Hi all,

I had sent template letters plus the postal orders by recorded delivery for CCA's

and had no response of any of the card companies.

All agreements were circa 1995.

Then sent follow up template letter stating that the debt is not recognised and please acknowledge etc.


Lowell, say they are unable to retrieve, Marbles the same however sent current terms and conditions, MBNA say they have not received the letters and that they will pass the debt to a recovery agent this month.


MBNA say, over the phone , that they do not agree the debt is in dispute, despite the letters being sent and recorded?


What happens next ? do I take further action or do I allow them to continue with their demands for payment and accept that they will pass the debt on to a third party? :?

Hi Battler, as the debts are from 1995 the chances of an enforcable CCA is very unlikely, as for MBNA they are throwing the toys out of the pram and if they pass it to a third party then you can inform them. No Valid CCA = debt unenforcable.

Sorry, that should read 2005! i'm in a time warp,

however thanks for the reply.

Still no answers off any of the card companies though,

Perhaps they can not find the agreements, we'll see.
