      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello everyone...

I've heard about this quite a bit ago but have yet to get around to starting the process. I'm going to start today as I believe that over the last so many years (even within the six that you can legally claim for) I've paid over £1000 in charges, some weeks paying triple charges whilst others paying the standard £30 which is still extortionate! Anyhow, if anyone can help then let me know and i'll also keepp the forum informed of my proceedings and any developments/advice that I come across.

Hi - take a bit of time to read up first to make sure that you have the facts before going too far ahead. Read the FAQs and template letters then have a good read around here to see how others are getting on. Keep any progress on your own claim or questions that arise in a new thread in the forums for your banks to make it easier for others to follow and advise you. Can i just jump in here and let you know that unless yu are reclaiming interest caused by you going overdrawn due to their charges you do not include this until you file a small claim, I am talking about the 8% interest, which you may see on thE spreadsheets, this isnt added until you file a small claim.

Apologies if I have persumed that you didnt know this, just wouldnt like to see you making a mistake!!

So just to make myself clear...

you dont add the 8% until filing a small claim

 

interest they have charged you for going overdranw SOLEY due to their bank charges can be included on the schedule of charges at this stage

Hello...just let me get this right then! (thanks for the reply by the way!!!) Scenario...My overdraft = £100, I make a transaction that sends me over that, and then say another two transactions that further send me overdrawn. This means for that monthly period I pay say £20 three times (the max amount of times they can charge you for any one month). Now what I fill in the spreadsheet for is to work out how much interest I have paid for them charging me this amount and therefore sending me further overdrawn? Is this right? It seems to me that the info is telling me to send the spreadsheet with this letter? Even the letter has a section on it with an 'interest' part to be entered?

You use the complex sheet to work out the charges and the interest on charges. I'll post a bit more soon.

You enter your charges in order down the left side of the sheet, and all the required information for the interest debited down the right side, in order with no gaps (it doesn't have to line up with the charges for a bank account - the credit card sheet is different).

This will work out your court (s69, 8%) interest for you. You don't do anything with this at the moment. You do have the option of claiming interest on your missing money at contractual rates, in which case you look up the rate that the bank charges you for unauthorised overdrafts and use that as the rate in place of the 8%. In this case you have to include it in the value of your claim from the beginning instead of waiting until Moneyclaim.

Sorry...what do I type in on the preliminary letter where it asks for an interest amount? I'd say the interest calculated but from where? The simple or the advanced??? And also, do I send this to the bank along with the letter?

The interest in the prelim is the interest that you paid on charges (from the advanced sheet). It can also (optionally) include contractual interest on the amounts claimed. It shouldn't include s69 interest as this is (optionally) awarded by the judge if it gets to Moneyclaim.
