      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'm in process of claiming charges back from the Halifax and I have been asked to complete the financial hardship form; I'm about to do that. However, I have missed one payment on my Halifax credit card. I called them and told them I would not be able to make the payment, they were so rude! Yesterday, while I was at work, someone from 'Halifax' came to my house. My husband answered the door and said the man looked like a debt collector. He had tattoo's on his knuckles and a shaved head, I'm glad I wasn't there, he sounded scary! He didn't tell my husband anything, but my husband did manage to read on his clip board that it said he wasn't to take any money at the door.

I don't know who he is or when he will be back. I wasn't notified someone would be calling and now my husband and I are rowing as he didn't know I'd missed the payment.

 

Do I have grounds to complain?

I think its difficult to comment without knowing more-theres no proof that it was a debt collector,and debt collectors dont all have shaved heads or tattooed knuckles.

OFT debt collection guidelines require debt collectors to state who they are and the nature of their call...theres also breaches here under 2008 unfair terms regulations.

Will move your post from here-try to give some more info if you can.

You should contact Halifax to see if this was authorised by them and if it was tell them that you will only deal in writing.

If this guy or anyone else calls again to your house-then get some details from them.

Thanks for your help Martin.

I have called Halifax and they tell me that the visit was from a company called 'power2contact'. Apparently they are a specialist customer contact company. Halifax confirmed I had called them twice in April and once in May, and could not tell me the purpose of the visit from 'Power2contact'.

They couldn't say whether they would call again either. Halifax say that the company does not have to contact me prior to their visit, which is a shame as I work all day.

I asked if they were a debt company and they said no, they are a contact company. ??? So I will wait to see if the man returns.

I did add that if they action my claim for a refund of fee's on my current account, It would more than cover the outstanding payment and I could pay up.

They said I had the wrong attitude to debt!

 

BTW, the tatoo's and shaved head - just a coincidence that it fitted my idea of debt collecters, but very intimidating, none the less!

Try to get everything in writing also, at least you will have a paper trail of evidence if ever needed, unless you are able to record your phone calls?:grin:

I recieved letters from Power2contact this was at a time that my barclaycard debt was passed onto Credit Solutions Limted, so I was under the impression that Power2contact was another branch for CSL, I never had anyone visit me at home though... Myabe Haliax have passed your debt on to a DCA, I know they have an inhouse DCA called Blair Oliver & Scott, though not sure how Power2Contact would link in with them...

BTW, one thing I do remeber is the telephone number for power2contact and CSL was the same!! Also, it seems pretty shocking that Halifax would send out an agent after just one missed payment... so any chance it could have something to do with another debt...?

ISIS invested £4.5 million as part of an £11m MBO in 2005. Credit Solutions plans to grow organically and by combining with power2contact to offer improved services. It also plans to develop in the debt purchase market.

 

 

 

 

Regardless of whether you contacted them in the past,its up to you to decide if you want these at your door or not.

I would fire off a strongly worded letter to the Halifax and tell them you consider this action to be deceptive practices which are in breach of OFT 2007 guidelines.

Power2Contact have been around for a while, there have been other posts about them on this forum. They are a tracing agency and try to link people to debts when they have moved several times. They are not above contacting neighbours to fish for info about you either.

Credit Solutions are members of the CSA and so have a code of conduct to uphold.

Breaches of codes of conduct fall within the 2008 unfair regs.

Wow thanks every one. I do only owe them one month but I cancelled the direct debit as I didn't want charges. They wrote to me even before the payment was late. I am reclaiming charges so maybe it's a bit of tit for tat.

Thanks for the letter template, that will be in the post first thing this morning.

I'm reading all the legal stuff but it makes my head spin a bit, so I'll send the letter and come back for more advice if I need it.

I'm so glad I found you guys, I've been worried sick about bailiffs and all sorts. All because I owe £233!!!!

"maybe it's a bit of tit for tat."......if thats the case and there is evidence of this then they can be made to pay you compensation....Quite a few Caggers have had this, varying from £50 to £350.

 

Dont worry about Baliffs either-only a Court order would allow them anywhere near your door-and with the issues that you have-theres no chance of that happening.

 

Remember to keep a copy of your letter and send it recorded delivery.

And since you may have other business later...I would advise against signing anything.

P2C are well known - not just here, but by Trading standards too. If they do ANYTHING wrong, report them. This company is being investigated and the more complaints we make the deeper in it they'll be.

 

William Hugh Pierce is one of the owners of this company - perhaps write a letter of complaint to him - ultimately, he is directly responsible for the actions of his employees.
