:)Hi all

 

I am new to this site and looking for help! I was approached by a 3rd Party Company asking me if they could help with unenforceable CCA, I agreed! I did not pay any monies upfront but sent off some paperwork with my CCA etc. The called me and advised that the two CCA that I had sent them would be worthy of a claim to wrie off my credit cards. They then advised me that it would cost me approx £850.00, which I thought was a bit excessive! I was not willing to pay this amount of money so search the web and came across you guy's.

 

So what I am looking for is help and guidance to see if I can claim/write off my 2 credit cards. I have a total of 4 and would love it it I could get a claim for all of them but I think 1 step at a time.

 

Any help would be greatly appreciated!

You could up-load our agreement here after removing any identifiable information, £850.00 seems steep what happens if they cant get the debt written off.

Thanks for the reply, apologies for being a little dim but not sure what you mean by 'up-load our agreement here after removing any identifiable information' Do you mean the CCA's?

 

It was on a no win no fee basis but they required the monies upfront before proceedings!

 

I think I may have to re-submit my post as I have added a new thread to an existing one. Whoops!

Took me a little while to work it out to up-load, all you need to do is scan the documents, remove/edit out all personal information, such as name address, account No, really anything which might identify you.

To up-load I would use photo-bucket, just do a search there is no charges for using it.

You don't need to pay someone £850.00!! You can do it all yourself for a fraction of the cost. The first thing you need to do is send a CCA request to each of your creditors. Once you receive the "agreements' you can post them on here and you will get all the help and advice you need regarding their enforceability. Send the following letter recorded delivery. Enclose a £1 postal order and PRINT do not sign your name on the letter.

 

They have 12 + 2 working days to respond to your request.

 

This letter is a formal request pursuant to s.77/78 of the Consumer Credit Act 1974. I require you to provide me with a true copy of the credit agreement relating to the above account, together with any other documentation the Act requires you to provide.

 

I expect you to comply fully and properly with this request, within the statutory time limit. You are reminded that should you fail to comply with my request, the provisions of s.77 will apply.

 

If it is your view that you are not the creditor, s.175 of the CCA 1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189. If you contend that you purchased the rights but not the duties of any agreement, you are reminded that s.189 of the Act is clear that an assignment is of both rights and duties.

 

Your attention is drawn to ss.5(2), 3(b),6 and 7 of the Consumer Protection from Unfair Trading Regulations 2008 (CPUTR).

 

I enclose a postal order in the sum of £1.00, which is the statutory fee. Note that these funds are not to be used for any other purpose.

 

If you are unable to comply fully and properly with this request, you should confirm this in writing at the earliest opportunity, and certainly within the statutory time limit for compliance, and return the fee.

 

We look forward to hearing from you.

It is highly unlikely that you will be able to write off the debt. However, if an agreement is unenforceable, then you can stop making payments as the account will be in dispute. They can take no action (i.e Defaults, CCJ's etc) but it won't stop them trying - but again, CAG can help you at every stage - and best of all its FREE :)

Andy, you have to send a CCA request to the Original Creditor or DCA you need to enclose a £1.00 postal order, Print do not sign your name.
