I was made redundant last september and after a lot of grief i finally have a tribunal date which is coming up soon, i am claiming for unfair dismissal on the grounds that i was scored low on a matrix scoring system for my attendance, i had 21 days off but 19 were due to injuries received whilst working, there were 3 separate incidents, only one being recorded in the accident book, that really is my argument, how can it be fair to penalise me for this? Also i was never shown any health and safety (lifting techniques etc).

We have exchanged all relevant paperwork and are now just waiting to swap statements, i am claiming £7,000 and received an offer of £1,000 today which i rejected, i then received another and 'final' offer of £1,500

 

I would just like to know if anyone thinks my case is strong and is £1,500 a fair payout?

Firstly, congratulations on beating any limitation issues. You suggest the Tribunal has accepted your claim. Clearly good news :)

In order to advise on the strength of your case we would need MUCH more information, and ideally a F2F interview.

 

In the absence of this, to advise you on 'value' we need some info please:

 

1) Your employment start date.

 

2) The date your employment contract was terminated by reason (supposedly) of redundancy

 

3) Normal working pattern - hours and days please, and remuneration how was this calculated?

NB The info at 1,2,3 is purely an example to ascertain a hypothetical valuation on a successful claim for unfair dismissal with ancillary heads of claim. In order to claim any money at all or 'heads of claim', you would first need to prove your case on the appropriate legal threshold. On the facts in the OP, I cannot comment on your 'overall' prospects of success.

I was employed from april 08 to sept 09 i worked a 45hr week over 5 days.

I was paid £7.50 ph for first 40 hours then guarenteed 5 hours per week at £9.25.
