    • Hi, I'd change justice centre to county court. I also wouldn't be including a telegraph article in the bundle. It doens't prove anything law and you don't have distribution rights on it. I also wouldn't personally break down the exhibits on the index page, normally people have a seperate page for this right before the exhibits. The main index page normally just says Exhibits to WX of [Your Name] or at least that's the format I use/see people here use, although really it makes minimal difference.   I also see that despite referencing several judgements you haven't included the EVRi one   paragraph 46 really needs to go imo it has nothing to do with anything. Your in court to apply the law to your case, not to tell the judge about a newspaper that means nothing to your claim.   I also see you've adopted the issues in dispute/not in dispute, which is also known as a scott schedule. if you are taking this approach, for things not in dispute I would say this needs to be things that are agreed between parties, not things like "There is no dispute that I am happy to supply all this evidence which is included in the court bundle." I would say that issues in dispute is to focus on the aspects of the claim that are in dispute, such as whether liability is limited by insurance or not, so I'd be changing that accordingly.   BF should be along shortly to advise on things.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Good Morning All,

 

I have a ptp loan that i have had for 18 month enough is enough now and i want to get it paid of, My payment is due friday and i want to cancel the direct debit but as they have my works number i am worried they will keep ringing my work, and as its not a direct number to me anyone can answer :(, Can someone help me with a letter i can send to the via email to say that i have cancelled the direct debit and i wont be takling calls i will only deal via email or post?

 

I am so nervous i just want to get out of this mess.

Don't worry.....email them and make it very clear that you are not avoiding this debt but will ONLY correspond in writing and ask them to remove all of your contact numbers. This worked for me.

 

Also....on a brighter note. I cancelled my DD in November and have only had one email and one letter. Nothing since. :D

Don't worry.....email them and make it very clear that you are not avoiding this debt but will ONLY correspond in writing and ask them to remove all of your contact numbers. This worked for me.

 

Also....on a brighter note. I cancelled my DD in November and have only had one email and one letter. Nothing since. :D

I put something like this:-

Just to keep you informed, yesterday I wrote a letter to your company asking you to correspond with me in writing / email over this debt and not by telephone. This was sent first class to your office in the Isle of Man.

It is my right to request this and failure to do so means that you will be breach of The Communications Act 2003 and The Administration of Justice Act 2003. Failure to comply means you will without hesitation be reported to OFCOM, Trading Standards and The Office of Fair Trading – meaning your company will be liable to substantial fines.

I am not ignoring this debt, contact by email proves this.

I am unable to pay the debt in full and as such i have cancelled my DD which is due to be paid on XX/XX/XXXX

Copies of all emails will be kept as evidence should you fail to comply. Please ensure that ALL my telephone numbers are removed from your system.

I trust that this meets with your approval and look forward to receiving your written response

They already have your national insurance number as it is your log in details and they ask for it if you speak / email them.

Hi Guys,

I have been passed to Clarity and have found them to be better that PTP but equay as obstructive, the fort call i offered £10 a month and was told they would see me in court and the second call i increased the offer to 90 a month and was told i would have to go to court.

PTP were awful, i answered one call to my work place and it must have been obvious that i was unable to talk, i was called a liar and a theft and asked how i was going to feel when people come and smash my door down and take all my possessions, fortunately i informed him that all calls to my work are recorded due to the nature of wher i work and that i was certain that it could be described as intimidation, i never recieved a further call. But whats to do with Clarity who are being difficult??

I searched for advice on here about PTP and someone had put an IOM address up for them so i sent a letter....i later found out it didn't exist so that was a pointless excersize really.

I haven't been passed to Clarity or hear anything from PTP since last year :cool: but you need to keep everything in writing! They cannot refuse your offer of payment if it is what you can afford - even if it was a token payment! They are playing games, stay strong.

Hi guys, been a while since I posted.... anyway, now I have a repayment plan in place with Clarity, they accepted my first offer immediately. Now I have also an outstanding loan with QuickQuid, which has been a total nightmare, I have threatened them with court action etc etc (long story). Anyway, now my situation has changed, and I have the chance to move to Italy to work. Question is, should I repay them before I go, or leave them and dont bother. Does anyone know if they can trace me if I dont tell them anything? I mean i'm taking about debt of about £1000 nothing so bad..... dont know what I should do? can they trace me abroad? will this affect my credit rating abroad? N ow i have a chance to totally start again and I want to do everything the right way. Any suggestions?

Hi there,

I have a very similar situation to alot of people here. I wish to cancel my DD for my PTP loan as I cannot afford to repay it. I am concerned though, as last time I cancelled my DD some strange person from PTP telephoned my father and asked to speak to me. I dont know where they got his number from - its not listed on the numbers I gave him, and I would never give them his number anyway. I wonder if they did some weird trace on me back to my dad via my national insurance number? Either way, it was very dodgy. I dont want to involve my parents in this or have them hassled by these people. What can I do to avoid this?

I would like to send them an email telling them not to contact me or anyone else on telephone, do they listen to this? I really don't want my parents hassled and I just can't understand where they got their details from anyway - seems extremely dodgy as I havent lived with my folks for over 10 years!

i have just got off the phone with clarity. I had a lovely lady who said she would knock £80 off my balance , i asked about making monthly payments & i offered her £50 a month which she said she couldn't accept but if i could have the balance paid in full by the end of july then that would be fine . I took the offer from her as it means PTP are out of my life for good !!

 

My first payment will be taken on the 28th May , then one in june & one in july... & BYE DEBT :smile:

 

My expereince with Clarity was HUGELY better than with PTP... I am happy with the outcome & the lady i spoke to was actually v nice & polite :p

Hi candyflosspot (a lovely name :-) and as it's only your 4th post I'll say welcome to CAG!)

 

Yes, I found that my experience with Clarity was also hugely better than with PTP. When I missed the month's payment, with their inflated 29% per month compound interest, with PTP, the foreign-sounding chap tried to pressurize me into making a full payment or at least half one month and half the next. He threatened that things would be very much worse with a DCA, and that he was actually being reasonable :rolleyes:. Also his 'solution' if I played ball was that PTP would offer me another loan, at their usual interest rate of course! I said I couldn't afford another loan!

 

Anyway, Clarity were MUCH more cooperative with me making payments I could afford, and with my former debt management company and with my current 'debt-elimination' co. It is one of the companies I'm paying £1 a month to, as they did have a fully executable agreement.

 

When you say "Bye Debt", was that your only one - if so you're luckier than most of us :) You don't have to answer that, of course.

no sadly i do have other debts .. i meant it as BYE PTP debt !! I am still in cahoots with QQ.. trying to make arrangements is hard work tbh and think they should be paying me for the amount of effort i have put in trying to arrange a payment plan.

I have a payday loan with cash genie which i'll be paying off this month , and also £300 in money shop cheques (this was at £700 back in feb )... i have sold all my stuff & worked for cash in hand (as extra income from my main job) in order to earn some more money in order to get rid of the debts ) .. i feel i am finally making some headway with the payday loans as i had a good grand or so outstanding start of the year)

I also have mainstream debts as well but these are all under control and im not worrying too much about them !

 

The lady i spoke to clarity was lovely & actually quite understanding.. much better than the monkeys at PTP & especially with QQ !

Just spoke to PTP asking to set up a payment plan. No such luck, and my "account manager" or as I like to call him EDIT, has said that my details will be forwarded onto Clarity, who I'm more than happy to deal with as they sound like a decent company who will offer payment plans.

 

When the guy told me that PTP will not be contacting me anymore, I said I want that in writing, either via post or e-mail

PTP - "I'm sorry, PTP is a strictly electronic company, and we cannot send that confirmation out to you"

Me - "Is e-mail not an electronic form of communication?"

PTP - "No sir it is not"

Me - (Biting my tongue now) "Are you actually being serious?! E-L-E-C-T-R-O-N-I-C mail! Clue's in the name!"

PTP - "You have my assurance that PTP will not be contacting you from now on, everything is being passed to a 3rd party collector"

Me - "Well I'll make sure they'll deal with me in writing then!"

PTP - "Well it is totally up to them, they may decide that this guy is impossible to deal with via telephone, and we'll just operate a door-to-door visit to reach him"

Me - "Ok. Nice to talk to big when your in Malta isn't it?".

Slam phone down :p

 

If I receive one phone call from work, people in my office know how nuts I am and they'll have to put harrassment charges on me when I'm through with them!

 

I have Wonga and QQ still outstanding, they however, seem like quite a lethargic lot when it comes to the phone calls.

Oh PTP what a delightful bunch of people!!!!! Clarity have only dealt with us via email, not sure they are going to like the one I sent today though as I have instructed a DMC to act on my behalf as juggling all my unsecured creditors has got out of hand and I cant keep up anymore!

Hi Mblessing20,

 

PTP are nothing more than a bunch of monkeys, wait for Clarity contact which took them about 6 weeks to get in touch with me but million % better to deal with than - from reading from here and my own personal conversations they will accept almost any offer of payment as long as you can make a payment plan and set up a direct debit.

Having said that they screwed up a bit with me as I gave them my card details and they were supposed to automatically take my first payment in May as the d/d could not be set up on time, anyway they didn't and have sent me a letter chasing payment but I have contacted them advising of my previous conversation and they have apologised and admitted fault saying my card details are on file but they did not set them to automatically take the first payment so now my direct debits go from June onward which is better for me. :)

 

On another note, has anyone had any headway with QQ (candyflosspot or anyone else)

I defaulted with them also in Feb and I am still getting the generic chaser emails as they must still be trying to take payment from my cancelled bank card even though they have not complied with my CCA request or formal complaint. :mad:

Hi everyone, I'm parkieman. I'd just like to say a huge thank you for all of your posts! I have been with PTP on-and-off (but mostly on!) for FOUR years now, borrowing anything in the region of £100 - £440. I guesstimate that they have made ain excess of £3000 in interest from me during that time! Like many of you have already stated, it IS a downward spiral - the quick and no-hassle access to ready cash when you need it most is hypnotic and you quickly rely on it as an additional source of income rather than a one-off option to help you out, which is what they sell themselves as!

 

Whilst I accept full responsibility for making that application each time, if they really supported their statement of 'this is not intended to be a long-term financial solution', maybe they should intervene when they realise that customers are requesting reloans before their previous repayment has even cleared!

 

I've NEVER defaulted on a payment, often as a consequence not paying other bills which are in comparison more important (and also going days without eating, begging from friends and family!) - partly because I'm terrified of the consequences and partly because I've become so reliant on them as an additional source of income.

 

I've now fallen into financial difficulty due to a change in circumstances and having spent the last three months begging and borrowing from friends to pay living expense bills (although PTP have always rec'd their money), have realised the only (and most sensible option) is to fall into arrears with them as opposed to three or four other creditors.

 

I'm comforted to know that there are ways to prevent them collecting payment for the last loan, such as the direct debit guarantee, and also that, despite PTP apparant unsympathetic approach to some of you, they eventually refer to a debt collection agency that are reasonable. Like you all, I want to pay my debts and ask for some understanding during these difficult times. It is obvious that PTP do not consider the history of a customer or how much money they have made from them when dealing with defaults!

 

I will have to cancel my DD before collection mid-November to stay afloat and prevent my situation from getting out of control, but can anyone advise if it will help my situation any if I contact PTP before the collection date to tell them, or if it will make no difference at all?

My advice with this would be to keep offering a repayment solution. ANd if you have their bank details then just pay that to them even if they have not formally accepted the plan yet.

 

My only concern with these companies now is whether once you pay it in full do they confirm it to you in writing? How can you be sure that they do not keep your details on file and then claim more money at a later stage?

 

I hate having defaulted on them in the first place - these companies are a nightmare to deal with.

mBlessing20 - that is the way to deal with them, I had one Canadian guy from QQ ranting on for about 20 minutes how he hates 'people like me' borrowing money and then backing down on the deal.. as I had earlier paid them back I let him rant and then he said '"What do you have to say'... I said 'You have the wrong person, debt repaid earlier today... goodbye and hope the rest of your shift gives you grief.'

 

They like to keep it verbal because they know they won't be able to use the phone calls as court evidence as they will go against them, that is why everytime one calls you should email, even if it is to the collections email, that they called and what is said.

Cooldude, that is why I recommend getting another bank account and paying them from the old one, that way they cannot go in and 'appropriate' your funds. Certain of these companies (Wonga in particular) have a history of doing this and nobody seems able to stop them.

Yeah I agree with the bank account SillyGirl...

 

but I was thinking more along the lines of say once you have paid them off in full and the debt is cleared, how can one make sure they dnt leave it on your credit file as unpaid....or even worse...once it has been passed to a debt collector and you pay them how can we make sure the DCA is actually entitled to collect it....

 

for one of my debts i have been contacted by 3 different DCA's....and now I don't know who I should actually be paying?
