    • Thanks I just had a quick look.  Will study over the w/e My friend does have kids. But it's a really dysfunctional family.  They don't talk.   Many years ago he sold 2 property assets and gave them a lot of money (enough to buy homes w/o loans) .  They've done nothing for him in the last 2 decades. And he altered his will so his new partner gets everything; the kids nothing (more). The 1st form I glanced at - to be deputy - asks for family details.   If I give his kids details I suspect the authorities may say they should get the deputy job instead?  Then  they will steal the money and give nothing to his partner. I can get a copy of the medical assessment  - and get it translated.  If need be.   This has all happened very quickly.  He got sick. And that must have kick-started dementia.   He was fine to hold a detailed conversation 6months ago; now he cant
    • Hi I think the only way around this as he lacks capacity is someone is going to have to apply to be a deputies via the Courts as he has assets here in the UK and a UK Bank Account which will take time and there will possible be Court Fees to make the application. Also if the Lack of Capacity (Dementia) was diagnosed abroad the person applying for deputies will need that diagnosis and it will need to be translated legally for the UK Courts so possibly cost for this as well. Also for reference although you were assisting them before the lack of capacity and had authority to act on there behalf that no longer stands due to there diagnosis of Dementia therefore Lack of Capacity so you no longer have any authority legally to act on there behalf unless the below is actioned or someone has Power of Attorney for that individual (which was setup before the Lack of Capacity) Have a wee look at these links: https://www.gov.uk/become-deputy https://www.lawsociety.org.uk/topics/private-client/mental-capacity-international-aspects#:~:text=You might need to make,act within the foreign jurisdiction https://www.gov.uk/government/organisations/office-of-the-public-guardian I have got to ask with the Dementia diagnoses are you 100% sure the diagnosis states they Lack Capacity as not everyone that gets a Dementia diagnoses may lack capacity initially. Now the Office of the Public Guardian link above you could also consider giving them a call just to give them a brief on this situation and get there advice on what documents etc are needed for deputies to be appointed as the person with Lack of Capacity is abroad.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Today i was enquiring about an old bank account i had with Lloyd TSB which hasnt been touched since September 2002 i was told...

After lots of digging deep/searching systems & phoning around here,there & everywhere...it was eventually discovered that it has been shut down & sold off to 1st Crud with a minus £800 balance on it :eek: (which will all have been illegal bank charges ;))

Anyway - the branch gave me all the ref numbers etc...i contacted 1st Credit (was only too keen to :p)

Whats the 1st thing they ask? - do i want to make payment/come to an arrangement etc...tut tut

They also claim its not stat barred coz i acknowledged the debt in 2006...tut tut

Well i have to feel some sympathy for the supervisor who spoke to me, not the threat monkey who answered as i was getting nowhere with him :rolleyes:....but his boss...the poor bloke got a right old lecture on consumer law :D

Anyway...nice to see that 1st Crud have changed their ways in light of their recent OFT spanking.

I can feel another complaint heading their way soon :)

Mr Ton you will probably start receiving the usual Reigate Rubbish, quickly followed by a letter from their pretend solicitors LCS followed up by a made up SD from the CONnaught Rangers.

 

The threat monkey's organ grinder will probably think you will fall for their threats.

I'm not sure they have learned anything. Yesterday I rang them to ask why they kept leaving messages for me (I'm acting as an auth rep for someone else) when:

 

a. They had clearly been told that everything was to be in writing

b. They are in default of a s.78(1) request

c. There is an outstanding complaint of non-compliant behaviour against them

d. The debt is disputed

 

Monkey no.1 started off confidently enough, but then got to the 'oh, there's a note here - I need to transfer you to someone else'. Monkey 2 didn't know here arse from here elbow, but gamely tried to suggest that she didn't understand why they were in default of the s78(1) request, because they'd sent an edited copy.

 

I pointed out that the law was clear about the documents that had to be supplied, and that they hadn't done it. I mentioned that they'd demanded confirmation of the signature, which could only mean they weren't certain of their victim's identity - in which case all their earlier threatograms were confirmation that they'd breached the OFT Guidance. She started sounding concerned at this point, and then said she'd just noticed that the Compliance Dept were actually dealing with the complaint.

 

I asked why the messages had been left; she said she wasn't sure, and there must have been an error. Actually, quite a few errors, because there are seven messages and only two mention me - the others demand that my client contacts them. I told her that all the calls were recorded and that I was in the process of forwarding them to the OFT, because I understood that 1st Credit were under sanction, and that one of the reasons was that they bypassed auth reps. 'Have you actually been in touch with the OFT?' she said. I answered affirmatively, and she then said that it would probably be best if she left it to Compliance to deal with the matter. 'That'll be xxx xxxxxxxx then', I asked. Apparently not him personally, so I asked if it was xxxx. This appeared to shock the monkey, but I'd clearly hit the target - she said she couldn't confirm the name, but she was clearly wondering how I'd found out. (Hint: 1st Credit's staff PERSEC is crap and easily penetrated).

 

Anyway, we left it at that, and I'm looking forward to their next missive, especially as they've already admitted in writing that they were not compliant and apologised - before doing it all again!

They actually said you acknowledged it in 2006 ??? Did you record the call Mr T ?

 

I was in a Lloyds branch when i phoned them..so didnt record it sorry.

 

They said i spoke to them on the phone about the debt in 2006 (which i did, but said i couldnt recall :p)...therefore the stat barred rule doesnt apply & the 6 year rule started all over again from that moment onwards :rolleyes:

The guy was talking rollicks coz towards the end of the conversation he acknowledged that is was stat barred & they could not enforce it.

They confuse themselves in their own incompetence....

 

Anyway...i appreciate what you said ODC about starting the whole thing up again & receiving mail etc....but they wont get anywhere with me of all people ;)

The original purpose of all my enquiring about the account was to find out if it still exisited/if there was any balance on it etc....(doormant account enquiry that type of thing)

It took alot of searching through Lloyds systems & many phone calls all over the show to finally find out that 1st Crud had it.

The first thing i was asked is "do i want to make payment" & "i have to set up an agreement on this account" - they seem to be programmed to just zoom in on trying to get the money asap, instead of discussing the specifics of the account etc..

What rogues they are :mad:

Anyway..i was only too willing to give them ALL my contact details including phone number.

The fools wont know what day it is now anyway, now that they have someone actually begging them to be harrassed & i prob wont hear anything from them...the DCA's like to think they have the initiative when it comes to all that, not the other way round. :D
