So how can i be guilty of making this SH*TY scooter track availaible from my connection when i had no idea it was been down-loaded from my connection, this is like getting your credit card stolen when you are asleep and saying i should of none in my sleep it was stolen and stoped it. If ACS think they are getting any dosh out of me i would like to say GOOD LOOK i will fight them all the way to the E.U courts if i have to.:x:x

If you claim that youy didnt have this track on your PC and available for download then either, your PC had been hi-jacked, prob unlikely and you'd quite easily notice, your wifi connection had been hi-jacked, more probable or ACS/Digiprotect have cocked up and wrongly identified you, this last one is the most likely.

If you claim that youy didnt have this track on your PC and available for download then either, your PC had been hi-jacked, prob unlikely and you'd quite easily notice, your wifi connection had been hi-jacked, more probable or ACS/Digiprotect have cocked up and wrongly identified you, this last one is the most likely.

..yes.thats quite a viable reason too, in fact there appears no actual reason why an ISP would keep hold of IP addresses anyway or why it would go out of its way to ensure their accuracy. Many ISP's have already voiced displeasure at their new 'policing' role.

 

If it could be proved that this info wasnt accurate then ACS would be in deep do-do :)

I wonder has any one considered do the Regulation of Investigatory Powers Act 2000 in particular Section 1 Unlawful Interception apply to how someone was able to ascertain that files were being uploaded from Private Home Computers without a warrant

 

I dont think that really matters as the monitors are based outside of the uk and are not bound by uk laws. Now if this evidence can be used if it is breaking uk laws is a diffent matter, as they will never be seen in front of a judge, so we may never know.

I dont no what law he is referring to or what country he may be from but i think he is referring to ACS-law, So it looks like ACS are driving the pirates underground and all the people who have been wrongley accused could join pirate bay for revenge.

well, it has been a while since ACS sent the 3rd letter demanding the reduced amount of £350, that one, like all the others was replied to with LOD and since, nothing.

 

I'm wondering what the next move will be. And find it v odd that the last letter demanded the £350 be paid within 21 days blahh blahh blahh but it has been at least 6 weeks, if not more since they sent it!

if they can monitor bittorrent and know the ports why not just block all ports? Pirates will find away to do there thing the ads on tv keep telling us they funded organized crime and this has been going on since cassettes where about. Media industry is the answer stop being greedy and make content affordable. And stop paying stars stupid money

Its not as simple as 'blocking ports', they can only monitor bit torrent traffic not control it.

Virgin Media are trialling yet more software/hardware to "sniff" what you are downloading! It is possible, I believe, to block web addresses easily enough. It is against the DPA and are to be challenged by the ICO over it.

I have not recieved any letter, dont expect to either, but if I did then I would be onto my ISP straight away and cancel my account. Until ISP's feel it in their pocket they will go the easy option route and give peoples details up.

I read on another, US based, site that ACS:Law are also being employed by another supplier of pornography to chase peeps. Will people pay up to avoid being called pervs? Its like being called a Rascist, easy to deny but impossible to prove your not.

I agree with what you say about the media industry being greedy. just look at sue bo's album she only receives 15% of all profit made the rest goes to the record company, yet thats still millions of pounds. If pirates can make copies (normally high quality CD copies) and sell them for a third of the price then surely the record companies can sell them at about half the current price and still make profit if not more profit from the extra sales it would encourage.

Im happy with my Virgin Broadband but if they were to start acting stupidly |id have no hesitation in taking my custom elsewhere.

 

Way back in the mists of time, you'll find that Davenport Lyon accused an innocent elderly couple with no PC guilty of downloading gay porn, this was pretty much the death knell for Davenport Lyons action against downloaders, Atari had been one of their biggest customers but they jumped ship soon after. after the bad publicity that this generated, sooner or later the same thing will happen to ACS.

Speacking off bad publicity, has any whos received a letter from them actually contacted any national newspapers and told them that acs law are targeting innocent people and demanding money from them, just because their ip address was connected to something being downloaded even though they never downloaded or uploaded it for others to download?

lol anyone want to bet that swinton council will not take such letters demanding money lightly? i see a court case coming... swinton council v ACS Law. Am sure it will become well known if ACS law did send swinton council letters demanding payment, and am sure it will highlight the issue ACS Law has at actually proving who is responsible for downloading on 1 specific ip address, e.g the person that owns the ip address or the person that actually downloaded the material.

It was on Radio 2 today, saying music piracy is now rife, i drive a school bus and have been quizzing kids on music downloads etc, and they tell me they can use mobile phones to connect to othere peoples networks and down load music go on face book etc and its all free

yep its called bt openworld or somthing like that. plus similar free access networks through other peoples wifi connection both phones and laptops can access the network through your router or modem if they are within a certain distance. all though your private connection is still secure it still connects via the same ip address i believe, i may be wrong though

This is frightening m8 so this means if you dont like one of your neighbours and they dont have there wifi secure i could go and dowload scooter etc and he could get a bill from ACS pirates.

This is nothing new, youll see from my previous post that I thought I'd try this out and downloaded an album using a neighbours connection, Talk Talk (I think) also published a report showing how easy this was and why the governments bill to disconnect file shares was seriously flawed.

well their wifi for their own internet connection and private network is secure through the modem/router, but the openworld network that is also accessable from any modem/router is open for all to use and theres sod all we can do to stop them. But as i said i believe they both the same ip address with both connections going through your router or modem. So anyone walking pass can use your routers connection to access openworld network and download whatever the hell they like, and it be you that gets the ACAS letter through the door.

Can I ask does anyone know who the other 5000 ISP's involved are?

 

What timescale do these letters normally operate under? Are people getting letters alleging infringements which have happened 2 years ago for instance?

I got my alleged accusation letter in June 09, it was alleging we made an illegal download about a year+ previous. we made this download (NOT) when we were on ower holls in the USA :mad: (apparently) :evil:. Up to now Tiscali/Talk-Talk, BT,Virgin,are a few who have rolled over without a fight and give out customers information.:evil:
