This is my 1st thread so apologies if it’s long winded but here goes:

 

I was struggling to meet payments on my credit cards as they kept putting my interest rates up (1 card went up to 36%), I thought I was the only person going through this but then I found you guys!! It was such a relief to know I wasn’t on my own so after reading through various threads and researching CCA etc, I sent out cca requests to all my creditors/DCA’s.

I thought I could manage on my own with the help of the template letters and advice given to others on CAG in the same situation as me, but I now realise I cant and feel out of my depth with some of the reply’s from creditors/DCA’s, I really DONT want to give in now, so I would really appreciate any help/advice that anyone can spare?

 

Story so far:

MBNA (Passed onto Arrow Global)

CCA request sent in Feb, received reply from a company called UK debt and legal acting on behalf of Arrow Global, didn’t acknowledge my request just said that I was disputing the debt and to fill in one of there dispute forms, sent back ACCOUNT IN DISPUTE letter, received reply still not acknowledging any of my letters just saying that I had failed to send back dispute form, sent letter back stating they had failed to acknowledge my request and that the time limits had expired, received reply this time from Arrow Global with the heading Notice of intention to serve statutory demand pursuant to section 268(1)(a) of the insolvency act 1986.? Letter then goes on to say that I have been sent various letters by DCA acting on there behalf (still not acknowledging any of mine) and that my debt is now being dealt with internally?

American Express Ltd

CCA request sent in Feb, received reply enclosing copy of my original signed application form (one of the 60 second one’s) and T&C’s, sent back letter stating application would not suffice and I required signed agreement they then sent back the same as above but this time stating that the application was the agreement, sent back letter stating request remained outstanding, they then sent me a default notice and a few days later sent a letter saying that I would have received my agreement at the time of opening the account and that they had no intention of responding to every point I had raised as it was without substance or merit, they also stated any further correspondence from me will be filed but no response will be sent, I then received a letter from Allied International Credit saying the debt had been passed to them.

 

Any advise as I really don’t know what I should or shouldn’t be doing??

Welcome to the Amex Appreciation Society Heidi! Was the DN followed by a notice of Cancellation or Termination? Can you post up the DN and the alleged 'agreement' so that the more learned of the site can have a look.

 

Don't be too freaked by our mutual friends in Brighton - it's amazing what can be found in the detail.

Not my patch but I know that an MBNA specialist is only a few clicks away.;)

 

Post up docs etc as with Amex will probably help.

 

Might be an idea to launch Amex in a separate thread to save getting tangled up etc.

did you send your letters by registered post.

also you say on your american express one that they sent you a reply a copy of your signed application form then state sent back a letter stating that you stated you required a signed agreement is this the same or am i reading this wrong?:confused:

and does this give u 14 days from the 'date of this notice'? if so it does not give u enough time to remedy the account and is invalid as it should include time for service. the reason smouk asks abt a Termination Notice is that this makes it impossible for them to serve a valid DN once the acc is treminated. this can be in the form of a Termination Notice from the OC or even if AIC has asked for the full amount as this is deemed as termination of the account.

 

have a read here lots of great info on this point from the same OC so worth taking on board.

added: i would SAR MBNA that shud get a response. send everything recd del from now on dont sign anth. it costs £10 (postal order if u can or make ur sig a bit diff on the chq rarely causes a prob for such a sml amt)

 

agree with smouk again, a diff thread for each problem will make it easier all round to keep tabs on things.

Sorry for the delay in replying i didn't think anyone would reply to my thread so quickly!!! thank you so much though i really appreciate your time and help.

 

Had to read up on how to even reply let alone how to scan documents! (im quite an intellect really!!!)

Anyway hope I've scanned the Amex documents correctly?

Thanks for the advice re: send MBNA a SAR ill get on to that as soon as i've read up on how to reply to these threads PROPERLY!!!!!!!!!! thanks for the links too.

Yes i sent all letters recorded delivery every time, when i replied to amex stating application would not suffice and i required a signed agreement they just sent me back another copy of my original application form and said that this was my agreement?

SHG, the thumbnails are a tad small.....try www.photobucket.com set up an account in ur cag name and upload the images...edit them to max size and copy n paste away to ur hearts content..

The DN looks like it is their standard doc. Have a look at these:

Is it mostly the same?

 

It's the "fourteen days from the date of this..." bit that's important. If it says that then it's invalid.

 

No termination yet?

 

Need to see them bigger though!

My DN is exactly the same wording as your one and also it does state:

"fourteen days from the date of this default notice"

I have received a letter from them today advising of £158 charges that they have added to my account (thankyou very much) have never been able to work that one out, if you are struggling to pay them anyway why bother adding more charges!!!!

SHG, have u recvd anth from OC or DCA that refers to u paying back the full amount, not just the arrears?
