I have recently been invited to a Interview Under caution regarding a benefit claim I made over a Year ago for Job Seekers I have been in full time employement for the last year, The letter states that they have reason to beleive I comitted fraud as I did not state a change in Circumstances.

 

I have no idea what this is regarding but I think it may have been caused by my employer, while on jobseekers I was offered a position and was due to start the end of January, a few days after the job offer they said due to circumstances there end I could not start until the end of February, I told the Jobcentre at my sign on day that I had found employment and would start at the end of february, they said I needed to continue to sign on till the sign on day before my employment started and then I could sign off.

 

Anyway after I started my new job and had signed off my employer told me that as the problem was caused there end they would back date my start date to the original start date and pay me for the month while I was waiting I did not think anything of it.

 

Now I have received this letter I am thinking the Jobcentre has looked into this as this is the only thing I can think of, is there anyway they could have checked my start date at my employer?

Hey I got one of those letters yesterday regarding me claiming JSA but they say I'm employed! My JSA (contribution based) ran out 7 weeks ago. Looking forward to the interview as I've done nothing wrong, oh and I actually am Unemployed (which is also driving me nuts). The letter comes over very intimidating which I'm assuming is scare tactics plus a nicely printed 'scary' leaflet. The DWP if I remember can come after you for upto the staturory 6 years.

 

BTW The Community Legal Advice mentioned is only 'free' if you can get legal aid and most cannot if someone is working in the partnership. In my case because my wife works I can't get any even though we are now in serious debt. They give you details of other bodies who 'might' help and it seems also ones out of your area. In my case it's going to have to be the good old CAB.

Post unapproved.

Government bodies such as DWP are very easily able to access information these days since there is lots of information sharing and databases are therefore easily reconciled.

If you have done nothing wrong then theres nothing to worry about.

If you have broken the rules-then more often than not telling the truth and coming clean will obviously be taken into account when action is being decided.

Most towns have welfare rights places now that will give free advice.

There are also many solicitors who specialise in welfare rights.

I guess it all depends on how the employer declared the adjustment. If they officially changed your start date, then this may now have worked it's way through the system via the tax office etc and ended up notifying the jobcentre. They could just as easily kept your start date as end of Feb, and have paid you a "compensation" for messing you about. This would not therefore have affected your signing off date and I guess you wouldn't have this problem now.

 

Hindsight is such a wonderful thing though isn't it. ;)

....and here we see what could have been an easily solved problem! When that letter arrives from the DWP one thinks of being 'carted off' to some Victorian Prison! To me, a simple question from DWP would have been adequate instead of the heavy handed 'Under caution Interview' demand. I keep thinking of those people who 'get away with it' for years!

Not much chance of being carted off to some Victorian Prison Michael since they are all full.

Theres talk of some new super prisons being built-which is probably why some of the Polish builders have changed their minds about going back home just yet;)

The super prision idea has been dropped, (no money available - HA HA). The DWP are hopeless really and chased me when THEY owed me one weeks money.... I went for an interview and told them their information about my start date was wrong, and that I had the interview on the date they claimed I started work and actually started the following Thursday, the day after my signing on day (which I did). They still didn't give me a weeks money. They thought I had been overpaid by two weeks. CHEEK - I've been paying into the system since I was 16 and this was the second time I'd been unemployed (for three months) in 12 years!

Just an update...

Went to the 'under caution' interview alone. Luckily I was expecting the worst but did not feel intimidated and said what I needed to. Very amicable and ahem, never got offered a cup of coffee! Shall we say the interviewer was 'desirable' too (which helps!). LOL

Not heard anything back yet. Probably have found my case opens up a can of worms regarding the DWP Minister (blatantly lying on TV) and the general role of the jobcentreplus service. Eg., JC told me it was not their role to find people jobs as there are recruitment agencies for that.

I suppose if you was comfortable with things then thats abit of a pos.

Shame about the Coffee....bet theres more designer water machines anyway-they are springing up everywhere...keeps em in jobs I suppose.
