Some time ago I took my hsbc credit card to task over my charges , and they paid back all I asked , Being a bit green I did not charge them all the interest I could of , but they took me to the doors of the court before they coughed .

Later on and not directly related Hsbc threw me off , and set dg solicitors on me for the balance of the card.

Recently i sent dg solicitors who i had a payment plan with a Cca request , I have had No response after a month , so i sent them the default template letter . in the meantime as I am a month late with a payment they have sent a letter demanding full payment of the debt within 10 days or they will take me to court for a Ccj plus costs , they are claiming that they are doing this under the instructions of their client Hsbc .

i am concerned , should I have sent the cca request to hsbc , as dg seem to have completely ignored it , do they have a duty to deliver it to their client , i have proof of postage receipt .

if dg have not responded to the cca and your letter, then cease payment.

they can threaten what they like.

they have no legal powers i bet.

 

NO CCA = NO PAY.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Remind DG solicitors on they haven't complied with your lawful request and while the default continues they may not threaten nor take any court action unlikely if they cannot produce a "valid" agreement

 

HSBC will swear their paperwork is in order, their arrogance holds no bounds, be prepared for a long fight!

Thank you , I took this card out about 6 years , Still not sure Are Dg liable for the Cca request or should I send another to HsBc ?

If you sent DG solicitors your request, they still have to fulfil their obligation and stop making payments to them ;)

 

By fulfilling their obligation , do you mean it is legally their responsibilty to comply , or could they get tricky by referring one to the other , are dg part of hsbc ? , thank you .

When you made the CCA request to the solicitors they have a obligation under the consumer credit act to fulfil your request

 

DG sols are part of HSBC, their staff get HSBC payslips

Thank you for your recent correspondence, contents of which are duly noted.

 

 

Frankly, I am surprised of the need to remind a firm of solicitors about the terms and conditions surrounding my Consumer Credit Agreement request (Consumer Credit Act, 1974); received by OC/DCA on xx/xx. I can only assume therefore that they failed to inform you.

 

 

Should your client now persist with threats of legal action as stated in your letter, I will welcome the opportunity for a judge to look at several offences committed by OC/DCA under The Consumer Credit Act, 1974, as well as your client’s non-compliance with and total disregard for the law on this occasion.

Thank you these people are tricky , does anyone know any more to stop them in their tracks , trying to get a ccj , once they realize that their debt is unenforceable . It wold be preferable to nip them in the bud rather than have a race with court docs etc , much appreciated x.

CCA the OC to be on the safe side, send by recorded, keep the receipt, then send the acc. in dispute letter, if no reply after 14 days

Thank you I sent them an "in dispute ' letter , and then got a reply which compared to their usual correspondence was actually quite civil , there is a line in it " I must point out to you that the information you are requesting and the wording used is not to{sic} dissimilar to requests from other customers ", doggone they are on to us !

I have been sent a copy of my original Credit Card Request Form, subtitled ,,'credit agreement regulated by the consumer credit act 1974, this agreement is made between hsbc bank and you , the customer'.

The details are mine in my writing and I signed the bottom box , 'This is a credit agreement regulated by the consumer credit act 1974 , sign it only if you want to be legally bound by its terms '

Also enclosed with this copy , although in no way attached was a copy of hsbc credit card terms and conditions ,, I think by the correct layout the new form , these are not signed by me .

Am I correct in thinking what they have sent me is invalid under cca 1974 as , there are no signed terms and conditions as it was an application form ?

Dear Sirs,

 

I write in response to your letter dated XXXXX

 

Your letter is incorrect and frivolous, you are fully aware of legally valid reasons why no payment has been made on this account, namely that the agreement which underpins this account has not been supplied despite a perfectly valid request and furthermore, it is suggested that notwithstanding the failure to supply a copy, the agreement itself is improperly executed, devoid of all prescribed terms and deficient in respect of detail relating to APR, total charge for credit and statements of rights ,remedies and protections as required by schedules 1,2 and 6 Consumer Credit Agreements Regulations 1983

 

Therefore the agreement as outlined in section 65 (1) Consumer Credit Act must be laid before the court to be granted an enforcement order before any further action can be taken

 

It is my view that the court would not grant such an order due to the deficiencies that I have outlined within the agreement, further more this has already been raised with HSBC, and the absence of any documents disproving my points itself speaks volumes

 

Therefore, I would indeed welcome the opportunity to place this before the court. furthermore should you proceed with the threats to issue a court claim, I will make an immediate application to have it set aside for the grounds outlined above, also I shall refer the judge to this letter when the matter of costs falls due

 

I trust this outlines my position clearly enough for you

Can you post up the "application" form?, i'm rather interested in what HSBC have sent you

 

they sent me an application form last year to do with there credit card no way was it enforceable, no prescribed terms at all

 

DG sols will threaten you more, will say it is enforceable and pay us or we will start court action etc

YEs I will try , I have to get my better half to help me , what was the result of your saga with dg , do you have a thread i could view , rgds

Didn't keep my thread updated with my battle with DG over the credit card as when they sent me the application form i knew straight away it wasn't enforceable so sent off a in dispute letter immediately to DG, then HSBC sent me a letter the application form was perfectly executed, not likely, another letter to them telling them why the agreement was not enforceable, HSBC wrote back saying the agreement was valid and they were taking me to court, DG kept sending letters threatening court action over 3 month until i wrote back if they think the agreement was valid take me to court... 6 months later no court action, no letters off them funny that isn't it :rolleyes:

 

DG solicitors are not easy to shake off and will not take no for an answer as you have found

Interesting , I found by sending them a letter from here ,their tone changed for the better , although their letter contains a veiled threat at the end ,

"I would urge you to continue with your repayments and consider taking legal advice before entering into any further communications on these matters "

When you sent off the dispute letter to dg , your reply came directly from hsbc , not via dg ?

Would it be possible to see a copy of your application form , to see if it is the same as mine , as I have never scanned before , and my better half is not living up to her name , thank you for your input ,
