Hi can anyone tell me how to find out if a bailiff is certified please

ask him for his IiD make a note of the court which certified him and check with them

 

dont ask the bailiff company in advance or they'll just send one instead that is (certified)

 

what is the debt?

 

you don't need to be certified to collect criminal /magistrates court fines or warrants

It is for council tax

council tax will be on a magistrates warrant and therefore the bailiff does not need to be certified

Phone the Ministry of Justice Public Register of Bailiffs on 020 3334 6355 and ask which court issued his certificate,

a bailiff acting on a magistrates warrant (ie when the debtor is taken to court for non payment) does NOT lhave to be certified

 

when collecting arrears as instructed by a council PRIOR to magistrates court then he does

if the council has a liability order for unpaid council tax then passes it over to a bailiff the bailiff must be certificated to collect it thats what I'm talking about

It should be 'certificated' certified usually applies to insanity - hmm sometimes not a lot of difference.

Liability Orders for unpaid COUNCIL TAX are issued in the MAGISTRATES COURT and NOT the County Court.

 

In addition, a bailiff enforcing a Liability Order MUST be certificated....

Hi what is the easiest way to find out if he is certified. I only have his name as he never showed me anything when he came

If you know their name then call the Ministry of Justice on 020 3334 3555 and ask for details of the certificate, the list is not always up to date but if they do find their details they willl be able to tell you which court certificated them, so you will be able to contact the court direct to see if their certifcate is up to date.

Done it and found out he is certificated, when and where

he is still obliged to carry his id with him and show it to you on request

 

if he is not in possession of this id when he calls then he has no authority
