Hi

 

I recentley apllied for a payday loan through a broker who searched various companies with my details.

 

One of the companies was a company called express finance who i had a payday loan with back in 2007 but was in dispute due to various charges they had added.

 

Anyway today they have taken 2 £60 payments from my debit card which i used on the broker website claiming they could use any debit or credit card to take monies owed to them.

 

I am a little confised as they have obviously accpeted me on a new agreement but are now claiming they are using the card details provided to take the money they claim they owe.

 

Can they do this without my permission?

This is the sneakiest tactic I have seen yet from one of these companies. I would start off by discussing with your bank (not always helpful). Get your card changed pronto to make sure they don't take any more (tell bank you lost it).

 

I have seen one thread where this company actually paid back some money they had taken by stealth. Threaten them with FSA/OFT etc

 

They had no right to use new card details that had not been given to them with your authority.

 

Highlights the dangers of giving all and sundry your bank details on line.

Furthermore its a different agreement. Why accept me if i owe them as much as they claim?

 

The monies they claim i owe are on an old agreement in dispute. So really dont know how they can take the money using my new card details on a new application.

 

Finally the agreement states they are to to pay me Xamount to be repaid on the 30/06/09. Are they not in breach of the agreement for not honouring this?

I suppose if the money is not forthcoming the agreement doesn't exist. I don't think you will get far with this argument. No excuse for their conduct so far!

Thtas fair enough but then if no agreement exists then they have no right to take money off a seprate card that was not used in their original agreement.

 

They say they can use any debit/credit card but basically what they are saying is that they can find my wallet take out my card and use it to pay them. Arses

Any advice of how i go about getting my money back? They have took £120 which was for my months shopping and i am now left with nothing on the 3rd of the month.
