    • Yep, those 'requirements' not met to shareholders satisfaction seem to me to be: 1. Not being allowed to increase customer bills by 40% (of which well over 50% of the new total would NOT be investment) 2. 1 plus regulators not agreeing to letting them do 'things in their own time (ie carry on regardless)
    • As already mentioned freely available "credit scores" are fairly useless. All lenders have their own "credit scoring" system, that for obvious reasons they don't divulge. And they're "scored" differently to the freely available ones. As soon as they could, we've always encouraged our two children to use credit cards responsibly... Pay off in full, etc, to generate good history. It's paid off. At quite young ages, they have both obtained loans for cars, mortgage and their credit card limits are through the roof. Personally, I have shifted debt around a lot on credit cards (even financed a house purchase once at 0% 😉) and I've only ever been refused a credit card once, sorry twice by the same company, over many years. They must have something very different in their lending criteria. You're a tight one, Mr Branson.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Clarity I have to say were really easy to negotiate with. Payment plan set up for 3 months, to be reviewed but if my payments are not missed, will be continued.

 

I am able to pay by SO and on a day that I want.

I think it is great that they have been named and shamed, along with a few other companies (Quick Quid etc etc). Shall mention that in my next email to them, ask them to comment on the recent publicity hahahaha.... me too... i'll be watching it too

I just had Payday Express chasing me for my payment they have slapped £105.00 interest in a matter of 12 days. I told him he was only going to get what I actually had and not a penney more i also told him to watch Channel 4, Payday Express in on my computer when they shot the photgraph, so yes I am loving it. He gave me their bank details so I can pay by SO and said he would see what he could do about the extra charges. There will be a lot of toilet rolls on sale now.

I am actually pleasantly surprised after a week of emailing saying I wanted all communication in writing as I had recently been discharged from hospital and getting that silly reply

What did you say to them to get that response? I am still in the we won't contact you in writing phase! I got a great one from Payday UK essentially saying they would ignore any of my letters and were going to continue to take the money as normal. I think I will be changing the bank my salary goes into :) Sometimes you have to laugh at these people.

After banging my head on a wall a bit I sent the following email to

The credit agreement and broker agreement and all other communications between the parties are to be provided by way of electronic means (except where provided otherwise by any statutory provision). By signing the credit agreement and the broker agreement you agree to a. receive all communications from the creditor and broker and to send all communications to them by electronic mail at the e mail addresses notified.

You are also bound by English law as stated in the terms and conditions

I will repeat for the fifth time why I would prefer communication either in writing by email Or letter

I would prefer not to communicate by phone as I have recently been discharged from Hospital. I had been admitted to hospital with severe chest pain, this may have been bought on due to Anxiety. I generally find letter and email a less stressful mode of communication. I cannot Understand why you are being so unco-operative.

I have worked in sub prime lending for a number of years and my best advice for anyone that owes money to these 'Cash till payday' places is - don't bother to pay them back. They don't credit search you so therefore cannot put anything onto your credit file. Check your credit history and you'll see that I'm right. Most of them are based outside of the UK and after a few emails, letters or phone calls they leave you alone.

This is getting annoying, haven't heard a thing from them since my last email hehehe, not that I gave them an option really, my last email was like "either we arrange a payment plan amongst ourselves or else pass this onto Clarity please and Thank You"

Well I've been emailing them for about 2 weeks now most days and they refuse to set up a payment plan. I've just got another email from them today reminding me their payement is due. Payday is Friday so I'll see hat happens then.

If you check your credit history - it costs £2 to check it online - you will see they do not search your credit history, therefore they have no rights to marking your credit history. They won't take you to court either - it's not worth their while doing so.....they have not acted as 'responsible lenders' so therefore are on shaky ground. So - what can they do to you? Nothing. Cancel any direct debits to them, change your bank card and don't bother paying them. And ignore them.

Got an email today! From PTP, it is the first i've had and it goes like this:-

Lucy - I had the same thing 3 days before as I cancelled my direct debit and they rang me so I told them I couldn't afford to pay them. Now the debit is near on £600, had one phonecall from them since 1st dec and they haven't even contacted me by phone or email....

 

I am now waiting for this to be passed over to Clarity, in which I am pretty sure they do? Don't they?

 

I have opened another bank account with someone else, but I am worried they may find this out and try to attempt to take money from that account, as my benefit's are being paid into that new one, can they do this if they was to search your credit file?

Hi Guys,

 

I defaulted a payment with Pounds til payday on Friday. It was for £519.00, how long do people think it will be before I start receiving the delude of phone calls from them?

 

I am off work at the minute, and not back until 4th Jan, so I really dont want them ringing up work when I am not in.

 

I can afford to pay it back on the 24/01, what would peoples advice before on how to approach this.

 

Should I contact them by phone or email?

If you can pay it and it doesnt leave you short then thats great, but if you think that you will need to re loan then just default, cancel your card, change bank , also send letter to your bak stating that under no circumstances are these ppl to take any money from your account. make sure no money in that account so they cant take it, send them an email ( do not call) saying that you cannot afford to pay it back and could you set up a repayment, dont call them and dont take their calls, they are rude and bullies.

 

read all the advice on here, these guys are great and have really helped me.
