My employer has withheld my wage slips for the last 10 mths. Each time I request them I get excuses and promises but no slips. My colleagues have received theirs. I suspect it is because he isn't paying me what he promised in my last salary review 10 mths ago. Without these slips I can't work it out. Does he have a legal obligation to provide them and can I report it? Thank you for any advice

You are legally entitled to payslips - give ACAS a ring.

 

However your P60 should be done soon so you will be able to see if you've had the pay rise.

This is correct, the right is contained in the ERA 1996:

 

An employee is entitled to an itemised pay statement 'at or before' every payment of wages or salary. The right to receive an itemised pay statement is an absolute one and is not conditional upon an employee requesting such a statement The required particulars are:

 

 

  • — gross pay;
  • — deductions (see below);
  • — net pay;

and, where the net pay is paid partly in one way and partly in another, the amount and method of payment of each such part.

Thanks Che, that certainly clears a few things up. I expect ACAS will advise my next step as the civilized way hasn't worked. On a side issue I don't have a contract neither do my colleagues and they have just been docked pay for having a day off sick........another one for ACAS?

Firstly, an employee is entitled to a Statement of Main terms of employment within eight weeks of starting employment. So you can also claim this.

 

Secondly, if an employee is sick for one day, in the absence of a contractual sick pay scheme, they would not be entitled to any wages or SSP. So they may not have been entitled to any pay for the day off sick.
