He also speaks wisdom in a tastfully mixed blend of Afro American accent overlaid with 1990s oxford English and manipulates and confounds the small, snaggle toothed feeble minded and feeble bodied pasty white folk in the court with ease ... and of course has all the women swooning at his feet at the slightest glimpse of his braod chest with its well trimmed hair let alone any of the other weapons he packs ... and they say I rewrite history   Mind you, it proves my point that slavery is a myth - we never enslaved them, quite the opposite - us white folk have only recently started to gain our freedom after hundreds of years of their manipulation and rule across the courts of Europe and we need to work hard to ensure that liberation of us poor etonians isnt quashed. We better renew the Telly Tax err licence fee to make sure theres more. Should we make them compulsory history viewing in schools? What do you think Dom ... err Dom, where are you?     • We sent this to the ombudsman citing their own guidance for business -   I can state that following discussion with Miss X we do not agree with the outcome.   The FoS guide for business contains the below and we would like this considered in relation to our complaint, specifically the sections 'we've been told by some trade guides that generally cars are selling at or close to advertised prices' and 'Adverts may be helpful... if they strongly indicate that the guides could be wrong'.     We are informed by persons within the motor trade that the impact of the pandemic on the industry has resulted in an increase in demand in the second-hand car market and has meant cars are indeed selling for close to advertised prices. I would therefore argue the trade guides are not aligned with the current and fast changing economic situation and are not a reliable source to gauge fair market value. Further, E-sure failed to consider evidence from advertisements despite our request and your clear advice to do so.

      Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
      So I issued the claim on day 15 and they requested more time to respond.
      They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.
       
      I opted for mediation, and it played out very similarly to other people's experiences.
       
      In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them. 
       
      In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.
       
      In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.
       
      To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.
       
      So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

AAww..boo hoo..just posting what has already been posted on other sites now, but fair enough, don't want to get CAG into trouble. The emails are hilarious though, foul mouthed emails from Andrew to his ex-wife is amusing..oh dear Mr Crossley, you really are a horrid piece of work arn't you.

 

I think this is going to get ACS into a whole heap of trouble :)

Everything they have on you i would imagine but it really isnt anyrhing more than anyone who was determined to get info on you could get on you unless you have card or bank details with them. That being said in theory they should not keep such information on record anyway, escecially so without telling you on a web-site that is clearly unsecure. If they have i would find tthat a bit naughty IMO.

 

 

Well..it appears that all ACS emails are out there as are a big batch of faxes, not sure about other information though, except the BSkyB list.

 

The collection includes the incoming and outgoing emails of Andrew Crossley and his employees, complete with attachments, and contains masses of information about how ACS:Law goes about its business and how much money it makes, plus embarrassing personal details.

The leak reveals Crossley discussing how he might buy a Ferrari (he decides on a less impressive Jeep in the end) and talk about how the company can most efficiently track and record the thousands of alleged offenders, with an amusing exchange where he thinks two people can process 200 cases a day and is politely informed by an employee that they would have to work without breaks to achieve this target.

There are abusive emails to his ex-wife, personal contact details, passwords to Paypal and other sites, and it also appears that Crossley is a fan of loopy conspiracy theorist David Icke. Perhaps those inter-dimensional lizards are also guilty of file sharing?

Eerr..Its possible coz I have them, its a large file, its on quite a few torrent sites, but its raw email data so isn't instantly viewable anyway......plus theres a hell of a lotta emails !..Ill let you know when I've opened it.

 

I gather that the BSkyB list was an Excel attachment to one of the emails.

Ouuch !.

 

Viewed the spreasheet, it's quite a serious breach, it lists BSB customers (and a few Easynet and Unknowns), their IP address, the film they were alledged to have downloaded (mostly porn I'm afraid) and then their name and address. If anyone think they maybe on this list they should be warned that this information is now freely available and needs just a little know-how to download and view, of course there are thousands of other emails to/from Andrew and his staff containing all sorts of personal information.

BBC seems to be looking into it,

 

 

Forgot to add Virgin Media are the only ISP to not have given this firm any details, So if your with VM BB and had a letter off this firm then ignore.

Yep...You are correct..and TalkTalk (which I think has been mentioned before in this thread).

Guy's I know this information is like gold dust but I'm going to have to unnaprove some posts here until we can get clarification of the legality of it. The data was obtained illegally and some of which is privileged information between a client and his solicitor. Whilst the site team recognise this information is in the public domain, that data is in a different format and the contents of the emails are not being readily reported yet.

Fair enough and Im not suprised, but Ill point out anything I've posted is from websites that have clearly posted the information in direct form on their sites already (I havnt posted anything from the emails directly), also it is now clear that nothing was hacked, the email backup was actually posted on ACS Law's website, a major cockup on their behalf !

 

It is now reported on so many sites that I find it hard that ACS would be able to do anything about it, even if they wanted.

 

And..yep..gold dust is the right word..it blows apart almost everything ACS have said upto now.

 

The real pity is that there are many thousands of people who have now have the misfortune of having their details known.

 

We shall see what tommorow brings :)

Hahaha! No whitewash there! Really sticking it into acs law - the "criminal attack" defence "doesn't wash". Indeed firms that are subject to resentment like this should be extra careful. Said he could fine "half a million pounds" on about three occasions. One of the biggest breaches ever!!

Hope cmw was watching! These emails demonstrate collusion between the two firms.

AAww..All my juicy stuff has been removed, never mind, I understand why. Without giving too many details, many of the emails will be very embarassing for ACS Law, they discuss their business model, the reasons why they 'drop' cases.

 

Oh yeah...ACS staff are rather poorly paid, but then again they may not be in employment much longer, wouldnt you like to be a fly on the walln in the ACS office today ? :)
