Data Protection SAR - Guidance for handling SAR's

Nice one 42_Man :)

Would be very useful to print that off and send it with highlighted relevant points when they start acting like silly beggars. I like the bit about using the usual address, thats one that comes up a lot. So they can only ask for a signature if there is reasonable doubt about ID? ie after change of address etc?

please notice that there is no exclusion or injunction on the provision of data simply because it is difficult to find or could be described as requiring "disproportionate effort".

 

In fact the information Commissioner's guidelines particularly point out that satisfying an SAR may require a very wide search.

 

I have in mind the post made yesterday by Yourbank about the National Westminster bank archive and apparently about the advice that they have received and appear to be relied upon that they are not required to disclose information in circumstances where it might take some considerable effort.

If the National Westminster bank are truly withholding data because of that reason then they are acting against the law -- in contravention of their statutory obligations under the Data Protection Act
