    • Hi LFI, With regard to the ANPR cameras in your post #65, while I was on the phone to the Planning Department, they did take a look at Google Streetview and went back to 2012 where they could see the ANPR cameras in place so therefore they would have deemed consent. I had previously read the T&C Planning Regulations and had read the section on deemed consent so I understood the point they made on the phone. It doesn't matter though, that doesn't harm my case any, and I shouldn't really mention this now, (this is what you reminded me of on another thread) but in the past I was a member of a scheme that gave me access to legal advice, I have spoken to a barrister previously through this scheme on another matter and I think I am still a member. I am going to check if I am still a member of the scheme, and if I am I will discuss my case with a barrister or solicitor, whichever the scheme deems appropriate. I will let you know the outcome. I am also going to take Bankfodders advice in the sticky and go to the local court and ask if I can sit in on a case in the Judges office.
    • deed?  you mean consent order you and her signed? concluding the case as long as you nor she break it's conditions signed upto? dx Yes sorry. they called it a deed at first in court.  Then Judge said she was happy to have it sealed as something else  exact names of orders in message above.     The disease was tested for when his cardiac testing was done immediately after purchase and part of the now sealed case.   However, results were disclosed incorrectly and I only found out  two days ago.   This disease did not form part of my knowledge during the case as I had been informed of a normal result that was not the case.   it is perfect clarity of a genetic disease where as the previous cardiac issue could be congenital until the pup is genetically tested. 
    • Hi, Halifax recently sold a credit card account of mine to Cabot. I am unemployed and have no assets and was thinking of making token £1 payments for 12-18 months in order to drag things out a bit and reduce the chance of Cabot being able to get the correct CCA documents from Halifax if I requested them in future. However, I saw on the pages on this forum about defending county court claims that one of the standard approaches when defending such claims is to say “I had an account with bank X, but I don’t remember the details and so don’t know if I owe this debt…”.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well I received my second letter from ACS:Law today after 4 months of hearing nothing from them. Saying that my case is still live and they do not accept my template letter and I have to pay up within 14days.

 

I am going to write my second LOD stating I standby my 1st LOD and I have nothing more to offer and I will not be communicating with them again. I have spoken to a solicitor and they have advised me that my 1st LOD is valid and they have no real reason not to accept it.

 

Do you think it worth saying I am aware of their recent situation where they were hacked and DPA was breached and if my details are found to be on that list I will be taking action against them?

 

Personally, I wouldn't go baiting them unnessecarily. I'd save that until they actually pursue you further. You don't want to get caught out making an erroneous statement. So short sweet and to the point.

Well, well, well, ACS's Terence Tsang seems to have left his new job with Cramer Pelmont after only six months. Looks like Cramer Pelmont are not going to go down the ACS path.

I see that ACS have got rid of the snow capped mountain scene on their website www.acs-law.co.uk and replaced it with some silver wave or something, quite weird.

I sent off my 2nd LOD yesterday and I mentioned that I was aware of the data loss and that if my details are compromised I will seek legal action against them.

 

Looking forward to hear what they have to say.

I received my GEIL letter today - it was posted on the 4th.

 

I moved out of my previous address (and changed ISP's in late September)

 

Should I inform GEIL of my change of address & send them a denial or do I stay quiet?

i recieved a letter from acs this morning saying that their 'client' is dropping the charges and no further action will be taken, i should bloody think so too!

That's good to hear, what a relief for you!

 

It made me think though, as you're one of the unfortunate ones who had their details leaked, I wonder if Crossley is dropping the cases of all those whose details were leaked?

 

Has anyone else who was affected by the leaks had their case dropped yet?

Perhaps the tears of the ACS people is making the letters wet, causing delays in sending them.

And so it all begins again............Rev up the stress levels...........why have I not recieved a letter telling me that they were dropping the allogations against me ???......just more fuel for the fire. AC is obviously not going to stop until is is made to do so. Until then he is just trying to make peoples lives as miserable as his.

Great News !!

Got a letter today from GM saying in light of the info I have provided, they can confirm that they have closed their file on me.

I sent two LODs to them,the 1st was the template from on here and the 2nd was in my own words.

They also said "Due to the extent of this campaign, our phone lines have been very busy. We apologise if this caused you any inconvenience or distress"

"We would recommend that you ensure your internet connection is always secure in order to avoid any future unknown unlawful file sharing activity"

 

Hopefully this is the 1st sign of them backing down on the back of the ACS Law fiasco !!

Hope you all get a similar letter soon.

At last I can stop worrying about this !!

Dear All...with regards to my first posting...I can totally understand that as a first poster that many people maybe suspicious. I have recieved letters from both ACS and GM - Evacuate the dance floor & MOS 80's nonsense. I found this site and became an avid reader. The information that all have given has been very informative and very helpful. I normally haunt the and post on the Slyck site. All I was trying to put across - however badly it appears - Is that a tactic of AC is to release letters to people saying that they are no longer interested in them. This will of course start other people wondering why it is that someone's case has been dropped but not theirs'. As I said just another tactic to stir up doubt in people and maybe panic them into paying up. I apologise if I have offended anyone in anyway.

i think my case was probably dropped because on the day i was being accused of downloading/uploading i was actually attending my mothers funeral some 350 miles away after a two year battle with cancer.

 

Very sorry to hear of your loss nicky and glad to hear this burden has been lifted. I don't suppose they gave any explanation in their last letter as to how, despite your circumstances, they could still so confidently accuse you? Out of interest was your router on or off whilst you were away? The whole hacking/spoofing thing surely must be addressed by isp's. Was at my folks the other day and my phone picked up no less than five unsecured connections!

the letter i sent was my first LOD. My commie was hacked repeatidly this year. i used to play world of warcraft and they hacked my account three times and managed to get passwords and all sorts. they even recently reinstated my dormant account and my friend phoned me and said 'hey im following you round while you mine!" anyway i can only conclude it was to do with this, i still recieve dodgy emails daily on the mail address i use for wow asking me to follow this link to confirm my acc etc so its still unresolved. I'm begining to realise how easy your whole life can be accessed via the internet and its quite frightening.
