    • Are you allowed to appeal if you plead guilty?   I know you appeal the sentence, but the criminal record formed from your guilt would surely remain?   I'm not sure if your able to appeal a crimianl record if you plead guilty are you?
    • DX: I did not pursue Link after I got the CCJ amended to monthly payments. Pretty sure the CCJ does not mention reviews, I do have the CCJ somewhere, I will have to look it up in storage. It is as mentioned on the thread you referenced  in your post #28. The Barclays loan was taken out in September 2004 for 60 months! Current Balance remaining approx £2K. On checking back my past correspondence with Barclaycard about this loan, there was a history of them ignoring my letters and offers to pay, and I even had problems in obtaining their bank account details for them to accept my payments! I have received strange correspondence from them too, one referring to insurance which I did not have. They seem very disorganised! Barclaycard told me to pay "Masterloan" a while back and I now receive regular statements and arrears notices from "Personal Loans from Barclaycard" clearly marked Masterloan, they changed the account reference number! I have never requested a CCA on this account. I advised them of my change of address last September, but they are still sending, until today, statements etc. to my old address! I have received 2 letters from Barclaycard Loan today though, not opened them yet!!
    • Yes, a few months ago. They wrote back saying there was no CCA and the debt was unenforcable. I then started gtting bombarded with threatening emails from their 'litigations team' which have been sent to spam. I've now recieved the letter before claim with the PAP form enclosed, but still no CCA or even a letter from them to say the debt is deemed enforcable. Thank you.
    • That's a shame but not unexpected.  I'm not sure about your assumed  questions because I haven't been to court but I'm not sure about not accepting a criminal record. It could be a language thing but it isn't your choice unfortunately.  HB

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Guys, be gentle with me this is my first post! And guess what.....i am having trouble with PTP! Last week i cancelled my DD, basically because my wage didn't go in on the day it was meant to so i cancelled so i wouldn't get charged by the bank. Once i cancelled it i realised that i cannot carry on like this, reloaning every month and paying £80 for the pleasure. I recieved a call from Stephen Clarke informing me that the DD had been cancelled, he asked me to call back the day after and pay the balance in full and he would kindly(?) remove the charge.

 

I cannot do this, so on Monday he called my mobile while i was at work (i didn't answer) and then he called work, luckily i answered as i just instinctively knew it was him. Stupidly i just said no she's not in so he left a number (why, oh, why did i not say she's left the company?!?). Thing is i'm not allowed calls at work, i work in an open office so is very embarrassing and i do not answer the phone!.

 

I have today wrote and emailed them with this letter:-

 

"Just to keep you informed, yesterday I wrote a letter to your company asking you to correspond with me in writing / email over this debt and not by telephone. This was sent first class to your office in the Isle of Man.

It is my right to request this and failure to do so means that you will be breach of The Communications Act 2003 and The Administration of Justice Act 2003. Failure to comply means you will without hesitation be reported to OFCOM, Trading Standards and The Office of Fair Trading – meaning your company will be liable to substantial fines.

I am not ignoring this debt, contact by letter and email proves this.

I am unable to pay the debt in full; this is due to unforeseen circumstances which have meant I have been unable to work. I have proof of this and can send if required.

Copies of all letters and emails will be kept as evidence should you fail to comply. Any telephone calls will be also kept as evidence and recorded. Please ensure that ALL my telephone numbers are removed from your system.

I trust that this meets with your approval and look forward to receiving your written response"

I am panicing now as to them calling work again, does anyone think this will work? Have i put the right thing?

 

I know i am quite a few weeks off being passed to Clarity, but can't cope stressing everytime the phone rings at work!

 

ADVICE PLEASE FOR A NEWBIE :)

Unfortunately PTP are going to bombard you with telephone calls for the next couple of weeks.

 

Do not answer their security questions and tell them that you will only correspond by email or mail. They will soon give up and pass your account to Clarity.

Oh you're not wrong their......just had two phone calls in quick succession on my mobile, obviously from them as it comes up "unknown" and no message left.

Don't worry I had the same with PTP they did not bombard me with calls at work or at home. I think I spoke to them about 5 occasions. I dealt with e-mails and specifically told them I do not take calls at work. They passed me on to Clarity within 5 weeks and I am paying £10.00 per month sometimes missing a month and even then only get a letter from Clarity asking me to contact them, which I don't. I owed £900. So stop worrying it will be OK.

I think it must depend on who your "account manager" is....people are writing about this "gavin" and he sounds dreadful! Mine is Stephen. i've just emailed the customer relations team, copied Stephen in and also copied the FOS in as i have already requested they do not contact me by telephone.

I have a payday loans with PDP which I have had for nearly a year and am finding it increasingly hard to keep paying them back and reloaning with them. I did default once and received a letter from clarity informing me that I had to pay the debt in full etc. I panicked and paid in full only to reloan again! I really want to get out of the vicious circle but am scared if i default clarity will not accept a repayment plan. As anyone had this problem.

Hi - PDL's are meant to be viewed as a short term loan and not taken over a period of time. I was in the same trap with PTP and defaulted due to not being paid on the correct day but to be honest it was the best thing i've done as i was paying £89 every month in interest and not paying any of the debt off.

 

The only thing that concerned me was the constant phone calls from the "account manager" - i simply emailed them asking them to take my numbers from their records and haven't heard anything since! I am now playing the waiting game for Clarity!

 

If you send a full income & expenditure all they can do is accept what you offer - be firm even if they reject the first time. They will eventually accept (especially as over the year you would have more than repaid your loan!!!!).

I sent them a message online to tell them that I will be unable to meet the repayment date on Friday, and as such, I have had to cancel my DD. I wrote to them that I would like to negotiate a payment plan..... sounds like this is where the fun begins, eh? I'm expecting to be bombarded with calls now..... the general consensus is that they hound you.... the only relief is that the office number they have has now been disconnected hehehe :-) I have been thinking for a long time about just cancelling the DD with them, not because I don't want to pay, but because im struggling to pay the £130 interest each month.... anyway, after reading all your posts carefully, I decided to do it, and in a way im kinda geared up for a fight now!! ALthough a bit aprehensive about it hehe....

 

So, now that I have cancelled my DD, what comes next?!?!

Now that you have cancelled the direct debit the next thing that will happen is the phone calls and e-mails will start. I received around 3-4 calls per day and about the same amount of e-mails for around 7-10 days. I spoke with the account manager who was 'assigned' to me - the wonderful 'Gerry Maguire' (Hi Gerry) and made it totally clear that the odds of it snowing in the Sahara would be better than me making full payment there and then. He got quite abusive on the phone (be prepared for this) until I kindly informed him 10 minutes into the call that it was all being recorded and WOULD be sent to the OFT etc at which stage he promptly hung up - LOL. If you speak to them just be firm and tell them you cant pay in full and stick to this - they will soon get fed up. After this the debt will be passed onto Clarity and you will get a letter asking you to contact them -it took 6 weeks for this letter to arrive on my doorstep. Clarity are pretty good to deal with and you should have no problem negotiating a monthly payment with them and as long as you stick to it you should get no further hassles. Remember to only offer a payment you CAN afford and dont let them try and corner you into paying more than affordable. I wish you the best of luck and I am sure you will be fine and you will get all help needed on here. Remember you are not the 1st to go through this and unfortunately probably wont be the last and the amount of experience I found on here when I was in same situation was invaluable.

I have had a really quiet time from them to be honest! Think i've been lucky! My account manager was Steven Clarke....he rang me twice - tried me twice at work then i emailed saying i won't be accepting calls etc and sent it to customer relations team etc and threatened to take them to FOS and it all went quiet!

 

That was on 04 November and not a peep since :D

 

Just playing the waiting game now and waiting for Clarity!

I must say so far all is quiet. I did have a telephone call from an "Unkown" number on my mobile, but I was on another call at the time and so I didn't answer it. No email either. Maybe since my repayment date is not till Friday, it will remain quiet till then?!?

And I am not prepared to take any of their nonsense on the telephone and will not tolerate bullying or intimidation. If they become threatening or aggressive, I will do as suggested and tell them the call is being recorded and that I am reporting the person directly to the OFT. If they think they are going to treat me like a piece of dirt they have another think coming, as said previously, I know my rights, thanks to the forum... and I wouldn't let my family speak to me in a threatening tone, so i'm not taking it from someone on the end of a phone.

 

Maybe I will be one of the lucky ones and not receive so many calls!!

It used to come up on my phone as "unknown" too - thats because they are calling out of the Uk i think! I was so pleased I didn't end up with Gavin! :D

 

At least they won't be harrassing you at work as the number is disconnected! ;) That was my only worry with them as its really embarrassing!

Yeah, i'm saying that, probably I will go home tonight and find 200 calls on my house phone hehehe. Should they be contacting me now, or after Friday which will be my repayment date? As I said, I sent them an email to tell them that I am unable to meet this repayment.....

Not sure tbh, i was naughty and cancelled my DD and didn't inform them! That was a Tues (payment due Weds) and first phone call was Sat morning :)

 

At least on your home phone though there isn't the embarrassment of nosey work colleagues! :D

Oh I have to admit I do miss my slanging matches with Gavin, be it via email or telephone call!!!

 

I contacted them on the customer relations address and requested only to be contacted in writing, they kept to this but when I explained that I was still only prepared to pay in installments they said they will send it to external agencies. I replied simply that I look forward to hearing from them and that was a while ago so should here back soon now.
