hello

i have been asked by my solicitor to do a nasty letter to the gentilman who has sent his medical report to me via my solicitor.

This all stemed from the road accident i was in nov 5th 08.

 

the medicl's report as my solicitor said she won be using themagain and that she has never seen or read a medical report like it.

 

ghe where do i start?

 

1. He was so quick to get rid of me that when i started to answer his questions he interupted and finished of in his word and ws speaking into a i think you call it a dictaphone where his sec types as he speaks.

 

2. I tried to explain about the acciden but he kept saying i wat to know ......

and using wrds i didnt understand.

 

3. in his report he goes on to say about my past medical probs i ve had for 15yrs as far back as 1989

 

4. He has gone into my past history, was this nessary and does this has anything to do with my accident?

 

He said that my bruising wouldnt last for any longer than 2/3 weeks

it did last longer as i will put in the photos.

 

5. he as also commented that on the hospital reports, nothing was mentioned about some of my injuries

1. broken tooth which i ad to repair a my dentist and that he needed a lettr from my dentist, i have been intouch with the dentist for a letter to enclose with my omments.

2. brusing to the back of my head.

 

He has commentated that i shouldnt be getting disablty in his opion, but deeper into it

I am waiting copies of my medical report that i had at the dss.(recently)

 

6. he said that i am bizzare and also i should see and get a pyscolgist (speelllng awful sorry) report.

 

i can go on and n but what has my injures and accident got to do with al this?

 

on the day i went for this he as not nice and i felt as thou was being interrgated.

I was so upset i emailed my slicitor straight awy. she said wat till she gets the medical report and not to worry.

as she is quite a distance from me we ommunicate via phone ax email.

 

she has asked me to write a nastyletter in respect of his remaks and she will proof it etc.

 

i can go for a second oppions but where would i get £534. odds from when i am aleady classed as hardship. she said t take one hing at a time by doing this.

 

My solicitor say her fear is that he may get intouch nd ave me takenof the list but have had a medical at the ofice by a medical expert.

 

the accident

 

on the m6 travelling on the fast lane doing 60mph, going alng when the bonnet of the car hit the windscreen i was a back seat passenger wearing my seatbelt.

I was thrown forward but shaken.

whilst akeing of again after a short while the bonnet hit the windscreen again this is when i wasthrown forward, then all i remember was like a bmb exploded inside ofme the next i wa coming around by my son callin mam mam he helped me out of the car but when i was walking it wa as if iwas drunk but i was tryin to come round to help m hubby who had cut a story short 16 stitches in ih forehead.

 

now what had happened a lorry driver who seen this happe thought to hiself that they are going to need help here so he staye with us, he then pulled into the layby, and was phoning ambulance and police, and what had happened my sons car went into he back of his lorry this must hae been the jolt i felt and if the ironbar across the lorry had ot had been there my sons car would have gone under it, it did take a while for the abulance to come bu with e making sure that my son was alright and hubby i wa still holding my chest they thought it was my heart with me suffering with angina, but it was my ribs.

 

they wanted meto say in but hubby said he thought d be best at home

the next morning this is when all the bruising came out so the hosp didnt see this as it was the next day

he photos i took of the bruising with me to thi medical he commented that they wasnt dated

 

his comments hve upset and annoyed not only me but mysolicitor as well

please can anyone help as itis the phrasing and wording it correctly etc

I am not a doctor, and nor have I seen your report, I have seen many others, and I think that the answers to some of your specific points are:

 

1. Remember that this doctor was asked to examine you and produce a report. He was not seeing you with a view to treatment. Such reports are always done on a private basis, and he will have a fixed time.

 

2. I'm afraid the only way to deal with doctors using words you don't understand is to stop them and ask them to explain.

 

3. Your past history is relevant to a medical report because existing or prior problems may be exacerbated by new injuries. For example, people with some pre-existing conditions will bruise more easily than others.

 

4. See no.3.

 

The doctor's opinion about the bruising is just that - an opinion. There's a difference between fact and opinion - the bruises are a fact; how long they'll last is an opinion, because no-one can actually know.

 

5. The only way you can check whether the hospital missed any injuries would be to get a copy of the notes.

 

6. His comments about you being bizarre need to be in context; he must have given a reason for this, which again is just an opinion.

 

In these circumstances, the doctor will have been asked to examine you and provide a report and opinion. He has done this.

 

Ultimately, I concur with the other views above. When solicitors ask doctors for reports, they will usually ask specific questions, such as are the injuries consistent with the accident as described, are there any lasting consequences, and so on. If the solicitor commissioned the medical report, it is for her to deal with the doctor. If she's unhappy with the content, she can get another doctor to see you.

thankyou for all your help i will try and explain a little better

 

my soliciter has asked me to do this as i have to fill in

that i agree to his comments

or

i do not agree and to state why eg para 1. 2. 3. etc

my comments will be sent to him.

 

 

in one of his comments he goes on to say

in conclusion it was noted thast she was claiming complete dissability due to wide spread musculo-skeletal symptoms she had displayed bizarre ilness behaviour.

 

I have always had a medical from the dept and was proved so i dont know why he is saying this also i am now awaiting copies from the dept for the recent one.

i have a report from my dentist which he required

i am at the drs again today for another letter from him regarding the accident

 

this is why i have to get all copies and to do a nasty letter but i think a hasty but politlte letter im not sure but my solicitor will put in a letter as well but because i am disagreeing with his report i have to enclose a letter as well as my comments etc

hope i have tried to explain this for you to understand

i would copy the report but its 19 pages i couldnt ask him what the words meant as he was hurring me and speaking into a recorder

it was an awful experience for me and thought it was a waste of time as i also didnt get everything about he accident over to him he finished of the answer for me in that little dictaphone as i think one calls it

thankyou for everything this is all upsetting me and starting to get me down i keep reading and reading his report on the other hand

my hubbys medical report is so diffrent and not a problem

I am going through a prolonged claim but am covered by my ibsurance for legal expenses and after numerous MRI`s, Consultants including a long spell of counselling have not had to pay anything. Presumably you don`t have this cover?

yes i have insurance who cover legal expensives my solicitor is being paid by them so does this mean that my insurance will cover me for a medical ? tyvvm

as i didnt think they would cover me for this when paying my solicitor?

Your Solicitor should be arranging medicals etc and claiming all costs off your insurance company. I can`t believe that you are expected to pay!

i know i am thinking of phoning my insurance to see if they will pay for a medical for me or do you think i should ask my solitor to arrange another med and for the cost to be added on her bill? i am in photobucket please do you know how i upload from there to add to here in this thread please thankyou so much for everything take care

your solicitor is responsible for dealing directly with the insurance company as they have been retained by them to process yor claim. I have not spoken to my insurance company since the accident 4 years ago, All of my medical reports have been instigated by my solicitor. I am with a well known supermarket insurer and they use a large solicitors firm who although are taking their time are thorough. If you want more personal details you can pm me

here is what i have done so far tyavm for all your help

i have to present it properly etc

 

PAGE 1 SUMMARY.

 

I dissagree with his comments "psychological Assessment"

may be required.

 

I did still get pain, in which i did go to the doctors but was

told i was on the highest medication.

 

I do not imagine pain that i get.

I am still on medication NAPROXEN TABS 500MG TWICE DAILY

TRAMADOL 50MG TWO DAILY AS DIRECTED.

 

PAGE 3 HISTORY

The car was driven along the motorway when the bonnet of

the car suddenly opened and smashing the windscreen. i was

thrown forward due to brakes being stopped hard.

after the driver mr m mcneil got out of the car closing the

bonnet he then set off again after driving approx 100 yards the

bonnet of the car sprung open again hitting the windscreen

which shattered the windscreen.

Mr miller the front seat passenger had to guide mr mcneil

across to the hardshoulder.

the LORRY driver who had witnessed this the first time said

he had to stay with us, as he seen we needed help so the

lorry driver went into the hardshoulder and immediatly

telephoned ambulance and police then the car i was in went

into the back of the lorry saftey bar i dont recollet anything

then apart from hitting the baby seat at my left side of me i

dont remember anything and was comming around with the

voice of my son calling mum mum in which when i came

round i could only see blue smoke, upon my son helping me

out of the car undoing my seat belt i was being helped by mr

mcneil and walking as if i was staggering holding my chest. i

was feeling strange.

it was a while before the ambulance came in which i was

quiet and holding my chest.

They took me in the ambulance and did tests and then

assessed my ribs where they said it was a fracture to the ribs.

I was unconscious, but was brought round by mr mcneil .

the bruising was caused by the seat belt as you can see from

the right side from shoulder to tummy and where the seat belt

went across the tummy.

 

PAGE 4 THE HOSPITAL RECORDS.

 

The car had not struck a board on the layby the car went into

the back of the lorry had it not been for the safety bar on the

lorry that we went into, which was stationary. the car we were

in would have gone under the lorry itself.... only for the

stationery lorry (the lorry driver has given his statement ) if

you require a copy please request from c.ashwoth solicitor.

There was no board on a layby?

By the time the ambulance arrived yes i was conscious

bruising did not appear untill the day after 6/11/2008,

in which photos had been taken from 06/11/2008 and therefore

were taken long after the the accident please see enclosed

photos.

1. bruising of the back of the head.

2. right tooth letter attached.

3. the brusing of the body and adoman was severe.

4. following the assesment the last dr i seen was wanting me

to stay in overnight where if i had of done so they would have

seen the bruising themselves, but my husband said that i

would be better at home.

5. the Dr did confirm firomyalgia at the hospital.

6.i did consult my gp, nurse, trainee dr's mainly about the rib

pain and right arm i was put on medication as mentioned in

paragraph page 1.

futher medication was prescribed again in page 1 details of the

medication already given.

i am taking solphadol 30/500mg ,

Mr Cornah states in his report arthritis of the spine- it should

read siactia of the lower spine which i feel goes into the left

hip.

a list of medication is to be set out as follows:

THE LONG HISTORY OF MEDICAL PROBLEMS IN MY VIEW

HAS NOTHING TO DO WITH THIS MEDICAL, AND SHOULD

I understand that these questions may be asked but to go into

detail and present a medical report on the grounds of

previous medical history should not be taken into account.

In july of 1996 i went to see my gp with the pain in the legs

which was like a sharpe knife scrapeing up and down the front

of the bone in both legs were i seen a Mr Burns the

rhumatoyde doctor. I had sick notes also attended my gp Dr

Jonston who eventully signed me off for life. I had since then

had to undergo medicals again this is nothing to do with

medical repot.

The diagnoisis in scotland were as follows

2. THE CHEST INJURY

WHAT I TOLD MR CORNAH WAS THE TRUTH AS HE SAYS IN

THIS PARAGRAPH, THE PHOTOGRAPHS dO SHOW THE

SERVERNESS OF THE BRUISING.

THE BRUISING APPEARED ON 06/11/2008 AND DID LAST FOR

LONGer THAN 2/3 WEEKS IT WAS AFTER THIS THE

BRUISING STARTED TO FADE SLOWLY.

IN WHICH THE BRUISING DID LAST LONGER THAN

ANTICIPATED.

ONE CANNOT EXACTLY SAY WHEN BRUISING AND PAIN

SHOULD LAST FOR IT VARIES WITH EACH INDIVIDUAL.

 

PAGE 8 THE RIGHT ARM.

 

PLEASE SEE ENCLOSED LETTER FROM PHYSIOTHERAPY,

WHERE TREATMENT STARTED ON 29TH MAY 2009 STILL

ONGOING.

 

THE LEFT ARM

 

The left arm was hit on the baby chair that was attached to

the left of the back seat.

2. THE CHEST INJURY

WHEN MR CORNAH PLACED HIS HANDS ON RIBCAGE I DID

SIGH WITH A LITTLE DISCOMFORT IT IS ONLY NATRUAL

THAT THERE WOULDNT BE ANY BRUISING LEFT FROM THE

ACCIDENT TILL THIS MEDICAL I WENT FOR.

3. THE RIGHT ARM

I HAD BEEN IN DISCOMFORT THIS IS WHY I KEPT GOING

BACK TO MY GP, I DIDNT ALWAYS SEE MY GP,

as i seen a locom also trainee dr's that were there.

1. The daily records

 

MR Cornah relates to notes and printouts from 1967? yet

there seems to be no notes in his report.

I also attended Blackpool A&E weeks after the accident but

there is no mention of the letter from the dr who has sent a

letter to my own GP.

I take it mr Cornah refers to the A&E on the 5th november 2008

at preston hospital was he refering to the accident?

I have no knowledge of a cancelation on the 7/11/2008.

I WAS GIVEN A SICK NOTE FROM MY GP

to refraiN from work see sick note enclosed july 1969

i didnt stop working to what mr Cornah states it was with the

bones in my legs.

I do not display bizare illness or behaviour nor do i

inapproprite signs it is a pity that i am not seen when i am in

pain, discomfort.

I do not go to my gp unless i really need to go .

i am enclosing recent correspondence relevant to this claim

although i dont think that this should be when afterall the

claim is for a medical report on the grounds of the car accident

and not my past, I wonder if Mr Cornah would really like the

whole history of my medical records from being born till now

he would be very shocked to sit and see them all afterall he

seems so interested in my past then why not go the whole way

mr Cornah, as you dont know me nor am i a paitent of yours

but by this report you seem to have a lot to say about

someone you dont even know.

COMMENT

FRIGHTENING RTA,

and i still am scared just like anyone one else would be i am

no exception from anyone else.

1. a dentIst report is being obtained for your records.

No comment on the head injury or neck due to not realising

the only concern where the paramedics and hopital staff and

drs for the pain i was in at the present time untill the

following day as i have already said.

2. THE CHEST

 

This did not resolve in the period of 4/6 weeks as he states if

this was the case then why wasnt i diagnosed with a diffErent

cause to what was causing this? i was complaining as to the

shooting pains within the rib area.

3. THE RIGHT ARM

I was examined by a gp at my surgery who examined my

shoulder/arm this is when she refered me to pysio enclosed

letter.

as we all know i was also told of the long waiting list that i

have to wait on.

The movement at the time was painful although Mr Cornah,

stretched my arm right up yes there was some discomfort

but he was in such a hurry i began to think to myself whats the

point he wasnt really interested, just wanted to do and say and

finish of my sentence or just said he didnt understand me so

he then put words to me i didnt understand. long words

guess some were medical words.

I complained to my soliciter upon returning home.

Mr Cornah states in his report that there is no indication for

treatment

although i asked for a letter from the physiotherapy i was

told that my solicitor or mr Conah should request one if they

need to.

He should accept that i had bruising as he seen on the photos

again see enclosed pictures.

No it wasnt recovered in 2/3 weeks as he says... why else

did i go to my gp with my arm

I disagree to such a report, it is only natural that when

someone who has been in a car accident weither it be by any

transport involment that they get over it in such a short period

i am not the only human being that is afraid to travel after

such an frightening experience as to the car accident.

Medical Report Comments

 

Dear xx xxxxxx.

 

RE: YOUR MEDICAL REPORT.

 

I have now received your report in which i am commentating

on your remarks.

 

I must admit that i was a little concerned about your comments

that you have stated in them here as follows.

 

 

I tried to explain what happened on the 5th november, but due

to me being minutes late as to me waiting in a GP's

reception before being told i was in the wrong practise, in

which i tried to tell Mr. Cornah, and i apolygised to him.

I do

realise and understand that he has a "time schedule".He

wasnt seeing me with a view to treatment.

 

Mr Conah didnt really seem interested to what i had to say, and

i felt i was being rushed and this made his questions to me a

little difficult as i felt i was being rushed when asked what had

happened i started to explain from the begning leading up to the accident.....

but was interupted by Mr

Cornah saying "i am only interested in you" to the fact that

when i tried to explain i couldnt properly as at one stage Mr

Cornah kept interupting, i felt i was being interagated and

was on trial for something i hadnt done, to me this was all

strange and i left the office feeling it was all a waste of time

and that i hadnt put forward exactly what had happened.

I had told Me Cornah that my husband was with me but he

was pointed in the direction to take a seat and wait for me.

Upon being rushed throughout this medical i was then asked

to join my son? Mr Cornah refered my husband to me as my

son I thought this was rude of him.

I feel that Mr Cornah had no time for me, and really didnt want

to listen to what i had to say.

For his information, as to why i was nervious is that he was a

male, and with me having counciling for my PAST rape this

is why i was nervious, so he really put me down and as he is

more interested in my past history he should have known this

afterall he has gone into my past when the real reason was

to have this medical report concerning my accident and from

the accident till present.

My past history is relevant to a medical report because existing

or prior problems maybe exacerbated by new injuries.some

people with pre-existing conditions will bruise more easily

than others.

There is a difference between FACT AND OPINION- the bruises

are a fact; how long they last is an opinion, because no-one

can actually know.

On the whole i am concerned about his comments on my past

so therefore i am enclosing details as to why i disagree with

this somewhat he calls a medical report.
