I'm fighting a litigation by a popular debt collector/litigant. They have provided me with a bundle of alleged evidence which includes a new witness statement, after I had already submitted my defence. The Court has given me permission to submit an amended defence. I also want to specifically ask for a copy of the Agreement as the one they provided me with is a poor and fuzzy version which shows the Application Form with no creditor signature. The terms and conditions are presented separately with no date/signature. Has anyone got any experience of asking for Specific Disclosure please? I'll be grateful for your help. Thank you.

Presumably you have already filled out your AQ.

 

Send the other side a letter asing for the dislcosure. Give them 7 days to comply. Point out that after 7 days you will seek an order from the court.

 

Use a form N244. In the accompanying statement explain that you have asked the claimant for disclsure and they have not complied and therfore you are seeking the assistance of the court.

Enclose a copy of the form whch you are seeking to replace.

It will cost yo about £75 which you wil get back if you win

Thanks BankFodder for the prompt and helpful response. I'm drafting a letter along the lines you've stated and this will find it's way to the creditor by recorded mail on Tuesday. Thanks once again.

Allocation questionnaire

 

 

An allocation questionnaire is a form used in English legal practice. After a claim is made, if a defence is filed each party is required to complete and return an allocation questionnaire to the court so that the judge may properly allocate the claim to a track and give further directions towards a final hearing.
