    • I've looked through all our old NPE threads, and as far as we know they have never had the bottle to do court. There are no guarantees of course, but when it comes to put or shut up they definitely tend towards shut up. I look forward to your deafening silence.   That should show them you're not afraid of them and draw their attention to their having legal problems of their own with the SAR.  If they have any sense they'll crawl back under their stone and leave you in peace.  Over the next couple of days invest in a 2nd class stamp (all they are worth) and get a free Certificate of Posting from the post office.
    • Yes that looks fine. It is to the point. I think somewhere in the that the you might want to point out that your parcel had been delivered but clearly had been opened and resealed and the contents had been stolen

    • Okay please go through the disclosure very carefully. I suggest that you use the technique broadly in line with the advice we give on preparing your court bundle. You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am ok thanks Dizzie had another illegible copy of the agreement this week.

 

Nothing from the court so at then end of the month I will consider my options, but I guess it is either leave well alone of complete N224 and request strike out? (Defence was acknowledged on 6th January)

 

Dotty, I would seriously consider taking the Gazbo/John(Vicky) approach

Hi LB,

 

No nothing to report on this one, or any others really, I have decided not to stress anymore about any UNLESS I get anything that vaguely looks like a LBA!

 

Whilst there are many on here that advise to respond to every letter received, I have come to the conclusion that it is a waste of time as the DCA's carry on regardless.

 

I rarely get any letters nowadays and only the odd phone call so I guess at the moment they are hounding others.

 

Whether I get to SB with these remains to be seen but we will see!

Agreed, I think the more you respond to the threatograms the more you encourage them to continue.

Hi minmoo, strange not received the usual email of the posting!

 

This is the only one where a summons has been issued (so far!) and their LBA was quite clear and precise as to their next step. (which is as it should be for pre action protocol)

 

It has however taken me a couple of years to get to this position and I have written many letters in the past with the great advice and help from others on here.

 

Sitting it out may not be suitable for others, it just seems to be working for me at the moment. But I do read everything thoroughly if I get anything.

This has been very inactive for a long time but have recently received a couple of letters from EC addressed to me but then Dear Sirs!

 

Goes on to ask the reader/occupier to contact EC by phone if I cannot be contacted at the address and if they are able to supply details of the addressee's whereabouts and to confirm removal of the address from their records!!!!

 

Hope this makes sense, in the past I would have scanned the letter and posted it up but am very wary of this nowadays.

 

Although anyone else dealing with these people may have already had a similar letter!

Not a bright idea on their behalf is it ?

example, I allegedly owe "x" amount, they address a letter to me, asking the "householder" if they know the whereabouts of apparently the person who the letter is addressed to ?

I'm confused already !

How many people open mail that is not addressed to them "personally " ?

I have heard nothing more from Hillesden's apart from a statement of account!

 

I have however had another N1 issued this week for an agreement that is yet to be confirmed (as far as the OC is concerned) and it was issued without any letter before action and only a standard threat letter in November last year!

 

So beware! :shock:

Sorry CB I didn't make this clear, the N1 I have had this week is totally unconnected, it's just that I wanted to make anyone aware of what had happened with no lba as it was pertinent to the last few posts on here.

Hi LL no it's not the same creditor.

 

It was just that on some of the last few posts we had been talking about not responding to the countless threat letters and wait until what looks like a serious lba is received, but this new claim has been issued without one!

 

At least I have this thread and all the help I was given, to assist me with another claim, I'm hoping it's another of those where the claimant is hoping to get lots of ccj's by default!

I'm just posting here to see if it brings this thread back, as it's not listed in my threads.

 

A recent CAG upgrade caused a problem with threads going missing, most of mine are back now apart from this one and I don't want it to be lost forever!

I may have to resurrect this thread and read it!

 

Have had a letter from Aktiv capital today, questioning why I've not been in touch to pay, call and they may be able to offer me a huge reduction on the amount required!

 

Must find my file out and have a catch up, Aktiv are on the move at the moment issuing court claims so I better not ignore this but see what letter is appropriate to send.

 

May be talking to myself here if no one is subbing anymore! :lol:
