    • Yes that looks fine. It is to the point. I think somewhere in the that the you might want to point out that your parcel had been delivered but clearly had been opened and resealed and the contents had been stolen

You want to know what is there – but also very importantly you want to know what is not there. For instance, the email that they said they sent you before responding to the SAR – did you see that? Is there any trace of of the phone call that you made to the woman who didn't know anything about SAR's? On what basis was the £50 sent to you? Was it unilateral or did they offer it and you accepted it on some condition? When did they send you this £50 cheque? Have you banked it? Also, I think that we need to start understanding what you have lost here. Have you lost any money – and if so how much? Send the SAR to your bank as advised above

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i had a loan with barclays partner finance, i asked for credit agreement in september 2008,, they have not been able to supply me with one and have now cancelled the loan , removed my default, and placed settled on my credit file,, £11000 in total,loan was £25000,, does anyone know can i claim any interest or charges from them?????

dont know if im missing something here but if you have had 11000 wiped off a debt you owed, i would be more than happy with that. without claiming charges and interest... one is a victory the other is greed. maybe thats why the more experienced members havent replied......

i asked for agreement, they sent it to dca, the dca then sent it back because they could not produced any agreement,, yes i did stop paying as soon as they did not send anything,, i spoke to person at dca ,, and they told me barclays did not have any agreement to produce!!!

sorry to be a pain but i wish they where all as simple as ur case,

so did u not hear anything at all from Barclays when it was sent back to them up to them telling u now that they have cancelled ur credit agreement.

By the way im no Financial Expert but im of the same opinion as u scew them for all they have got because thats what they have been doing to Joe Public for years, Im sure somone with more Knowledge about charges will be along shortly, personally i would go for it, whats the worse that can happen if u have got it in writing that they have cancelled the loan, just my own opinon.

Agreed and to be honest i am finding it hard to believe. Barclay's never back down that easily having experienced them. I would like to know who their acting DCA was in this situation if i may ask?. Also when was the loan taken out and when was the default made against you?. Sorry for all the questions but i would like to know.

 

Furthermore with them writing of this alleged debt and closing the account as well as removing the default, i think it maybe difficult in claiming any charges back,why re-open a can of worms, quit while your ahead:)

Payback68 makes a good point. If you reopen the can of worms to try and reclaim payments etc. they will make a renewed effort to find the CCA or find a way to wriggle round the 'problem'.

Hi there,

 

Need some help with my barclays staff loan... I no longer work for the bank and had a loan whilst i worked there... I have asked for a copy of the ca at the time as this was done over the phone they sent me a letter with the balance on the account and advise the loan was agreed in line with the terms and conditions at the time of the loan being taken out, this maybe different a staff loan but surely im not staff anymore so should be a normal loan covered by a ca... I have placed this into dispute with a loan free compnay but they have taking for ever to get back to me, does anyone have any knowlege on this???

Thats a result, but how can you claim interest and charges for a non existant loan, sorry but the monies paid will be considered a gift, the same as the amount they wrote off is a gift to you, I would leave well alone now, and keep all correspondence just in case they pass the account on to a bottom feeder DCA

dca was capquest,, loan was taken out in2005,, they could not produce a agreement of any sort,, i got intouch with the credit file agencys who also ask them to justifly there entries on my file,, hope that helps,,
