Natwest Overdraft has Overdrawn Me HELP!

NATWEST ARE OVERDRAWING MY ACCOUNT!

 

I am 5yrs Existing Nat west Customer.

 

I have a Current Plus acct with them and £1000 Overdraft.

I have never used an overdraft before and after 6mnths of having it I decided to use it. (statement below)

 

 

 

30March balance -£989.

31March -£15 interest

31Match balance -£1004 overdrawn

1April +salary £500

.

.

.

20 April balance -£987

21April -£15 interest

21April -£25.5 charge Maintainance Fee(31March)

21April balance -£1027.5 overdrawn

22April +Salary £349

.

.

21May balance - £25.5 charge Maintainance Fee(21April)

.

.

 

So this is a Total of £50 Charge and also the £30interest in just 60days also I am on Low income :mad:.

 

Ok I phone their 0845 number @ 80p per min (Big Mistake)

 

They Put me on hold for Centuries, Passing me form Bimbo to Bimbo takinf 30mins = £24 phone Bill

 

and they still refused to refund me me outrageous charges!

 

They wont Barge!

 

Banging on about Not Bank Error!

 

They said the interest day changed from End of each Month to 21st of Each month.

 

But I was not notified of this change in the post.

They Lied that I Opted for Online Banking so All my Correspondence would Cease! and I would only received Online Statements.

I checked Online Banking page After the Call to check wheather I Opted out Only to discover that I had never Clicked on any thing to Stop receive paperless statements?

 

Therefore I am not liable for the 2nd Charge on the 21st May as it was not notified to me as in the terms and Conditions stated.

they Still did not Barge.

 

so Pls give me advice.

 

 

Please can some one help me with Advice.

Do I have a leg to stand on if I take Legal Action?

or How do I claim back these charges

 

I am closing the acct once I pay that o/d thats for sure.

 

 

 

 

Natwest more like CrapWest.

The overdraft incurs interest and the interest payment going out is taking it over the overdraft.

Give me two secs cos a maintenance charge is £28 not £25.50 or have they dropped the price?

 

EDIT: £25.50 maintenance charge should be £28(have just checked their website).

can you clarify the charge itself cos the amount appears to be incorrect anyway which kinda may lead to another question.

 

EDIT: the change in the charging period was notified to all natwest customers in January

I am being a complete idiot on this one and should have spotted the dates. What is the date when your statement is sent out? Do you have online banking facilities?

Yes I have Online Banking Facility.

 

But actually it seems weird I haven't received my bank statements for 4months.

 

Natwest told me in that conversation that they some how didn't have an address for me on File? that I need to Fill Forms in branch again.

 

Seems Weird as that my Parents address and I have lived there for like 10years

Ok, I can sort out the address thing easily to start with and then carry on with other matters.

1)Apologies I looked for a landline number but as you are registered online you can change the address over the phone or double check it with them....0845 7 888 444.

What you need to do is check the statement date?

The reason is that a change was made to the way you are charged which was notified to everyone in January. From 1st April 2009 you are charged 21 days after the charging period which is your statement dates. For example, say you exceeded the overdraft by £10 and your statement dates are April 21st to May 20th. 21 days afterwards you are charged or 10th June.

I suspect your statement address is 1st to end of the month so 21st of April you get charged. THe next month one should be £28.

2) I think you need to ask them if mail was returned from your address since you haven't received statements for that period of time.

 

I need to clarify with you whether you are aware that you are charged interest on your overdraft? I think you may have 2 separate issues,

1) without pre advice statements you are unaware when to pay money into the account to cover the interest and have therefore incurred charges because of that. Had you known then you would have paid money in to cover the amount ouststanding(that may be one line of argument for you).

2) if mail was returned from your address you had no way of knowing until you were charged that this was an issue until you have been caught up in the changes to the terms and conditions.

To add to the Actionline advice, there is an option to speak to an advisor and they identify you from your ONLINE Banking PIN number.

Natwest have confirmed that They do not have an address on File for me for some reason they didnt say.

 

I also I had no preadvice statments sent out to me cause of this.

 

 

Also I argued point (1)with them as you said, But they are telling Lies that I Opted to receive my " Bank Statements Online" within the Online Banking and that I also clicked not to receive statements though the post which is Total Bullshoot! As I discovered once I logged in to the Online banking after the argument.

Come 2 think of it only Online Banking have access to such information not the Frigging Lesiter Lending Dept?

 

They said its not a bank Error

 

But this is a Clear Bank Error as they stopped sending me Post when I clearly Live there and they changed the charging information and didn't notify me the Loyal customer about anything.

 

 

It was only Due to the Outrageous charges that forced me to get intouch with them.

 

I have a Natwest Credit card as which for 12mnths I have Clearly been receiving Pre Advice Statements at then same address also I have never missed a payment due to their presistant bombarmned of Preadvice Statements.

 

 

 

They're still acting like Bouncers and don't want Clear the Unlawful Charge(s).

 

 

What Can I do next, because if I phone them up, the previous Muppet has put on my File "No Refund of o/d Charges"?

Thus they will all say the same thing.

 

 

I cannot afford these charges atm just been demoted to Low income.

You may not be approaching this in the same way I have suggested. Go into a branch that is opened on Saturday and ask them when you had post sent back from your address as you have been made aware that your address was wrong. Furthermore, ask them to investigate when your bank statements by post was changed to online statements since you are concerned that it was done without your permission or that they may be an issue with your online banking(remember you want them to think you know as little as possible about what you are going to do). The reason they know about the other thing is that they may have checked other notes on the account with regards to complaints which you may have already made.

I would add that you need to change your statement date to perhaps middle of the month cos any interest and charges would go out 21 days after the statement date so better to do it that way.

When you have all the information then you can complain to [email protected]

If they won't play ball then you have to reclaim the charges the normal way but that will not be resolved until after the OFT test case issues.

Is is so not yet as I have only gone into me local branch and they decline the refund...even though its Clearly their fault

Yes it was customer relations unit and I think I suggested that you went via CRU before. I would do it as advised on post 11 and then report back. Keep the chin up in the meantime though

Can it be explained to me How Natwest have managed to Overdraw my account when it has a limit on it.

 

e.g I cant overdraw my account via cash machine, shops etc so how did they manage to do it and charge me a fortune

You can via shops, a poster on another forum who had a business said that their machine was set to check every 50th transaction. Cash machine withdrawals can take it over the overdraft if other card transactions haven't gone through.

I think the business man may be wrong indeed because even if I make a transaction during the weekend and then check a cash machine breakdown statement slip or Online banking. it shows a the amount as deducted form the total balance thus not allow one to get overdrawn. And I would imagine this for shopping also.

 

 

So How come Natwest can apply a different law unto themselves and overdraw me is the a Loop hole there?

I've seen transactions where the money is set aside, then disappear only to be debited a few days later. Had I used the money in the meantime I would have gone overdrawn as a result. They aren't applying a different law. The OFT test case is currently ongoing so what loophole are you talking about?
