failure to comply is an offence under the data protection act.

Would appreciate any further in put.

Might be worth a thread in the Employment forum. Make sure your OH gets everything she's entitled to and that her employers do everything they should to make that happen. ;)

Hmmmmmm,

 

It seems that her employer (the manageress) is starting to turn a blind eye. And is less than helpful. I think the local yobs have got to her before the police. She seems more concerned about her business now than the welfare of my Mrs??????:mad:

That is exactly what happened with my daughter when she slipped on a "non-slip" surface and broke her arm at the pub she worked at. I'm sure the insurance would have coughed up, but the owner broke so many laws to cover her aris I was disgusted.:-x

 

DD wouldn't do anything about it because she wanted to keep her job until she leaves for uni, but if I'd had my say there would have been an insurance claim and sick pay.

 

If you haven't done so yet, I suggest some photos of your OH as evidence in case it's ever needed.

We are taking photos each day throughout the healing process. The police have the culprits name and address and my wife's statement. They won't attempt an arrest unless they have at least 2 more statements, or 1 more statement and positive CCTV footage:confused:. Luckily enough, the other barmaid saw everything and is going to provide a statement which will include the culprits name also. That is unless her boss gets her to change her mind so her business does not suffer. She is not worried about putting an insurance claim in. She is worried about the reprisals from the gang culture (and I use those words very loosely) in this area.

 

The other problem we may have is that my Mrs only helps out from time to time when the pub is busy (i.e Match Days, Private Functions), so she is not officially on the books. I'm not sure whether she can still put a claim in. I will maybe have to put a thread in the Employment Forums.

Sorry to hear the news! Best wishes to your better half for a speedy recovery.

 

1) Whilst the matter has been reported to the Police, if no 'real' progress in the very near future, a formal complaint to the Chief Constable is in order.

 

2) Any employer (Regardless of basis of employment, hours worked, paid or unpaid, sex, disabilities, sexual orientation etc.) is owed a duty of care and a safe working environment. The Employer must hold Employers Liability insurance (by statute), the certificate with policy details must be displayed (or it's location known and available to ALL staff). The incident should have been reported to the insurer. You or your legal represenative can make a claim against the insurer.

 

3) The incident should have been reported to RIDDOR

So sorry to hear what happened; we used to run a city centre pub and, sadly, arses like that are all too common :(

 

I don't know if it'll be applicable in your area, but we used to have pubwatch and we worked very closely with the police in terms of barring known troublemakers and keeping pubs safe for the decent folks. So perhaps that's a road you could go down with the manager? Looks bloody awful for her if a member of her staff can be injured and she does nothing about it. Possibly a word to the brewery also? It's in everyones interests that the pub is a safe environment, but from a brewery point of view, it boils down to money, so you may get some help there.

 

For your wifes cuts, until you can use the bio oil, (I've heard good stuff too) try mixing aloe vera gel with some wheatgerm oil - around 1 drop of wheatgerm to 2ml of gel. Aloe is fantastic for helping skin to heal, it encourages the skin cels to renew and wheatgerm is also very very good for skin and will help to keep it supple while the cuts heal, which can help to reduce scarring. It's safe to use on broken skin.

Always remember, someone who employs you gains financially from it. When they turn a blind eye towards the person they employ, they aren't acting in their best interests. Whatever you do, go for what is best for you and your other half Stuff everyone else. Sometimes you have to put youselves first.

 

My ex employer was also an ex best mate of 8 years. He stitched me up regarding NI contributions and income tax for 2 years. Also he made me redundant so he could employ his best mate. I had no problem dropping him in the sticky brown stuff with the Inland Revenue and Health and Safety. He now faces either a huge fine or prison and his so called buisness has been closed down.

 

I don't care. If someone craps on me, then they deserve everything they get in the way of Karma. If I can give that Karma a helping hand, then I will.

 

I always believe in the phrase, "Treat others how you'd like them to treat you. If not give them the same crap back times two, if you get the chance."

 

Good luck with this one Sod'em. And don't let anyone get away with anything that doesn't benefit you or your other half. :)

A bit of techy help please, this guy is still walking the streets.:mad:

 

A friend of mine has burnt a few copies of the CCTV footage for me, but it won't play on my laptop. I don't even think it is reading the disc. It is making the usual noises when I insert it, but it just keeps asking me to insert disc.

 

I've never had this problem before, as my lappy has played everything.

This sounds like the disc itself, rather than the data it contains, isn't being recognised.

 

Pop the disc in, open up My Computer (either on your desktop or on the Start Menu) and you'll see the CD/DVD drive icon. Right-click the icon and select Explore. This will tell Windows (I'm assuming it is Windows) to try to open the disc without running any of the data on it or autoplaying it.

 

If the disc opens, you should see the file(s) contained thereon. Right-click a file and select Properties. Under the General tab, you'll see a line that says Type of File: . This will tell you what kind of file format it is, and we'll be in a better position to help you run it.

 

If you cannot Explore the disc, you should get a message telling you why Windows cannot open the disc. If you do, let us know what it is, if you don't, try the disc on another PC running Windows. If it opens on another, it's your drive; if not, it's the disc.

as Tez said above,

 

old problem where people drag and drop when writing disks and session has not been closed can cause this, it will play back on the Pc that wrote it , and when tested on that PC , everything looks ok , normally that can be fixed with Nero , just close the session

..

Thanks Tez, the idiots (sorry, I meant the Police), gave some cock and bull story about the disc not working on their system. I presume they only use XP as our taxes cannot afford anything else.

Thanks for the concern GM (and everyone else). Things are going extremely slowly with the police. I made sure I got copies of the CCTV myself because (as I stated above), the police said it does not work on their system. After advice from you all and the fact that I didn't throw lappy out of the window, it finally worked (on VLV media player). (thanks again KIP).

 

They have a cast iron eye witness statement whom gave the lads name also (albeit, it was a nickname). That shouldn't make a difference as he is well known to the police. people even know where he lives, but it seems that he has got away with it:mad:. The police have more than enough to arrest and charge him, but they just seem to be dragging their tails.

 

I know it seems like I'm going on, but this has really affected my Mrs (and hence the rest of the family). She bursts out in tears (and I'm always thinking "what have I done now?") at different times of the day. She can't sleep. She won't see the doctor, and worse of all (in case of reprisals) won't press charges.

 

My only hope of justice is if the CCTV provides enough evidence for the CPS to make a seperate prosecution.

Well, the Police have finally made an arrest. The culprit has been shown the CCTV footage and admits it looks like him, but he is adamant that it is not him. (Only making things worse for himself in the long run)

 

The eye witness has to go next week to identify him from a number of photographs. We are 100% certain that she will pick him out as she knows the lad well. She's just not sure of his full name. He has been bailed until September with no conditions attached. I am a bit worried about that, because now is the time that windows start to get broken and intimidation begins.:mad:

Hi Just Came Across Your Post Whilst Being Nosy! Im So Sorry For Whats Happenned To Your Fiance And Family As A Whole. If You Can, Invest In A Small Camcorder If You Fear For Your Home Etc As We Found Out Recently When It Comes Down To He Said / He Did In Court They Dont Give A S**t Until You Have Proof.

 

Look On The Positives Though These Gits Might Not Do Anything, As Ive Learned Its Always Easier To Fear The Worse And In Reality Its Sometimes Not As Bad As We Think Its Going To Be :)

 

Hope The **** Bag That Did This Gets The Sentence He Deserves :)
