Looking at the document there is no evidence to suggest that a 0-10 point system is used. It is more likely that things are scored out of 5 or even 3.

 

1 = No

2 = Maybe

3 = Yes

 

A scale from 1 to 10 would be impossible to score accurately don't you think?

Well this comes from the Google translator version of the 2nd link given.

Not a suprise really, other companies use a points system (Marlin for one) to assess the likelyhood of success in taking legal action.

 

Probably a bit of a blunt tool but mabey better than going eeni meeni.....

 

Downfall of all scoring systems is that it's only as good as the info given.

 

In DL & ACS cases if you deny it flat and tell them to burger orf they don't have a lot to go on. A flat denial will only indicate that you are no pushover and would probably defend. OK the points system might well say forget it but would only tell them what they already know ie, if someone defends, the action will fail.

 

Not exactly rocket science.

I wonder how many of these 30000 new claims will be 'new people'. I wouldn't be surprised if many of them will be a further claim to people who have maybe already paid up or have given no response to the first claim.....?????Maybe we should prepare ourselves for a second or more claim. As far as the ISP's are concerned I think a mass switch should happen to kick these people in the teeth, as it seems they put up no fight for their customers in Court, nor do they have the decency to write to ALL their customers who's details have been handed over. The ISP's have the money and lawyers to fight these ridiculous claims, they should be our first target I say - switch to a different ISP as soon as possible, that's my answer to BT.:mad:

I too received a letter being accused of copyright infringement and like you all was freaked by it. At first i disregarded it as i thought it was a [problem]. When i got a 'part 36' I have since went to my local mp who has been absolutely fantastic. He has written to acs law and the law society for england alerting them to this unjust action. If you are in a trade union they sometimes allow you to have a free 1/2 hour advice from a solicitor. I since then, i have heard nothing from them so everday i keep my fingers crossed that i do not hear from them again. Try not to panic, but do advise that you are pro-active in preserving your innocence. I also wrote to the WHICH magazing and they too have asked me to take part in a campaign to highlight this attrocity that people are being subjected to. Good luck to you all.

according to another forum total 30000 breakdown 25000 of BT and 5000 of kingston communications. i suppose in next round target will be the customers of these companies.

out of that he dont care. Even if he can scare 10 % (of people threatened) it bring millions for him and his fellow crooks

i agree its nothing to do with copyright protection of their client but

more to do with making easy money by frightening many innocent people. its

sort of black mail.

In addition, technology exists that can hide or "spoof" an IP address.

that should fund them for a few years to come! Could the government mess it up any more? Make mr crossley a lord thats what i say :p

 

The law is so stupid forget killers or worse and go for copyright infringer/alledged they are the **** of the universe once there all broke or banged up the world will be wonderful :)

Probably need a new photo copier....

 

Took some time to write to my MP tonight especialy when relating to madlesons new proposals as legal scams ( or is that too strong a term ? ) like this will pop up all over soon and proposals such as his ( and imho on the whole correct bar the disconnect thing ) will be getting a massive public back lash.... no doubt starting with the jan 15k....

Hi can i ask for a list of all ISP who have rolled over and given our IDs out to this ACS-law so i can avoid to re-new my contract with all spineless ISP. Tiscali/Talk-Talk, BT, Virgin, are the few i have on my list of avoidables, can any m8s add to this please? and i would also like to invite all CAGs to add to my campaign im sick of reading about us having to fight our own little corner, if one ISP took action against ACS this would come to a end as quick as it started BUT they havent, if they lose 30.000 customers they have lost lots of £££££££££. The only ISP what i havent hurd of rolling over is AOL is this true? THANKS.

When i win the lottery the 1st thing i will do is chase ACS Law and hit them hard. who the hell can fight them with a solicitors letter starting at £250!!

 

I thought carphone warehouse was gonna fight the NPO's.
