      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Firstly what a cracking site, loving it ! Spent hours reading threads !

Sorted out all my old statements going back 6 years, and have highlighted and listed the charges, WOW it mounts up .....

Question I have is : Is it worth going straight to the LBA or am I jumping the gun ? ( KEEN TO GET THIS LOT BACK !) :confused::?: Should I start the ball rolloing with the PRILIM ??

Stick to the sequence of letters as the court will expect you to have made every effort to resolve this and given the bank enough time to respond. 28 days is the norm, hence the two letters with 14 days each, before launching into a court claim.

 

You can't include 8% s69 interest yet - it is specific to your court claim, but you can claim for interest on charges deducted by the bank. You'll need the spreadsheet (complex version) to calculate it.

Hi

 

haved started the prilim letter to find this sentance ...

 

What I require

I calculate that you have taken £XXXXX plus £XXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXXX .

I enclose a schedule of the charges which I am claiming with this letter

 

 

I thought that I should not be including the interest at this stage .....

 

Could someone confirm that I need to remove that sentence >..

I took the date from the day i dated the letter as i posted it recorded delivery the same day.

First Direct Data Protection 5/06/06

SETTLED IN FULL 23/08/06. £4412.30 charges plus 8% interest and court costs .

OH Halifax Data Protection 05/05/06

SETTLED IN FULL 23/08/06 charges plus 8% interest and court costs £738.78

MBNA SSettled in Full before court action.

You can send on the 21st.

They have given you a reply (presumably saying their charges are fair )...

 

The reply to yours shows dialogue is taking place.

The timescales are not rigid where there is clear replies from the other side.

 

Same goes for the lba if they reply say after 10 days saying no then you can start the MC.

 

For cases where there is no response at all then the 28 days is best left to run.

Although there is reference to you claiming interest you should not add it to the schedule at this stage,

send the lba with your schedule/spreadsheet

 

When you file on MC thats the time to calculate the 8%

I only included on my pre lim the basic charges .....

 

ie £39 here £28 there etc etc

 

I did not include the interest debited .....

 

Is this going to be a problem...

NO Written reply as yet, but my wife had a phone call THIS morning started off offering her £250; Then when she said NO upped it to £788 as full and final… she thankfully told them to confirm this in writing so WE could make a decision … let me think about that for a nano second… OK thought about it BRING IT ON !!!

ok am back again..........

 

had to go away on buisness, seem to have lost track of time and need some advise as to completein MCOL;

 

Do I need to start the whole process again ? I did the Prelim & LBA within the timeframe BUT have not filed yet ...

 

They have offered me a settlement not acknoledged that yet ?? is that a problem ??

Oh one other question ...

 

can and should i claim both accounts at once;????

 

I understand that if I did two claims I would have two lots of claims costs... this is not an issue but wanted to see it it was worth splitting them or adding them together ??
