If a bank does not have a copy of my CCA as requested over a year ago (they have admitted as much) then does that mean that they are in breach of the Data Protection Act by passing the debt onto an outside DCA for collection?

If so, are there any good templates for letters with reference to this that I could "borrow"?

I have already sent them the "bemused" letter but I want to be ready for future reference.

Thanks in advance.
