1. I think I should not write any more or otherwise please inform. Thnak you

Totally bizarre, IMHO, I would ignore this letter and see what happens next. Alternatively, you could write just a very short note advising that you are still waiting properly addressed responses to your letters dated XX to Robinson Way and XX to their solicitor, Horrible Farrell :)

Hope you guys are doing fine. I got this letter from RW since Jan 2011 for homw visit. If you read this thread before they can not prove that they have been asigned and Cap1 can not find the account. Now they are threating with house visit. Advise please and Thanks

This is just going round in circles isnt it ? Perhaps something along the lines of:

 

Dear Sir or Madam

Your letter dated XXX has been received by me and I would respond as follows:

 

You are well aware this account is in dispute and the reason why.

 

May I suggest your time would be better spent attempting to resolve this dispute rather than continuing to send repetitive and threatening letters to me.

 

You are well that you are not permitted to send or instruct a collector to my home without an appointment and in the circumstances, I will not agree to this.

 

Your continued breach of OFT guidelines will be reported to the OFT.

 

Yours faithfully

 

DO NOT SIGN

I told them I will not be veryfyiong any of my detail on the phone. Only written replys. Should I ingnore this for the time being untill they receive my letter.

Full of 'mays' and 'ifs'. yes, ignore.

Successfully claimed back mis-sold PPI (Barclays Bank) 2009-10 (£8500)

Ran a paid-for DMP. Deeply respect those who self-manage a DMP; it is possible to do with the help of fellow CAGGERS

Offered F&F to all my creditors. All closed out including a particularly intransigent and stubborn one - who eventually saw sense after 10 months of nonsense!

Does not condone debt avoidance but violently disagrees with the antics of debt collectors and their behavior towards the ones trying to pay. I am a great believer in what goes around, comes around. Keep up the good fight!

Ok, their first letter to which I gave you a response was dated 21 April 2011 (presumably sent 2nd class post and mailed on the day prior to the bank holiday.. which meant you couldnt possibly have received it until the date you did) and said that you had 10 days to respond. Although they had already carved a minimum of 6 days out of that allowance.

 

You did respond on 3rdMay.. however this latest letter is dated 29th April which is dated 8 days after the first.. hardly allows you the 10 days does it ??

 

I would give your letter time to reach them.. Dont respond to this one, but let us know immediately if you receive anything else.
