GE Money only sent half the aggreement in response to CCA request

My wife had a store card and when she got into finacila trouble she contacted GE Money and asked for a CCA, i guessed they only sent part of the agreement because sections that are refered to are not there. What does this mean?

 

should I try writing to them to see if they have the missing bit, or admit they don't?

If the part they have sent you has the prescribed terms on it then possibly the rest is not needed and its enforceable anyway. Probably best for you to post up an image of the document after removing any personal information from it.

 

You'll get more advice on whether its enforceable then.

Yes please post up what you have received I would certainly be interested as I only had part sent to me. It will be interesting to see if yours is the same. DG

the small print in the signature box referes to section 11 of the agreement, but the copy they have sent only goes up to section 6. have written to them saying i need the rest of the agreement to satify request under section 78; if they have the original it would be easy to turn it over to copy other side, if they only have a copy of the front i think they are stuffed.

I see that GE Money is now part of Santander, and it would seem to me that they have sold off all their "bad" debt, in the case of wife's evans card it is now in the hands of CL Finance, should she be worried, should I send than a bemused letter as GE money never fully complied with my CCA request?

 

We have heard nothing from E Money, and wife's credit file shows nothing about the account being takn over, although it does show the account as having an Account Query.

 

They have said in they will honour my concessionary payment, so should i just let sleeping dogs lie?

Are you still making payments by the way?

 

Anyway, you can send the bemused letter if you wish as GE Money should not have passed it on. Trust me CL Finance are nothing to worry about - just like the rest of the motley DCA crew.

I'm dealing with CL on an Evans card. I've had no problems with them so far and I'm making reduced payments. There are posts where CL just put a small note in a box on the statement and say it's been sold to them. It's not happened to me so far so when the statements arrive give it a good check. I am going to CCA them at a later stage but at he moment I've got bigger fish to fry. On my BH account with GE it was sold on and I only got the top copy of my so called agreement so don't be suprised if they can't produce anything.

Just checked wife's credit file. The entry for GE Money has disappeared, and an old entry for a Evans card that was settled in 2006 has now changed to Santander Cards UK (Evans). GE or Santander never informed us of any assignment, only CL. Not sure what to do here, guess I'll just wait till i hear from CL again and then ask for proof. This alleged debt is not on credit file so what is the position, does the debt no longer exist, should wife still be paying them £1 a month, will CL replace GE on the file like 1st replaced Citi? She stopped paying them when that happened and has heard nothing for months, should she do the same here?

An entry for CL Finace has now appeared on the credit file (same sort of thing as happened with 1st and Citi), now I know for a fact my wife has never had a Credit card/Store card with CL finance. So I guess we may be treating this the same way as 1st and Citi, and stopping token payments; definatly will be if they start being funny.
