Hi all,

 

I got this letter from Intrum Justistia this morning and wondered if someone could confirm for me what I am thinking. Here is the letter:

 

Thank you for your recent communication. Please accept my appologies for the delay in response whilst we contacted the original creditors.

 

In your communication, you requested a copy of your signed credit agreement under the Consumer Credit Act. We have requested a copy from the original creditor, Sainsburys, but have been advised that they are not able to supply a copy. Therefore the account has been returned to the original creditor.

 

Whilst we are not able to supply you with a copy of the signed credit agreement, the contractual relationship between the parties in relation to the credit agreement does, as a matter fact, exist. The account reference number under which Sainsburys opened the account was xxxxxxxxxxxxxxxx. the account open date was xx xxxx 2003. At the point that the account was passed to us on the xx January 09 the oustanding balance was xxxx.xx. (a lot of monies,...!!!!)

 

However, in accordance with the Consumer Credit Act 1974 we will not be taking any further action to obtain repayment of the amount outstanding. You will recieve no further communication from Intrum Justistia Ltd in relation to this account.

 

Intrum Justistia Ltd has contacted the relevant agency's to update your credit file accordingly. In relation to your request for a refund of monies paid, you will need to contact Sainsburys direct in respect of this enquiry as you have not made any payments to IJ Ltd directly.

 

If you require any further info blah blah blah.

 

 

 

 

So what does everyone think?

Just to also say that I was informed by Sains and IJ that IJ did infact buy this debt and Sains made it very clear to me that they wanted nothing more to do with me... nice huh? I reckon they must have done something really wrong.... but hey, 2000.00 worth of charges is one no no I guess.

So As IJ were the legal owners of the oustanding amount, am I right in saying that they've written it off?

 

Any suggestions would be great, and hopefully good ones.

Yep - guard it very safely :wink:

:)I am not an expert, but I can give good advice about Brighthouse:)

 

Am learning more and more about DCA's too :)

 

I have no legal experience and all advice given is based on the knowledge I've gained from this site.

not if you don't have the original agreement it doesn't.

 

If it was "a matter of fact" then they wouldn't be sending it back now would they - great result well done.

Thanks to you all so much for your comments and I so appreciate you all very much, I wouldn't of gotten this far without all of your advice, and although a dont reply a lot to people threads, its just cos i dont wanna give the wrong advice, but I am thinking of you all and hoping for great results will all of your challenges.

We will win, we just can't give up.. never!

One thing I have learnt is this, I wil NEVER EVER use credit again, if i aint got it then I cant spend it - end of!

Still 8 other creditors to go, and each one is so different in response to the CCA request, but I will keep the forum informed.

Oh, and Ill be framing that letter and putting it on my wall!!! ha haha ha ha

When I first read the letter and read this I nearly cried!!!! and thought HOW RUDE DO YOU WANNA BE?????!!!! but they obviously were just stressing their annoyance of the action they now know they would have to take! YAY!

That's a first for IJ to actually pass on your request for a copy of the Agreement to the OC.

 

I actually had two other accounts with them for two other seperate creditors, one Mint and the other Argos Additions.

They hadn't bought the debt from these so have just closed the account and passed them back to the OC's, which I am rather annoyed about, but at least it keeps them off of my back until I figure out a game plan for these also.

It was a bit strange really, I was paying Sainsburys for years directly and was in an arrangement with them for the last three years paying all we could. Then in October 08 I got a letter from Sains saying they had sold it to IJ, wanted no more to do with us and would no longer communicate with us as the leagal owners was now IJ. the minute I got that letter I prepared to send a CCA and SAR to IJ knowing they would be in contact soon. A MONTH LATER!!!! I get a letter saying they are working 'FOR' Sainsburys..... I was like ...er.... thats not what they said kinda thing.

So I knew this was my opportunity. In the CCA request I made it very clear to them what Sains had made clear to us, so i guess then they realised they couldnt fob us off! :p

I wonder if Sains got into trouble... um....... funny that.

But hey what a miracle!!!!

LOL dont I know it..... I will keep check of my CRF for sure....

Will update the thread once I have an absolute delete from my CRF.

Um, had a quick thought, does anyone think that I should send IJ letter confirming reciept of theirs and that I will be expecting my CRF to be updated accordingly within 14 days or something to that effect, just incase they might forget?

 

Any thought or how to word the letter would be great,

You'll have to check your credit file in a couple of weeks to see exactly what the update is.
