    • The first thing you need to do is for your father to send Argos customer services an email saying he wishes to return the item within the 14 day cooling-off period under the Consumer Rights Act 2015. This is important because he needs simple proof to back up his request, as they are being stubborn. The contract is between your father and ARGOS. He has to cancel the contract and receive a refund back to his debit card.     • TfL take abuse of staff passes very seriously. If the pass has been confiscated I imagine they will write to them and it could result in the card being suspended for a time, as I understand it. I hope you've told them about the card being confiscated and why? We need to know how many times you used the pass please - how many weeks at 2-3 days a week. Later I would expect TfL to write to you as well, possibly with a schedule of journeys made with the card, to ask you to tell them which journeys were you. They will ask for your side of the story. We can help you to refine a letter to send once they write but you need to start it off because you're the only one who knows the full story. I suggest something like this. Paragraph 1 a short explanation of why you used the card on the day you were caught Paragraph 2 you know you made a mistake and you regret it Paragraph 3 you understand how what you did is wrong and the effect it has on TfL Paragraph 4 you have taken action - tell them what - to ensure that this doesn't happen again Paragraph 5 you ask if they would allow you to pay the outstanding fare and their administrative costs to resolve this Please don't copy and paste what I've said, use your own words. HB NB This is a suggested reply, don't send it before they write to you because we need to see what they say.
    • I purchased the phone last Sunday evening, online, and paid online.    it was collected in store on the Monday afternoon, and then the return was attempted the following day, the Tuesday. 
    • Thanks honeybee13, They have not been in touch with with my partner yet. Will my partner be implicated? I really don't want to and have to live with knowing that the pass is confiscated and will not get it back?? I must admit i use the pass non peak and use it for 2 or 3 days a week.  I have no excuses and am bad in writing letters. I have read some thread and sample letters but i don't have mitigating circumstances. My mind is totally blank and can't sleep.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

HI Guys,

 

I booked a hotel with XcapeWithUs.com using the M&S Mastercard. I have just checked their site to find out they stopped existing as of 30 Apr 09! I've spent almost £400.00. How can I get it back?!!! :(

 

Plz I need your help quick

going to start our own thread but my OH booked a stag wknd accomodation with this company, paid the final instalment on 28 April then they say they go bust 2 days later!!!!!!!!!!!!! [problematic] ?????????Unfortunatly he paid over £2500 by bank transfer and 2 lots of £500 on his visa debit!

they were supposed to be going in 4 weeks.

have just spoken to banks, they say that they can assist with reimbursment of the card payments, just not with the bank transfer. in process of putting claim in writing to them now :(

 

did ring the hotel but no money at all has been paid to them. not good.

I'd advise as Janmal has done to contact the hotel first (as some MAY have been paid for), then if payment was made via a credit card then you must request a refund back....

No money has been paid to the hotel (not just the boys holiday but many other people travelling too).

 

Lloyds bank are receiving a lot of calls too. They told us to try the hotel and then put everything in writing to them to claim back the money that was paid on the card which helps but still leaves most of the money with Xcape. This was sent to them this afternoon.

 

Only some of them have travel insurance, not all :(
