      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys about 13 years ago when i was a student Lloydstsb give me loan with out giving me the 14 days period to think about it. I ended up in defaults and had to deal with this company call BLS who then sold me on to Apex Credit Management. I am at the moment paying £15 pounds each moment , this has gone on for years now

 

 

my question is can I write off this debt as it was taken out before April 2007

 

 

I need to know how I can write this off.

The OFT have warned about these companies making false claims. You can ask them to write it off but the chances of them doing it are slim. Your best bet is to ask for a copy of the agreement and negotiate smaller payments if it is enforceable or not pay them anything further if they have no agreement.

Scroll down to letter "N". Enclose a postal order for £1, send by recorded delivery so they have proof they received it and print, don't sign, your name on the letter. They have 12 (+ 2 for admin) working days to produce a copy of the agreement and if they cannot produce it in that time, you can put the account into dispute. Once you get it post it on here and we will tell you whether it is legally enforceable or not.

Apex Credit Management , have reply back stating they want to get paid and if i don't paid I shall go to the court , what shall I do ?

 

I sent a letter back stating that i have sent a letter N and they have accepted the one pounds cheque.

 

 

need advice ?

Do Apex definately own the Debt?

 

BLS are a side arm of Lloyds and Apex are one of their pet DCAs just because Apex are writing to you doesn't mean they own it

If you can keep you head when all of those around you are losing theirs try parking your helicopter somewhere else

They have to send you a copy of the agreement - that's the law and they know it. I see increasing signs of these firms getting desperate for money. If you do not receive a copy of the agreement in the required time you can put the account in dispute and complain formally to Apex's complaints deprtment that they are pursuing you for payment when the account is in dispute, with a copy to the OFT who are gearing up to jump on these cowboys. There are templates to help you. In the meantime you can ignore them. They cannot take you to court without an agreement and they are all wind.

Hi guys its now been well over 3 weeks and all I am getting from Apex Credit Management Ltd is letters stating to pay or face court action and its my final opportunity to sort this out , hence the same letter has been sent for the forth time.

 

I have already sent the Failiure to provide a copy of the agreement within the prescribed timescale. letter and am resending the second one today

 

what shall I do now they still haven't reply back to me about this letter.,

O my god someone please help me I just received a letter today from Aplex Credit Managment

 

This is what they states

Outstanding Balance £16K

Concerning your letter dated 31st May 2009 the contents of which have been noted.

We have closed the above account and returned it back to our clients to continue investigating your dispute.

Please ensure all future contract is made direct to Lloyds TSB to the address below.

Okay guys I am happy and shock , happy i don’t have to deal with Aplex but why am I having to deal with the god dam fraud operation when I haven’t done any fraud.

 

Guys what do I do now can I get all my money back from Aplex that I paid so hardly month by month

Often cutting on food just to meet their dead line ??

 

How can i get this to be wrriten off , what are the next steps

 

 

 

Please , please remember with out you guys advicing me , I would have not in a million years got this far so a big thank you , for once my kids can have some extra food on the table , it really means a lot by not paying 15 pounds a month to them.

yep thats why they do that

all it is is a fancy collections dept with eveyone in the same place so the names are amalgamated, it don't mean its gone to the fraud people, just the bloke that changes hats and desk to be called by a diff title.

 

as mr.ton says

Okay guy's I am now in postion to write to Apex and ask for a full refund of money and interest / stress that i had to bare , are there any templates for this step , I had a look at the above two links and nothing seem to fit my bill

 

any ideas

I dont think there is a template on here yet for demanding money be repaid, perhaps someone can produce 1 & put it on here?

I seem to have been the instigator of the idea in the 1st place, not many folk thought twice that you could demand refunds off DCA's :D
