I had a Credit Card with M&S Money, which has since been sold to a DCA. After a lot of letters going back and forth, they have agreed, in writing, that on the balance of probabilities, they may not have sent me a Default Notice. As they then went on to sell the account, does that mean that I could claim for unlawful recission of contract?

 

By the way, they have not been able to produce a valid agreement either.

Did they send you a notice of termination ?

No, but by selling it to a DCA is that not terminating the agreement?

 

If I paid all the arrears, and continued to pay the monthly sums as required and on time, the DCA would not be able to supply me with a new credit card when the original ran out, so the original agreement is no longer n force.

 

Or, what is more likely, am I wrong?

 

One other thing, when I asked M&S for a copy of the Termination Notice, they said ask the DCA.
