Although I ‘specifically requested’ from Barclaycard a copy of my signed and dated agreement pursuant to the Civil Procedure Rules ( Pre action protocols and Part 31.16) and therefore an unsigned copy would not suffice, only a copy of the original contract in its unaltered form would suffice

They ‘again’ forwarded me a photo copy of an unsigned, undated terms and conditions leaflet! And announced that “ This completes their obligation under section 78 of the Consumer Credit Act 1974”

 

They make a habit of continually forwarding copies of terms & conditions I never asked for!

I have been making this request now since August 2008 some '42 weeks ago!' but without success and they still keep demanding payment!

 

Can someone please advise as to my next step:confused:

Make sure you do not post anything which identifies you. Although we can remove certain things from the site unless it's done in a timely manner everything you post will appear in Google cache & we do not have any control over that.

Hi

 

same as mine! In response to my cca request they sent a copy of current terms and conditions. I sent acc in dispute letter and today got another letter telling me that as far as they are concerned they have complied, refer to things they have not even sent, and say that if I continue to say its in dispute, they will not respond further than what they have already said!!

When you've had all the help you need, make sure you stick around to help others too!

Just think, if everyone left the site after they'd got their help, there might not be anyone left the next time YOU come back needing more assistance!!!!!!!

Just received this 3 page letter from Barclaycard which has left me rather confused and a bit puzzled! It seems to suggest that they do not need to forward me a signed copy of my aggreement and actually does get a bit legally technical for me to fully understand. If someone could please explain the information in layman terms for me, and suggest some sort of response it would be much appreciated......Thanks........Pezz1753

If it was i'd take them to court......they cannot ignore the CPR31.16 and you can get a judge to rule on it !!!

Are you completely stupid or perhaps English is not your first language. I will try to explain for your benefit.

 

I DID NOT MAKE A REQUEST UNDER S77/78 OF THE CONSUMER CREDIT ACT but A LEGAL REQUEST UNDER THE COURT PROCEDURE RULES CPR 31/16.

Please comply with my lawful request. If you have any difficulty understanding the above I suggest you pass this LEGAL REQUEST on to someone who actually knows their a**e from their elbow.
