Aktiv Capital and cap1 application form CCA return

I am being chased by Aktiv Capital for a Cap One debt. I sent letter 1 on 9.1.9. and they replied on 15.1.9 and said they were asking Cap One for the agreement. default letter on 23,2,9 ( no reply) and hen today I received another letter stating that although they purchased the right to recover the outstanding balance they are not the original creditor they do not hold the original documentation.

They enclosed the original application form from Capital One and are now looking for my repayment proposals. The application form is just that and although there is a brief paragraph at the bottom referring to the Consumer Credit Act but it has no reference to amount of payments, frequency of payments, amounts and dates.

How do I proceed now?

Tell them to get lost..they have no legal powers to money off you, only the county court does.

Report them to the OFT & trading standards.

Ire there any template letters for the OFT?

Not that I know of, but Mr. T above did find a very good site called

www.howtocomplain.co.uk Not sure if they have a template for OFT.

 

If not, you can complain on their website, it will say not for individuals but you complete their form anyway.

 

If you wanted to actually write a letter, just outline the case from start to present say you wish to draw this to their attention.
