    • Hi Rei and thanks for the update.   Your post confirms what we're telling folk all the time - Harlands/CRS, Zinc and their pet "solicitors" continue to make demands but they fail to do anything substantial to back up their threats.   Hence our continuing advice to NOT respond to demands by letter, email or phone, because they'll do nothing that will affect your credit rating, or that will force you to pay.  
    • Hi GHL and welcome to CAG   You now have your own thread to use from here on ( to avoid hijacking someone else's thread where you first posted).   I assume there were 2 separate m/ships and not a joint m/ship, but please confirm.   I hope you've read other threads here which should help you understand how Harlands/CRS operate. They use every opportunity to make far more money from missed payments and penalty fees, than what they make from taking a percentage fee from ongoing monthly gym fees.   Yours was a rolling monthly m/ship so you only needed to give them notice to quit but there was no minimum 12 month term. Hence all you owe them is £19.99 each.   Write a letter to Harlands, each of you :- 1. Offering to pay the £19.99 for the notice period you failed to give 2. Offer valid for 14 days only. 3. Offer withdrawn if they fail to accept, or if they demand any higher amount.   Post a draft of your letter here first so we can check it.    Letter(s) should be sent from the PO and get a free Certificate of Posting from the PO Counter.  
    • King I fully understand the mother was living there on her own and only one named on the tenancy agreement.   As for your comment that after informed of the passing in a few days they pack tenants belongings and store them and change the locks this I completely disagree with.   In my are the different HA (and there are many) in a scenario like this will:   Communicate with the executor/family member once informed of bereavement informing them of any succession rights, property to be handed back ( 28 days on being informed of above) if unable to must notify the HA to ask for an extension.   After the 28 days if no contact the HA will then follow its Abandonment Policy.   If contact made after 28 days and no extension has been granted HA will then go to court to claim property back.   Once this is done and no contact off to court to claim property back only then will the enter the property unless in an emergency or legally required i.e. gas safety inspection even then may need to go to court for that to get access.

I sent a CCA request to that address on 17th March and it was signed for on the 18th.

 

Not that I have heard anything from them yet!

It took them more than a year to reply to me and even then all i got was a standard fob off.

I have had 3 letters not signed for but I do know that they bulk sign. I also know that Royal Mail will deliver RD post without asking for a signature

Hi all has anyone else had problems with CITI cards not sihning for recorded delivery at the PO Box 49920 address as it could be the reason nobody hears from CITI just had a conversation with Post Office as I have sent 3 recorded and none signed for the Post Office say a lot of them will not take recorded delivery.

 

As we have reported many times-you should not use the PO address.

It needs to be their registered address.

Sorry I do not post a lot on here, too much time trying to digest the information.

Anyway the latest development to this saga.

I received a letter on Fri 24/9/2010 from Cabot stating that they have bought my account from CitiBank. Here it is.

I would have thought it strange that Cabot would buy something that can’t be enforced by them, with reference to the following letter received from CitiBank on or around 30/06/2009.

Should I ask Cabot to supply me with my CCA which they will think they can obtain from CitiBank?

 

They are charging me 12% interest per annum, are they legally allowed to do this?

 

In another section this gives me some reason to have alarm bells.

Send Hello letter from Cabots = often we'll see these in same envelope depends on which member of staff deals with it - but post mark on envelope is usually the give away. You'll see where they add the interest commented on the screens diary. (on the sale document is where the interest amount is usually written - I found it was 12% on the document I had they forgot to blank it out)

 

they'll sit on the account for years till year 5 allowing it to accumulate interest till they ready to collect - the diary pages are updated monthly showing how the balance rises with the added interest. You'll see loads of telephonecalls made by their messaging services - where their automated dialler calls to annoy you. They will do this until they ready to try collect debt. THEN

 

DAY XX/XX/XXXX - DO LAND REGISTRY SEARCH TO ASSESS - this way they see whether it is worth taking person to court, going for a charging order cause they can more or less guess whether there is equity in the property and whether person is renting or buying property. Land Registry will show loans with dates already charged to a property = a useful tool in assessing when last loan was taken out and who with (they'll see whether subprime lenders/high st banks etc.., when loan was taken out etc.. ) so it's a pretty useful tool for them to use? They can pretty much cherry pick the people they think have the money to pay them by looking and guessing the equity available in a home.

 

DAY XX/XX/XXXX - Send prelim letter asking for money. Using their solicitors letter headed paper (It used to be Hodsons - but more recently its Morgans acting as their in house solicitors)

 

DAY XX/XX/XXXX - Send lba letter threatening court action.

 

And then they'll file an online court claim.

Am I right to be worried?

Do not send a CCA request to Cabot. That's as much as saying it's ok for them to chase you.

 

Citi are trying to circumvent their responsibilities to supply the CCA

 

While no agreement has been supplied, the account is in dispute and they can't flog it until the complaint is resolved.

 

Send the "bemused" letter to Cabot and report Citi to Trading Standards and the OFT

 

You could raise a formal complaint with Citi but they will wriggle out of it (if they can)

As with all these things, it's up to you as to what course of action you take.

 

They would have to have a fully compliant executed agreement to seek an enforcement order -- so if action was to happen you would file a CPR 31.16 request to view the original executed agreement.

 

As far as I know Citi is not providing these (or copies of them to any parties), either their customers or third parties such as DCAs that purchase accounts.


Advice offered by ENRON is without prejudice and is for your judgement as to whether to take it. You should seek the assistance or hire of a solicitor or other paid professional if in doubt.

I take it SF1961, the bemused letter you are refering to is the one I have just posted Ref Code: DPA.

A quick reply to update this thread, after looking at my credit file in Noddle (thanks to dx100uk).

June 2009, Citi wrote to me stating that "We are under no obligation to comply with a request for a copy of your agreement under the Consumer Credit Act as we no longer have a contractual relationship with you, nor are we seeking to enforce any agreement against you. Your right to be provided with this information from CitiFinancial ended with the closure of your account.

I am returning the £1 you have sent in relation to this request".

Sept 2009, Cabot bought this debt from Citi. They have listed the account in default since Sept 2010. Further monies have been added charges/interest I presume of £1500 from Sept 2010 until March 2012 where it has remained static since then.

Can Cabot still list this as a default on my credit file, when Citi have closed the account and want nothing more to do with me? Can I get this reference removed?

Did you ever get a notice of assignment allets?

 

If Cabot bought the debt, they can update the CRA's accordingly.

Yes Cabot can continue the default entries as the "beneficial owner" of the debt.

 

 

If there is no CCA available or a " reconstituted" agreement which does not full comply has been supplied

the no court action can be started.

 

 

You say here Cabot bought the debt in 2009, yet have " listed" it as a default from 2010?

 

 

Do you mean the default date stated on file is 2010, this could be totally wrong as Citi would have defaulted the account prior to selling it to Cabot.

The last communication with Citi was when I wrote to them, this was May 2009. Last letter received from Citi to me was March 2010.

I don't have a debt with Citi on my CRA (Noddle.co.uk). Last payment made to Citi was back in March 2009.

 

 

I wrote to Cabot at the of end Sept 2010, stating that Citi had not provided me with my CCA and they had no right in selling the debt to Cabot.

 

 

Cabot wrote back to me in Oct 2010, with the following:

 

"I understand that you previously made a request to CitiFinancial (CF) for a copy of your credit agreement in accordance with section 78 of the Consumer Credit Act 1974 (CCA). However you received a response, which stated that you no longer had the right to request this documentation".

 

 

"In light of the comments in your letter, and the documents enclosed, we have contacted CF to obtain clarification on this matter. Whilst we await a response to our enquiries, please be assured that your account shall remain on hold with our Customer Assurance Team".

"I trust I have set out our position clearly".

 

 

This was the last letter received from Cabot. Meanwhile Cabot has increased the debt from around £9,200 in Sept 2010 to £10,700 by March 2012. It has remained at this to the present day looking at my Noddle CRA.

 

 

I have not done a CCA request to Cabot.

Unless the Citi expressly allow for interest nothing should be added.

 

 

I think you should take a look at a "mainstream" CRA, the ones using 2nd hand data are not always reliable.
