    • I'm not sure we were on standard tariffs - I've uploaded as many proofs as I can for the ombudsman - ovo called last night uping the compensation to 100 from 50 pounds for the slip in customer service however they won't acknowledge the the problem them not acknowledging a fault has caused nor are they willing to remedy anything as they won't accept the meter or formula was wrong.   I'd appreciate more details on the economy 7 approach and I'll update the ombudsman with any information you can share. 
    • To re-iterate and highlight my urgent question on this one: The N24 from the court did not include any instructions to submit paperwork 28 days before the date, unlike the N157 received for other smaller claims. Do I have to submit a WS for this court date? Link has!...
    • No, reading the guidance online it says to wait for a letter from the court. Should I wait or submit the directions? BTW, I assume that the directions are a longer version of the particular of claim accompanied by evidence, correct?
    • Thanks for opening, it's been another rough year for my family and I've procastinated a little.. Due to the age of my defaults on this and other accounts (circa 2021), I really need to avoid a CCJ as that will be another 6 years of credit issues. Mediation failed as I played the 'not enough info to make a decision' however during the call for some reason they did offer settlement at 80%, I refused. this has been allocated to small claims track, court date is June 3 and I've received their WS. I'm starting on my WS. They do appear to have provided everything required of them (even if docs could be reconstructions). Not really sure what my argument is anymore but I do want to attend court and see this through. Should a judgement be made against me then I will clear the balance within 30 days and have the CCJ removed - this is still possible isn't it? I'm going to be reading up today and tomorrow and hope you can provide me some guidance in the meantime. Wonder what your advice would be given the documents they have provided? I am now in a position to clear the debt either by lump sum or a few large installments - Is this something i should look into at this late stage? Thanks as always in advance
    • I have now received my SAR. It includes a great deal of information! Is there a time limit on how long account information is kept and/or can be provided to debtors? I have received many account statements which were not previously sent to me. I remember that the creditor should provide explanations of any acronyms and abbreviations that maybe used in the documents. Is this still the case? Also what, if any, are the regulations in regard to adding fees to a debt? Can fees be added to a debt after the court has approved a charge on a property. Perhaps due to the numerous owners of the debt, many payments I made were not properly recorded on the account, some were entered over a year after the payment was made! Following the Legal Charge, I paid every month until my payments were refused. I am trying to compute the over payments, but the addition of fees etc. is confusing me. Any comments and/or help would be appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

you did not answer one of my questions again! what do i know before anybody else? you obviously think i am somebody else and not genuine, as an individual owner with his own opinion you are obviously against me because you dont agree, if you read back you will see that i am saying you dont like anything about the park not just the latest 12 months and extra fees issue, you say there are no good points, that was why i stated why stay. Skonk i didnt stumble on this forum i was told the people against the owners had a website so i simply googled it and you dont have to be a physicist to find it. if you want to discuss something then fine be you have to take the blinkers off and realise that not everybody dislikes the site and not all object, people are genuinely happy ar golden sands

Why am I not surprised that you are happy to be subsidised. The shortage of seats was caused by management allocating more space for retail and less for people.

The extended season is great for those who want it, but they should bear the full costof it.

 

you say those who want it should pay the full cost and then say you dont want it and have later called me selfish for paying my fees and then booking for every function. if there are so many that dont want the 12 months and will not be using there caravan then it shouldnt be very busy if what you say is true

In the winter entertainment guide all of the party nights have limited tickets and some have aditional costs. There is no mention of being able to pre-book tickets. Also if you have booked tickets to every event then you are obviously a selfish person.

 

who told you there was additional costs, because when i booked tickets there was no cost for any event. how can you call me selfish for attending something i am entitled to. at the breakfast the other week i did not recognise more than 4 people who go in the main function room at weekends, so these people obviously do not use it as you have said it is simething the new owners have ruined, you certainly dont like an objectionate view to yours do you. at the end of the day i have a catavan on golden sands i have paid my fees i and all my family enjoy all the amenities we have and we intend to enjoy the extended season and the extra events END OF!!!!! wether you believe who i am or not i will not lose any sleep. why do i answer all your questions but you never answer anything i ask? you just becoming antagonistic and try to be detrimental towards my opinions, it is wuite funny really, selfish i am not

G'd morning monchenblue, Which one of your questions did I not answer?

I took the trouble to address each point separately,so what did I miss?

How do you know before anyone else? was a question put to you! and you haven't answered!! I admit there were some things that people were not happy about under the previous owners, but nothing serious enough to cause a public out-cry as the present situation has. By your own admission you came on to this thread to support the management!

You didn't comment on if you would be prepared to pay the full cost for the extra season without being subsidised.

If you have booked every function without consideration for others then you are indeed selfish. and determined to get more than your moneys worth.

The additional costs were detailed in the winter entertainment guide, sent to every caravan owner. And as i said before no one is aware of being able to pre-book. The selfishness I have commented on earlier. You are all entitled to your opinions, Beacuse my views are different to yours, you accuse me of being antagonistic.

Monchenblue it appears to me that no matter what the management on Golden Sands decide to do you will favour it. I am afraid this puts you in the minority as most owners don't approve with whats going on there at the moment.

I love this thread! Every time I check, someone with less than 5 posts just happens to stumble on this thread, on the whole internet! If I ever got into a fight, I'd want Just-ice on my side!

These "new-commers" are happy with the site, it is better than what they had before. However if they weren't on this site before they cannot make comparisons.

just what i thought your comment these new comers just sums it all up, i will not get into anymore with you as you are so self opinionated it is unreal, when i make a comment of my opinion it is wrong, but it isnt because that is MY opinion alone. by the way you never did answer if you do still own caravan on the site and if you have paid your additional site fees? three times i have asked but you never answer, very starnge?!!!!!!! the list in the office for the functions is huge, so when you have your next meeting about the owners please do not forget to mention it as it is mentioned during the entertainment in the club every week, sorry i forgot you do not like the club so probably do not go in there, if that is the case what is the problem with others booking tickets!!!!!!!

monchenblue the issue is not about newcomers, if you had read and digested previous posts you would realise that the issue is that alot of people don't want to use there caravans in winter but have to pay to subsidise those who do.

 

Why should people have to pay for something they're not going to use?

 

I personally would put the £595 towards a winter break in the canaries rather than spend the winter in Rhyl ;)

My opinion is that just-ice has got you sussed. And your fishing trip has left you with an empty net.

You and happy as larry are singing from the same hymn sheet. And your grab all attitude is in line with management thinking.

Aprox 300 vans X £600 = £180,000. A tidy sum!

That is £37.19. per van per week.

If 150 of you want the extra season you should pay £74.38 per week and the gas you use will still be subsidised.

Are you prepaired to pay that monchenblue?

Well monchenblue I find it ironic that you think I should answer personal questions, when you won't. Wheather I am on the site or not, I have not paid the extra costs.

What is strange!!!!!! is the amount you Know about the office. (as a van owner?) !!!

You ask the problem with booking tickets?

Do you remember the owners party last year? a lot of owners didn't get tickets because they had all been pre-booked. On the night some of the tickets were not claimed, and so deprived others of attending!!!!!!!!

I don't know about the specific designs, but Halsneed Park at Whiston has been a residential caravan site for over 45 years.( Before double glazing was popular in Houses.)

what a good thread.

the owners that have not payed ,do have a good cause, because if their licence states they can only use the caravan March to October, then even if they pay the £595, they cannot use their caravans if their licences are not updated, as they would still be in breach of their contracts.

So be careful.
